engineerboat:Buhari didn't tender any results at the filing of his form and even on commencement of trial in march but, suddenly came up with a bogus result during the pendency of trial. Such procurement of evidence is flawed in law. It is of no effect and value let alone the numerous contradictions therein. |

tuniski:Nothing is fundamentally flawed.you are just trying to twist things or rather deliberately misunderstand issues.i will engage you in this argument not to just educate you but others because while you are learning,others are reading and appreciating.when you comment,know that others are reading and learning hence the dragging and insulting comments you received. I will use myself as an example.i am contesting for elections but i lost my originals and photocopies but i swore an affidavit attesting that to that and that i am educated up to secondary school cert level.an opponent drags me to court saying that i did not attach my certs and qualifications to the inec form cf001,therefore i dont have the nevessary certs and am not qualified.he did not plead forgery.what am i to do? how do i prove to the court that i am qualified and that indeed i was possessed the documents i claimed to get.i have to go to my former school to get an attestation from them,a picture or proof that i wrote waec there or was in class 5.some of my class mates at then were brought to testify in my favour,a broadsheet,attestation letters and transcripts from waec and neco are brought to the court. There are three differsnt results and one has my name fully.i have proven that i wrote waec and was educated up to school cert level.if the certs were forged or any discrepancy noticed,it cannot be entertained by the as what was pleaded was non qualification and not forgery. You do not know the word compelling,just accept it.or lets say strong.adeleke case was stronger,he almost won.he won the main election,was declared winner by the tribunal,proved clearly to the tribunal that there were errors in the result sheets,proved to the court that cancelled units were done by the rec instead of presiding officers.what has atiku successfully proven? |

Djrufus:. Your opinion is respected.However Buhari used affidavidavit in the first term which is binding in the law.He used same for the second term on the ground that his result is missing. During the hearing he brought a copy of his result.... it is in order in law. So Buhari satisfied the requirement to contest before and after the election. |

Djrufus:Thats why you should have followed the tribunal proceedings.most of your colleagues did and were disappointed hence the reason only few are arguing blindly.buhari included his other qualifications in the affidavit and outside and pdp lawyers clearly tried to argue that the overseas military training he attended were not equivalent of school certs and he wasn't issued a certificate. Theres a lacuna in the constitution which his lawyers harped on and the appeal court ruled in favorite of adeleke.the constitution said education up to school cert level,it didnt specify that you must tender your certificates.just prove that you passed through secondary school whether you wrote waec or not and it was proven. Infact,let me tell you the bitter truth.even if buhari did not tender anything before the tribunal or did not go to any school at all,the court will still find a way to qualify him.check the supreme court judgment on donald duke in 2002,2016 supreme court judgment on ayade's qualification. |

ejimatic:Yes affidavit is a legal document recognized in law but what happens in a situation where what you swore to in your affidavit contradicts the original documents you are trying to defend with your affidavit? No is the answer....The interpretation is that the certificate was not available as at the time he was filling the form to contest.Now the certificate is available regardless of its source.....It is still in order. |

ejimatic:Nobody is questioning affidavit. You and i know that it is what you claimed to the affidavit that the court with attest and oathed for you. So in this case, was Buhari certificates with the army, If yes, what is hindering him from collecting them, What hinder him to tell the court to subpoena NA Board secretary to come and and testify whaat Buhari Documents is doing wih them. But in all this, Buhari never do that. But Buhari lied in the affidavit he submitted to INEC. |

garfield1:The problem with you is that you only want argument. Buhari's affidavit is first stale cos it was 2014. And he was publicly issued an attestation by WAEC prior last year. Again, obtaining evidence during pendency of trial is flawed by the evidence act. You don't seek office claim awaiting result or missing result cos you have all the time to seek a ctc of said cert. Suddenly you are presenting same during pendency of trial. Indolence is not rewarded by the court Atiku has a compelling case except you don't know what it meant. Any case that has spilt decision is compelling. This case will have such a ruling. Your cockiness of claiming knowledge is actually ignorance! Cos the frontier of your knowledge is the beginning of others. You haven't shown any knowledge or expertise but, bringing other people's thoughts from some forum for submission without acknowledging them. I know your type. That we are in cyberspace and you support the party in power doesn't make you any more knowledgeable than anybody you hear! |
