By the way, any landlord that waits for a tenant's rent to expire before issuing a notice to quit is working with a BSc lawyer.

The law states that a notice to quit should expire on the eve of the rent's expiry date. So it is in order to issue a notice to quit when a rent is running.

Once you pay, refuse any refund bc you have a right to stay the full tenure of your rent (for those that get served notice to quit that expire with months remaining on their rent.)

Whatever the court grants you, you must still pay mesne profit.

That the person didn't pay and pack out is because the landlord either doesn't know the law, or he doesn't have strength to track down the runaway tenant.

The landlord involved in our case is a powerful and wealthy king.

7 block of flats, and wanted to evict everyone forcefully, we took him to court and court granted us 6months, and when the 6th almost elapsed, we pleaded for more time to vacate, the court gave everyone 3months, and after that, another 1 month was given.

We no pay 1 naira.

And you are now providing more details.

Landlord has no right to FORCEFULLY evict any tenant outside the provisions of the Landlord/Tenant Agreement, and in absence of this, the particular state's Tenancy Law.

So if the landlord is acting unlawfully, the tenant has a right to seek legal redress, and the court has the right to effect any judgment (punitive or not to either/both parties) as it deems fit.

Your case is different and your initial comment didn't help in understanding it.

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

A tenant was issued a rent increment for the apartment he is occupying. He rejected the increment. He was then issued an eviction notice on the tenth month of his running rent. He now has 4months after the exhaustion of the his current rent for the eviction notice to expire.

My question is:
Is he meant to now stay for free during these four months of eviction notice?

There is nothing like free rent during notice to quit. Make una no allow tenants use una head.
