Nuremberg was not only about Hitler

Most people think of Nuremberg as the trial of Hitler's inner circle. It was much more than that. Between 1945 and 1949, the Allies did not stop at the men who gave the orders. They went after the men who carried them out. They tried the judges. They tried the police commanders. They tried the generals. They tried the civil servants and the industrialists. And they wrote into international law a set of principles that every Nigerian in uniform, on the bench, and in Aso Rock should read tonight before he sleeps.

The International Military Tribunal delivered its judgment on 30 September and 1 October 1946. Twelve death sentences, three life terms, four long prison terms. But the tribunal also did something few remember. It declared entire organisations criminal: the Leadership Corps of the Nazi Party, the Gestapo, the SD and the SS. Membership, with knowledge of what the organisation did, became a crime in itself.

The judgment contains one sentence that should be framed on the wall of every Nigerian ministry: "Crimes against international law are committed by men, not by abstract entities, and only by punishing individuals who commit such crimes can the provisions of international law be enforced." Not "the government". Not "the system". Not "the Presidency". Men. With names.

The judges who put on the robe and picked up the dagger

In 1947 the Americans tried sixteen officials of the German justice system in what became known as the Justice Case, United States v. Altstötter. These were not thugs. They were the State Secretary of the Ministry of Justice, the chief judges of the Special Courts and the People's Court, senior prosecutors, men with doctorates in law. Their defence was that they had applied the law of the land as it then stood.

The prosecutor, Telford Taylor, answered them with a sentence that has outlived every one of them: "The dagger of the assassin was concealed beneath the robe of the jurist." The tribunal itself went further. It found that the prostitution of a judicial system for the accomplishment of criminal ends involves an element of evil to the state that is not found in frank atrocities, because it destroys the very institution meant to protect the citizen.

Franz Schlegelberger, Acting Minister of Justice, got life. Oswald Rothaug, chief judge of the Nuremberg Special Court, got life; the tribunal said that "by his manner and methods he made his court an instrumentality of terror" and found no mitigating circumstances. Rudolf Oeschey, life. Ten of the sixteen were convicted. For what? For sentencing a 68-year-old Jewish merchant, Leo Katzenberger, to death on a fabricated charge, "only because he was a Jew". For rubber-stamping the executive's enemies into prison and the grave. For knowing what the law was being used for and signing anyway.

Now read that against Nigeria. A judge who accepts a house in Wike's Katampe "Judges' Zone", allocated subject to the approval of the President and the Attorney-General, and then sits on a case in which the Presidency has an interest. A court that awards ₦100 million against SERAP, a civil society group, in a defamation suit brought by two DSS officials, after SERAP described a DSS visit to its office. A Federal High Court that rules that Omoyele Sowore has a case to answer under the Cybercrimes Act for describing the President as a "criminal" in a social media post. A remand in Kuje for one politician and a soft landing for another. The Special Courts of the 1930s also looked lawful on paper. That is the point. The Nuremberg judges did not care whether the paperwork was in order. They asked what the paperwork was for.

The policemen who said they were only obeying orders

The Einsatzgruppen Case, judgment delivered 8 to 9 April 1948, tried twenty-two commanders of the mobile security police and SD units. Every one of them said the same thing: I acted legally and in obedience to superior orders. Otto Ohlendorf, an economist with a law degree who commanded Einsatzgruppe D, said it in perfect, reasoned sentences. All twenty-two were convicted. Fourteen were sentenced to death.

The tribunal's answer to "I was following orders" was already written in the 1946 judgment: "The true test is not the existence of the order, but whether moral choice was in fact possible." The judges added that no court will punish a man who, with a loaded pistol at his head, is compelled to pull a lethal lever. But they found no evidence that a single one of these men would have been shot for refusing. They obeyed because obeying was convenient, because it was a career, because the man above them wanted it done.

The United Nations codified this in 1950 as Principle IV of the Nuremberg Principles: "The fact that a person acted pursuant to order of his Government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him."

So to the Inspector-General of Police, to every Commissioner of Police, to every DSS Director and every operative who has picked up a journalist at night, who has held a young man in Katsina on a treasonable-felony charge for tearing a Tinubu billboard, who has kept a critic of Seyi Tinubu in a cell without charge, who has raided a newsroom or ignored a court order for release: nobody is holding a pistol to your head. You have a moral choice. You are making it every day. And the day will come when a Nigerian court, or a foreign one, asks you what choice you made. The Committee to Protect Journalists has counted more than ninety journalists detained or attacked under this administration. Each of those files has the name of an officer on it.

