INEC has every right to withhold it because it was announced under duress.. the returning officer told the whole world the he was announcing the result under duress...... It would be a shame for Inec to issue a certificate to a candidate who's result was made known to the whole world by the electoral officer was under duress. It's like NYSC issuing a discharge certificate to someone who openly flouted their rules and regulations in everyone's eyes.
Rochas should go to court and stop whining like a baby tongue

Inec does not have that right.
what's their contention?
if it was declared under duress, then q new election must be conducted within 7 working days.
or better still, cancell some units proned with violence and do a rerrun.
approaching the court is just the right option now for Rochas.
Inec can't prevent a zone from being represented by a candidate merely because one man declared the results under duress. was he forced to declare an already prepare results? NO. he was simply asked to complete the declaration of results he already started before he leaves to Owerri. that alone does not affect substantial aspect of the result.
let's call a spade a spade

INEC should fix a date for a rerun and settle this issue once instead of withholding his certificate of return...

They are two different scenarios.

Mantu lost at the polls. He could not become a senator, and thus could not become a senate president.

Okorocha pressurised am election official who declared that the results he gave were false and made under duress. IT IS HIM WHO SHOULD TAKE INEC TO COURT IF HE FEELS ROBBED. He may not due to the outcome for pressuring an election official.

baliyubla:
Truth is INEC has no right to withhold Mr. Iberiberisms certificate. If INEC has issues with how Rochas was announced winner, they should approach the courts.

What’s happening to Rochas and Akpabio is the same thing that happened to Ibrahim Mantu who was promised the Senate Presidency in 2007, only for him to be humiliated at the polls, just to allow the secretly favored David A. B. Mark to emerge Senate President.

Rochas should have been wiser.

Tundemuttee:
Governor Rochas Okorocha has appealed to the Independent National Electoral Commission to issue him with certificate of return as the senator-elect for Imo West.

He made the appeal at a press conference in Abuja today.

“I will advise INEC to do the right thing, to release my certificate so that I can celebrate as others. I want to be in the Senate and it will be interesting if I am there ” Okorocha said.

He urged INEC not to allow itself manipulated by his political opponents, who he said, wanted to freeze him out politically.

Okorocha was not invited by INEC to a ceremony in Abuja where certificates of return were presented to all senators elect and members of the House of Representatives. Okorocha was declared winner of Imo West two weeks ago, amidst claims by the returning officer, Professor I. Ibeabuchi that he made the declaration under duress.

INEC appeared to have upheld the submission and omitted Okorocha’s name from the list of senators-elect invited to Abuja.

Okorocha said his travails are connected to the politics of 2023 and that his opponents are already conspiring to close him out.

“I understand that people are beginning to fight a war of the future now when we are not even yet there.

“The idea is that, do not give Rochas a certificate; you must slow him down until after they have elected the presiding officers, then you can let him come in,”he said.

He added that the idea was to also ensure that he does not become anything in the Senate and to make sure that his governorship candidate son in-law does not emerge winner.

Okorocha ended his conference with some sarcasm, suggesting that INEC excluded from today’s event for a bigger event.

“I think probably, INEC must be trying to do something special, because I understand that once results have been declared and returns made, then you are bound to be issued a certificate of return,”he said.

“Maybe, INEC would want to organise a special programme for me to hand over this certificate of return to me, because clearly, I won and it was a peaceful election, the best you can ever think of,”he said.

The Chairman of APC, Comrade Adams Oshiomole, President Muhammadu Buhari etc will not allow Okorocha to get the certificate of return.

The fact is that they do not trust Okorocha.

They have this fear that he might decamp to the Pdp later on and then carry out a civilian coup by mobilize PDP senator to rebel against the Buhari administration.

That is the APC fear is that Rochas Okorocha might behave and rebel against the APC party just the way Senator Bukola Saraki did when he gang up with Ekweremadu to take away Buhari comfort zone and strangulate the policy of Buhari from carrying through in the senate for a period of 4 years.

There is this saying that once beaten twice shy.

OKOROCHA IS BEING LOOKED AT AS A NEW REBEL IN THE MAKING

APC DO NOT WANT TO TAKE CHANCES AT ALL AS THEY HAVE LEARNT A BITTER LESSON WITH SENATOR BUKOLA SARAKI.

were they held hostage at the inec collation center or where they kidnapped and taken to an unknown location? Personally i dont think a mere statement from the returning officer is enough to withhold a certificate of return, he cld be paid to do so, such allegations shld be corraborated by others and backed with evidence. Secondly, is the returning officer claiming that the result he announced was a fake one? if so where's the authentic result? In all, i think INEC didnt handle this well, they shld have come up with a resolution long b4 now, either a re-run, cancellation in some wards or announce the result they have.

INEC lacks the powers to deny Okorocha his certificate of return...

We should be careful in allowing persons and institutions assume powers they like...

If the REc doesnt like me, all he needs to say is that he is announcing the results under duress, and my mandate will be denied.

That is very dangerous precedent.
You don't reward bad behavior with a handshake..

If he feels aggrieved, let him approach the Courts for redress..

Okorocha said the rest of us (ndi Igbo) don't know how to play politics, he is the only wise man from the east.
He said his travails has to do with 2023 politics which is still far but the same Okorocha was the one saying the south does not know how to play politics because the refuse to align themselves with APC. Who is he now to say 2023 is still far? When all he has been doing is in preparation for 2023.

They have the power to do so. The returning officer said to the hearing of everybody that he was forced to announce okorocha as the winner under duress because he was held captive by okorocha's supporters so he just did it to save his life. INEC is very right to with old that certificate until they ascertain who truly won the election

Conduct election and announce the results and also to cancel results where they discover discrepancies. So they are well within their rights to withold his certificate if they discover that their staff was forced to declare a wrong result under duress

If INEC establishes that Rochas exerted undue influence on the electoral commissioner then Rochas has flouted INEC laws and should be disqualified. The 2nd person should be given the ticket. That is the law. It's simple. Unless it was not established without a doubt that it was Rochas that made the man announce the incomplete result under threat.
