All this beneficiaries of Rochas Okorohausa corrupt government won't let us hear word again .

They've been having sleepless nights over Rt. Emeka Ihedioha victory as if Uche Nwosu s a match for Ihedioha in politics .

If rochas Puppet , Uche Nwosu, feel cheated then he should approach court for redress.

What if INEC indeed made a mistake in declaring Rt. Hon. Emeka Ihedioha of the People's Democratic Party (PDP), governor-elect in Imo state, as alleged by Uche Nwosu the Action Alliance (AA) candidate.

According to section 179 (2) of the 199 Constitution of the Federal Republic of Nigeria (as amended);

For a candidate to be declared duly elected to the office of Governor of a State in Nigeria he should win a MAJORITY OF THE TOTAL NUMBER OF VALID VOTES CAST and must have scored at least 25% OF THE TOTAL NUMBER OF VALID VOTES CAST IN AT LEAST TWO THIRDS OF THE TOTAL NUMBER OF LOCAL GOVERNMENTS IN THE STATE.

In my free time, I did an analysis of the results announced by INEC and indeed the PDP candidate didn't satisfy the " at least 25% OF THE TOTAL NUMBER OF VALID VOTES CAST IN AT LEAST TWO THIRDS OF THE TOTAL NUMBER OF LOCAL GOVERNMENTS IN THE STATE " (See the attached Table). The PDP candidate got 25% in only 11 LGAS

I also found out that the total Number of votes announced by INEC is different when summed using excel...

FACTS: The PDP Candidate won in 11 LGAs, AA in 10, APGA in 4 and APC in 2 LGAs.

The analysis was done using the results of the top 5 candidates and not the 71 who contested, simply because these were the only results available online. It is important to note that if the analysis was to be done with the remaining 66 Political parties, these percentages might drop but not significantly since some parties scored zero votes in a few of the LGAs

As much as I want Pdp to win imo ...I don't think that is the position of the law ......simple majority can only be used in a run-off between the top 2 candidates

He has already approach the court alongside araraume.the returning officer that made that declaration is an adhoc staff and may not be familiar with that constitutional provision

Thank you sir.seems most of those commenting here are doing it so from s sentimental angle.i think inec may have deliberately ignored that part of the law because 6 states were already declared inconclusive throwing inec in a frenzy tallest of the public backlash,criticism and pressure from all angle.an additional rerun may affect their budget,logistics and manpower already overstretched.
But could also be that the returning officer who is a vice chancellor and not a full inec staff may not be familiar with that provision which have never been tested in Nigeria plus inec may not have trained them on that side.what all inec officials are usually familiar with is inconclusive polls which is even inferior to the 25% spread requirement.

Your are very correct. The declaration was done in error because the PDP candidate did not meet the two third 25% spread.

You can go to this BBC Igbo web page if you understand Igbo very well to see it clearly. They did a similar calculation during the announcement of the result.

Exactly, the case seems a bit straightforward. This case wouldn't be about proving the elections were rigged, pockets of violence or there was over voting and all that could affect the outcome of the election. The case will just focus on interpreting section 179(2) and determining if the candidate declared winner met this condition. No much documents needed in court only the final result sheet signed and stamped by the returning officer Prof. Otunta and all the party agents. One month is even too much if we have a serious Judiciary.

Why try to twist the law ? That provision clearly states that once the person with the highest votes but do not have the two third spread,they will be a runofff irrespective of whether anybody has it.it didnt specify that someone with a lower vote but with the spread should be declared.if we go by your warped reasoning,then nwosu who has more spread should be declared winner.dont turn the law upside down.
It therefore means that if two candidates have same number of votes will go to a runoff irrespective of whether they met the spread or not.a winner must have the highest votes and the spread.
During the presidential polls,most of you were also hammering on if buhari met the two third requirement.now you guys want to look the other way.ihedioha is only wasting his time.

Thank you,you got the drift.if you followed the collation process,it was very rowdy and interrupted by fights and fisticuffs severally.it wasn't easy.the inec officials after restoring order were in a hurry to quickly announce a winner and leave the place.plus the plethora of inconclusive polls was disturbing inec.

You are very smart sir.its a case of interpreting the law which is clear,unambiguous and straightforward.if the lower courts waste time,the supreme court will scold them.they dont joke with the constitution.even the pdp lawyers would be helpless.
