You can either accept Aliexpress proposal and wait for five days or cancel the dispute allow the additional buyers protection to elapse before opening another dispute but you must act very fast

you are right. I knew he was up to something when he ignored all my messages and suddenly updated the order with tracking number. He's has never replied my messages since I placed the order. What's the way out now? As it is now, there is no option to cancel the order or open a dispute. Do I have to wait for 3 months to get my refund back or is there any way to make him send my order?

I think there should be a severe penalty against sellers who dubiously advertise items that they don't have or are not willing to ship after payment was made. A buyer should not go through the anxiety of waiting 3 months to receive his refund without compensation after a dubious seller scammed him.
