"it was the responsibility of the Executive to assent to Bills made by the Legislature or go to court to challenge them" (quoting a Senator from Kebbi). I am shocked to read this kind of statement coming from our Senator. It shows he may never have opened the Constitution to see its provisions. I am afraid this Senar may not even have a copy of the Constitution. First and foremost, the Executive have no Constitutional obligation to assent to every bill chorned out by the Legislature. They have the Constitutional power and discretion to withhold assent and they can exercise that power without going to Court. However, when the Executive withholds their assent, the National Assembly can veto such power by re-passing the bill with 2/3 majority and the bill automatically becomes an Act and the Executive assent will no longer be required. See Section 58 of the Constitution. |
