Bolognese:Thank you sir.seems most of those commenting here are doing it so from s sentimental angle.i think inec may have deliberately ignored that part of the law because 6 states were already declared inconclusive throwing inec in a frenzy tallest of the public backlash,criticism and pressure from all angle.an additional rerun may affect their budget,logistics and manpower already overstretched. But could also be that the returning officer who is a vice chancellor and not a full inec staff may not be familiar with that provision which have never been tested in Nigeria plus inec may not have trained them on that side.what all inec officials are usually familiar with is inconclusive polls which is even inferior to the 25% spread requirement. 2 Likes |

Bolognese: Your are very correct. The declaration was done in error because the PDP candidate did not meet the two third 25% spread. You can go to this BBC Igbo web page if you understand Igbo very well to see it clearly. They did a similar calculation during the announcement of the result. https://www.bbc.com/igbo/resources/idt-c6067ffb-5955-4352-9217-8165997aa7ee The page is in Igbo language but you can translate the page to English if you don't understand Igbo. See what section 179 of the Nigeria constitution says 1 Like

Exactly, the case seems a bit straightforward. This case wouldn't be about proving the elections were rigged, pockets of violence or there was over voting and all that could affect the outcome of the election. The case will just focus on interpreting section 179(2) and determining if the candidate declared winner met this condition. No much documents needed in court only the final result sheet signed and stamped by the returning officer Prof. Otunta and all the party agents.
