@OP, don't be biase in ur reports, u don't know who started the fight , whoever bleeds after a combat might aswell be the initiator of a battle.

While the end state of the two parties is not an indication of who initiated the attack. But the only way the man can escape being charged with assault, is to show some physical harm that he suffered during the altercation. That way he can argue that the woman attacked first and he only defended himself. But without that, he has no evidential proof, and should do the time.
