The only time babies on a U.S. registered plane are granted citizenship is if the aircraft is in U.S. space either over land or water. Once you are outside of the space your ciizenship depends on the nationality of the mother or father.

If I were to represent the child in Court particularly on the 3rd factor, my argument would be this:

The air carrier registered in the United States as a Corporate entity is an artificial person in law and the law applicable to all activities therein is the law of the United States.

In the view of the above, the law to determine the citizen of the child will be the law of the US applied strictu sensu.

Flying over the airspace of another country when the birth was taking place is not a factor to consider for grant of citizenship even where jus soil is applicable. This is because being inside the US registered aircraft while on air does not automatically puport the aircraft is in Mauritania airspace even though it actually is. It simply means being inside a United State territory until you have reached your destination as contracted with the air carrier company.

The aircraft is an artificial citizen of US with permission to fly over the air space of many countries in the course of its business. Had it been the aircraft was not registered under any extant law of any country, citizenship would have been automatic with recourse to the third factor mentioned by the OP.

Particularly on the case of first landing of the plane after child's birth.

Let's say mother leaves Lagos for US and plane has stop over in London.
Her destination is US, not London.

If she gives birth on the Lagos-London leg. She and her baby will be taken off plane and put on emergency vehicle for transportation to hospital. She will not complete her trip to US on that plane. At the hospital, by UK law, the baby's birth must be registered right away. Because the registration is done under the seal of Her Majesty Queen of England, the child's birth records for the rest of its life takes reference in UK. The baby should be able to take UK citizenship.

The first treatment center and jurisdiction that attends to the new born's health and registration of birth is reference for citizenship.

I read something similar to this a while back. A woman lives very close the border between two states. She lives on farm in New York but she will drive two miles across border to Masachusets to buy items for her household. She went into labour in store. They called ambulance and she ended in hospital in that state and gave birth. They said because of this the child is citizen of Masachusets. Oyinbo people sometimes have one or two screws loose in their head. I cant understand how New York and Masachusets are both in America but they have divided citizenship. So the child now carries two citizenships, that of Masachusets and the one for America. I didnt argue it because I needed the screws in my head to stay intact.

People born in Massachusetts are American Citizen. Massachusetts is a state in U.S and U.S is a country.


What I thought you were saying or intended to say was like how in Nigeria people born in Delta but there parents are from Imo state. When you ask them where they are from they say Imo.

Unlike in the U.S, someone living in Newyork and had her baby in Indiana, the baby would say he/she is from Indiana even though that the parent's place of birth could be New York.

Lets say for ease of clarity that a Nigerian births a child at her home in US and never went to hospital for care or registration but somehow returns with the infant back to Nigeria. How will she prove the child was born in US?
