Brother do you really know what an appointment means? The CJN recommended to the president by the NJC correct, now the President has the prerogative to reject that recommendation since he is the one appointing him. Now looking at the famous Ayo Salami case, when the NJC recommended that he should be reinstated, the President refused.
Aye salami is different from Onnoghen.

CJN for that matter.

Buhari cannot unilaterally suspend him

Bros the appointment of the CJN is clearly stated in section 231 of the constitution and involves the three arms of government.

The removal of the is also clearly stated in the constitution and it also involves the three arms of government.

There is no how buhari can win this case.Justice Onnoggen will most likely return as CJN on Tuesday
No body removed the CJN he was suspended from office. must I explain suspended to you? bt the way have you checked section 11 of the Interpretation Act? check it. The President was relying on the Court order of the CCT, which has the powers to give such a recommendation on any Public Officer, the CJN is a public officer. and not that was an ex parte order, the Same order the CJN lawyers were using to stop his trial at the CCT. chech the 6th schedule of the constitution and read about the CCT powers. Then you can come back let's talk.

Finally, Onnoghen team of SANs has failed to stop proceedings on Monday. I actually didn't know why they were scared in the first place.

Monday is it!

I also like the noninvolvement of the acting CJN. He's left out of the process and it's cool.

That way decisions cannot be influenced and Nigerian people can see its transparency.
It's seems that you didn't understand what you read or you can't comprehend because it was also stated that HE , the acting CJN will be the one to pick the people involved on the panel.

It was SPECULATED that he will be the one to pick people on the panel.

BTW even if Buhari himself chooses the judges for the case he would lose woefully. The constitution is quite clear on the processes involved in the removal of the CJN

You guys are naive. If you catch a thief, you can't kill him because he stole. He has the right to defend himself. And if you don't have evidence, you might loose the case. You cannot thwert the Constitution by killing by killing him when the law hasn't take it course. The Constitution must be obeyed by everyone no matter who you are.If not, Nigeria is not an entity.
If the judiciary does not get this right,we are doomed for impending violation of the Constitution. We won't like the outcome when everyone says"Bleep the Constitution".
Very well said. But maybe I should enlighten you a bit. He is the CJN the number 1 judge... And let's say he didn't even commit any of the said allegations.. Fact one he can't precide over his own case.. CCT will refer their conclusion to NJC.. and who is the head of NJC? still the very same CJN that have allegations leveled against him.

In a country that truly obey the rules of law and Constitution as you claimed, the honorable thing for him to the is to stand aside and encourage them to carry on. But did he do that? Absolutely no! The first thing he did was to postpone the NJC meeting indefinitely so that they won't convene and hear his case/matter.. Next move he went to Industrial Court just trying every move to stop his trial.. for a Number One Judge of the Federation that's shameful he was suppose to lead by example

And what's now embarrassing and absolutely shameful is people like yourself that stop focusing on the allegations with proofs against him that he admitted he forgot to declare which shows he's a corrupt CJN and start romancing how he was tried or asked to stepped down.

No I'm not Naive.. People like you should have shame and stop discussing serious issue base on sentiment.

President Muhammadu Buhari should have allowed the Justice Onnoghen case to lie low and save Nigeria from all this needless paper work, time consuming processes, political distractions etc

I know the Nigeria judiciary is corrupt and they bitterly frustrate him for the three attempts he made to contest the presidential election.
buhari didn't win those elections stop saying they frustrated him if not for d apc merger buhari would have retired from politics...

That's what they always say they're fighting for to attract national and international pity.

What's democratic in defending an obvious looter? It's just baffling where our lawyers stand sometimes in court.

Well, it's not new, even Evans the kidnapper have a lawyer that represents him.
The law is sacred... there is a presumption of innocence, until proven guilty in a competent court of law; even where he has admitted to guilt - he still deserves a fair representation (S. 36 of the CFRN).

This is even More so where the CJN - The Most Senior Judicial Officer in the Land, is involved.

Lawyers need to protect their profession from a tyrannical president. If this was left to fly - it will create a bad precedent - that future presidents can, at their will, remove Judicial Officers without recourse to due process.

One thing the public fails to note about these suits is that they do not bother on the substance of the allegations - they are just about due process and constitutionality of the suspension.

Buhari is just another dictator - in a sane country he won’t even be considered by a political party let alone the presidency.

I'm telling you and I realised majority of our problems is not just the leaders but also most of the followers have serious problems.

You said your politicians are corrupt.. the top level people are corrupt.. now they bring corrupt people before you.. you're still complaining they didn't follow due process.. Ukrainian trashed there corrupt politicians in the bin.. when they were tired.. they went to parliament to pick them up one after the other and through them in the bin.. Does it matter how corrupt people are taking out of the way?

Some people are just clueless forgetting the fund this people are looting is also there money.. Some Mumu followers Dem.

like GEj suspending CBN Governor and also preventing him from traveling. CBN Governor like CJN are appointed by the president too, just like EFCC chairman.

See below. It's same situation with the CJN. He's the chairman of NJC and would not sit to adjudicate on a matter that concerns him
Two wrongs don't make a right.

If at that,

D CJN is nominated by the NJC.
and confirmed by the LEGISLATURE. after the Executive sends it to them.

You can see how the three arms of government plays a crucial role in appointing CJN.

Another illegality is why would the Executive appoint An acting CJN without the Nomination by the CJN?

DON'T ever support any form of injustice no matter whose gird is protected.

It can be u someday.

Shalom.

Let me educate you.

In a situation where our laws re not sufficient to deal with a problem.

The best thing to do is to amend them.

The executive should not be seen as an arm of government that chooses which law dey will obey.

The Executives can equally send an amendment to the existing law to the National Assembly. And have that law ammended so that we can have such situations again.

The problem with you lot is that you lack the basic cognizance to understand the implications of lawlessness being brandished by the Executive.
