So what u mean is thatinec should be more powerful than the judiciary. Men I think u should try to read what u write. Evenbinec cannot be more powerful than the legislative it just that the process it take to get a constitutional amendment is discouraging, that is why we would be stuck to the 1999 constitution as long it favors the politicians.

senatordave1:
The court cannot have powers more than the constitution because the constitution created the judiciary.how can you be more powerful than your creator? In any case, the supreme court has the power to rule against inec and change constitutional provisions but until then, what inec decides about elections remains finak.except a court rules against them or the constitution is amended.

It's clear that Buhari and his cohorts at INEC plan to really rig this election but that will not happen

The best thing the 8th Senate led by @bukolasaraki has done to our Electoral Process is shifting the Presidential Elections to come last.

It will solve the interference of the president in all our elections. And @inecnigeria MUST comply with the LAW.

But the 1999/2003 elections, presidency was last, what law did that come from?

We should all know that the proposed policy from national assembly is best for democracy.

Sir, basically that's the argument. Only inec can fix dates for election in Nigeria. The Constitution under sections 73,76 and 176 gives inec the powers to fix dates and pattern of election. They can choose to hold presidential election first in 2015, second in 2019 and last in 2023.

Thank you for this sir.you have laid this issue to rest.johnnyessence, waveman, farah, aideed and esseite please read this guy's submissions and take note.anything that has to do with election ordering, sequence, timetable, conduct, declaration of election results, registration of political parties, whether the nass or governorship or presidential elections are coming first or last or middle or are the exclusively and solely the duty of inec as vested by the constitution.the electoral act which nass amended to reorder the polls is inferior to the constitution.any reason you have to justify the reordering be it strengthening democracy, stopping bandwagon effect or removing buhari remains your personal opinion and cannot supercede the constitution.lets not overflog or drag this issue anymore.the only way is for nass to amend the constitution or the supreme court to set a precedence.

You are wrong. Even the INEC chairman stated that they are change the date if there if required. Go back and read the news again.
Once the bill is passed, INEC has no choice than to obey.
A bill when passed, is also a law. It mustn't be constitutional amendment.

You are still getting it wrong. NASS is not contesting the date of election with INEC, they only trying to pass a bill that will remove that power from INEC. There no need of whatever court in this case. Supreme Court will come in only when there is something to contest. Right now there is nothing to contest.

You see,ou are the one that is getting it wrong.seems your ignorant of our laws.you have even contradicted and made a fool of yourself.everybody arguing with me have buried the issue, why unearth it? If inec has the power to reorder the sequence of elections, does it not occur to you that only a constitutional amendment is thr only way to take away that power? Does it not occur to you that a common bill like the electoral act is inferior to the constitution? If you did government in school, were you not taught that the constitution is superior to any other act or statutes and that any other law in conflict with the constitution is null and void? If you were sciencd oriented, why not ask questions? Didnt it occur to you that the only way to alter inec powers is an amendment or one of the parties going to court to seek clear interpretation.if you cant interpret the constitution, look for the interpretation act and read before you jump to issues you know nothing of.

You arw very annoying.this is a constitutional matter and you must read the constitution.the inec chairman said all those things from his personal view.as of this week after going through the constitution, you can see his latest opinion.you dont even know what ths contention is about, its not about the dates but which elections is to come first be it governorship or presidential.nass passed a bill to take away that power from inec which is the wrong way.you cannot pass a bill to change what is in the constitution because a bill is inferior to the constitution.you amend the constitution.so please dont say what you dont know.

And the bill you mentioned here has been passed for second reading. soon it will passed third reading too. you just have to allow the legislative arm of government to work effectively. as it stand, inec doesn't have power on their own.
