If a Muslim kills a potential convert as an infidel during jihad because he/she hasn't accepted Islam yet:

1) would that be fair to another Muslim who initially rejected Islam but later got converted?

2) how is the Muslim doing the killing sure his victim wouldn't convert to Islam later?

3) in the above (No. 2), wouldn't the killer Muslim be guilty of witchcraft / sorcery if he claims to know the future of his victim in the present?

I am asking these because I have been confused about Islamic approach to conversion of nonbelievers.