The generals who thought the uniform would protect them

The High Command Case, judgment of 27 to 28 October 1948, tried fourteen of the most senior officers of the German armed forces, field marshals and generals. They were acquitted of planning aggressive war; the tribunal held that only the policy-makers could be guilty of that. But twelve of the fourteen were convicted of war crimes and crimes against humanity for what they permitted, transmitted and enforced against civilians under their command. Field Marshal von Leeb, one of the most decorated soldiers in Germany, went to prison. The rank did not save them. The oath did not save them. The order from above did not save them.

The Nigerian military has, for the most part, stayed in its barracks in this Republic, and Nigerians should be grateful for it. But the generals should understand the line they are being walked towards. Emergency rule in Rivers State, enforced by soldiers, over a political quarrel between a governor and an FCT minister. Troops deployed around elections. Soldiers used for errands that have nothing to do with the defence of Nigeria. Every Service Chief who lends the Nigerian Army to the political survival of one man should read what happened to men who wore far more medals than he does.

And the politicians

Principle III of the Nuremberg Principles says: "The fact that a person who committed an act which constitutes a crime under international law acted as Head of State or responsible government official does not relieve him from responsibility under international law." That sentence was written for presidents, ministers and their courtiers. Ministers who sign contracts worth billions of dollars to a single foreign family without tender. Ministers who allocate thousands of hectares of federal land to companies that exist only on paper. A Senate President and a National Assembly that have rubber-stamped every loan, every emergency and every supplementary budget put in front of them. Governors who count election-season corpses in dozens and call it a landslide. Spokesmen who defend the indefensible every morning on television. Nuremberg tried the propagandists too.

Why I say this is a criminal organisation

Let me be precise, because precision is what will matter when the accounting comes.

I am not comparing the scale of what is happening in Nigeria to the industrial murder of six million people. Nobody serious would. What I am saying is that the law that came out of Nuremberg is the law of the entire civilised world today, and it was built for exactly one purpose: to ensure that the men who make a criminal state function cannot hide behind the state. That law applies in Abuja as it applies in Berlin.

It is my firm conviction, which I have stated publicly and repeatedly, that the Tinubu administration operates not as a government but as an enterprise: a network in which contracts, land, appointments, the security services, and the courts are deployed for the enrichment and protection of one family and its circle, and in which the instruments of the state are turned on anyone who says so out loud. I hold that view on the public record: the 1993 Chicago forfeiture of $460,000 in Case No. 93 C 4483 (a civil forfeiture, not a criminal conviction, and I say so every time), the President's own filings in a United States federal court to keep FBI and DEA records about him sealed, roughly thirteen billion dollars in contracts to companies linked to one foreign family, an unpublished asset declaration, and a documented pattern of prosecutions and detentions of critics. Those are allegations and inferences, not convictions. Every person named is entitled to the presumption of innocence and to a fair trial, which is Principle V of Nuremberg and something this administration denies to others. But the pattern is what Justice Robert Jackson asked the tribunal to look at in 1945, and the pattern is what a Nigerian tribunal will one day look at.

A Nigerian Nuremberg

I am not calling for the bullet. I have never called for it and I never will. Nuremberg's entire achievement was that it replaced vengeance with a courtroom. I am calling for the courtroom.

When this administration ends, and it will end, by the ballot in January 2027 or by the collapse of its own contradictions, Nigeria must convene a tribunal of its own. Not the EFCC as it stands, which prosecutes the opposition and drops the cases of converts. An independent tribunal, with foreign judges sitting alongside Nigerian ones, on the Sierra Leone Special Court model, with a mandate to try the enterprise as a whole and every individual who made it work.

The Kio Solution demands:

One. A Nigerian Accountability Tribunal, established by statute in the first hundred days of the next administration, with international judges and prosecutors, mandated to investigate and try abuse of office, grand corruption, and crimes against the civilian population from 29 May 2023 onward.

Two. Adoption of the Nuremberg Principles into Nigerian law by name, so that no judge, police officer, soldier or civil servant may ever again plead "I was following orders" or "I applied the law as it stood".

Three. An immediate register, kept by the Nigerian Bar Association and civil society, of every judicial officer who has accepted property from the executive, every police and DSS officer named in an unlawful detention, every court order disobeyed, with the name of the officer who disobeyed it. Evidence is what convicts; start collecting it now.

Four. Application of the Isabel Precedent: the diaspora should carry files to courts and agencies in London, Washington, Paris, Lisbon and Dubai, so that assets and persons are reachable wherever they run.

Five. Full disclosure: publication of every Chagoury-linked contract, every asset declaration, and the FBI and DEA records the President is fighting to keep sealed.

A word to those still serving

To the judge reading this in chambers: Rothaug applied the law as written and he got life. To the DSS officer: Ohlendorf had a law degree and a reasoned explanation, and it did not help him. To the general: von Leeb had a marshal's baton. To the minister and the senator: Schlegelberger was Acting Minister of Justice.

None of them believed, in 1938, that the day would come. It came. It always comes. The only question each of you can still decide is which side of the record your name will be on when it does.
