Do a paid IMEI check with Frinx for #500 or so to check if it's iCloud locked.
If it isn't then you can take the risk that nothing else is wrong with the phone.

Removing passcode from iOS is as easy as flashing it -- as long as there's no iCloud.

If it's icloud locked, run for your life
