@ OP, you forgot the fact parties still have the exclusive or inherent rights to approach a competent court within jusridiction for preservative rights in prsonam or in rem , for interim Orders preserving the res (subject matter of the suit and this could also take years) because any Orders sought and obtain are appellable by a party so dissatisfied by the above said others. Arbitration clause simpli cita, does not cut it. Litigation will still find a way in. Pls see the Arbitration and Conciliation Act, and rules incendetal thereto. NB: If my client briefs me and all he wants is time, trust me to use everything within reach to do the needful. |

Good one @OP but the right word in that clause should be 'resort' and not 'result' Another important ingredient in an agreement is to check against wrong use of language or words which may create ambiguity and difficulties for the arbitrator! |

The clause is not widely applicable. Parties may not be in Lagos. Also parties may not agree on a single mediator or arbitrator. That being said alternative dispute resolution is always a better alternative than litigation. Take this from a lawyer with almost 10 years commercial legal experience.
