Is this one a government?

I have read reasonable reactions and actions from some African countries on the Xenophobic attack, I'm yet to read one from Buhari.

Rather, the administration has left the fight to Nigerians to do themselves.
If the President had done what is required of him long before today, the government of SA would have acted according, to say the least, awoken to the bilateral responsibility of providing security coverage to endangered foreigners in moment of crises, like we do over here.
But the SA government has seen that our own government is 'very responsive and responsible', that's why they do the way they do.
Imagine how many job cuts Nigerians will suffer for all the burnings and lootings that happened across Nigeria yesterday and may still happen afterwards.
So you want the president to start insulting and cursing SA or what?
The president can't join ppl to loot bizs owned by SA. This issue will only be resolved diplomatically. The AU can be called on to sanction SA
For many of them, they want the President to threaten "Fire & Brimestone", direct Nigerians to retaliate or better still slap Ramaphosa.....that is when he would be seen to have acted "appropriately".... fools

I'd pay the company no more than than $500 million without which foreign investors may very much lose confidence in our institutions and credibility.

Should also be a lesson for leaders that sign off stupid deals that leaves us hanging with no recourse to oversight.

Law can be very interesting. The parties agreed to adjudicate a breach in the UK courts and there is also a law in the UK barring confiscation of state property via the judicial system without confirmation from the sovereign party in the dispute. Quite interesting.

$9.6b judgment: How P&ID snubbed Buhari’s $600m offer

According to the fact-sheet, President Muhammadu Buhari and Vice-President Yemi Osinbajo separately approved negotiation with Messrs Process and Industrial Developments (P&ID) after the Arbitration Tribunal awarded $6.597billion to the company. The two leaders at various times offered $250million and an improved offer of $600million to the Irish company.

The Vice President gave the approval on April 18, 2017, following the recommendations of the Attorney-General of the Federation (AGF) and Minister of Justice, Mallam Abubakar Malami (SAN), which included a negotiation with P&ID.

Also, President Muhammadu Buhari directed the Federal Government’s team to meet with P&ID counsel on July 12 and 13 in New York.

Based on Osinbajo’s approval, the AGF and the then Minister of State for Petroleum Resources Dr. Ibe Kachikwu, and a delegation along with counsel Chief Bolaji Ayorinde, SAN, on May 16, 2017, met with representatives of P & ID and its counsel to negotiate the judgment debt.

The government team initially on May 16, 2017 succeeded in negotiating the judgment debt from $8.4billion, to which it had risen, to $600million.

But P & ID rejected the offer on the grounds that what was agreed on to be executed was a Draft Stay of Enforcement Agreement and not a Settlement Agreement as proposed by the Federal Government.

The Federal Government offered $250million which P&ID rejected.

The document said although a former Attorney-General of the Federation, Mr. Mohammed Bello Adoke (SAN), recommended an amicable settlement with P&ID, the “ proposed settlement broke down.”

The government said the “settlement could not be reached before the time for report of settlement elapsed, therefore proceedings resumed at the Tribunal for determination.”

This article is long but details the ICSID agreement signed by Nigeria that allows foreign companies to sue countries in an international tribunal. Hence, P&ID can sue Nigeria in the UK or anywhere else despite Nigeria being a sovereign state. In the past massive judgements have been awarded against other countries as well including even Germany which was sued by a Swedish firm (Ironic since german businesses were the ones that pioneered the ICSID).

These are the current signatories of the ICSID (The countries in dark green) if you are an international company or even a domestic company that operates in these countries you can sue the entire country for breach of contract.

You are so much afraid of recession and poverty, why couldn't you tell Mr IB of Otuoke who negotiated the settlement deal in 2013 but refused to honour it until he left office even when crude oil was selling above 100 dollars per barrel?

How is your quote in tangent with what is actually and clearly written:

"... that gives immunity to Sovereign states..."

It goes further to say:

Mr Quinn said the contract was conceived during the tenure of the late former President Musa Yar’Adua, who doubled as the Minister of Petroleum Resources.

He said the idea of the project was first introduced to the then permanent secretary at the State House.

The official said he was advised to forward a proposal to the president in his capacity as minister of petroleum resources, while the then permanent secretary in the ministry of petroleum resources also proposed the need to seek a formal meeting with the president.



When P&ID proposal was being considered, Mr Quinn said he identified the Special Adviser to the President on Energy and Strategic Matters then as the late Rilwanu Lukman.

He said he also approached Mr Lukman and discussed the project with him.

On August 7, 2008, he said P&ID wrote to Mr Yar’Adua on a formal proposal for the project to be implemented.

The company was subsequently invited to meet the president, who, he said, directed that a presentation be made to the Minister of State at the Ministry of Petroleum Resources.

He said P&ID made the presentation to Mr Odusina and the Ministry of Petroleum Resources in October 2008.

Following his reappointment as Minister of Petroleum Resources on December 18, 2008, Mr Quinn said Mr Lukman in early 2009 directed P&ID’s proposal be further examined by the government.

P&ID was reportedly invited by the Special Technical Adviser to the Minister, Taofiq Tijani, to represent to the Minister for Petroleum Resources on February 24, 2009.

After the presentation, Mr Quinn said several top-level meetings were held involving the Ministry, NNPC, DPR, NAPIMS and Addax Petroleum to come with the gas sales and purchase agreement.

On January 11, 2010, Mr Quinn said the GSPA was executed by him on behalf of P&ID and Mr Lukman on behalf of the Nigerian government.

However, the setback to the contract, which may have laid the foundation for the dispute and arbitration was the call to Mr Quinn in the final week of June 2012 by Debo Spaine of Addax Petroleum.

Mr Spaine informed Mr Quinn that Addax’s headquarters in Switzerland had unilaterally decided to withdraw their cooperation and wished to “undertake the development of the NAG [non-associated gas] themselves”.


On February 10, 2012, Mr Quinnn said he wrote to the then newly-elected President, Goodluck Jonathan, to solicit his support.

He did not say what Mr Jonthan’s response was.

Immunity falls under jurisdictional issues and can be raised at any time or on appeal. In case you're ignorant, this same company had previously taken this case to a US court where they lost based on jurisdictional factors.
