Useless "kontry" a business dispute that ought to be treated with utmost priority and expedited upon dragged for this long now that Psquare brand is dead who will pay? Don't forget the damage the complainant would have suffered. the audience who pay for that show hoping to watch psquare perform live would believe they were conned and might not be willing to attend any of his shows again.

When I said "the court", I didn't specify which..I meant it to cover all the courts which heard the matter

Yes the High Court is the first cost to rule on damages being the court of original Juridiction.. but the appellate courts can review both damages and costs award upward or downward depending on the facts of the case, as they have done in a plethora of cases

Furthermore, exemplary damages are imposed for the purpose of setting an example..Depending on the transgression, exemplary damages have no limits.. and my point is that the Courts won't have been out of line to slam PSquare with hefty exemplary damages that they won't recover from in their lifetime, because what they did was beyond despicable

As per costs, that's basically costs of litigation (appearance fees, professional fees, cost of coming to court by litigant, etc) , which in law they say costs follow events.. So. I know what I said when I said "damages" instead of costs.. There is no such thing as exemplary costs, but exemplary and even punitive damages.. So yes, I know the full import of my choice of words in my earlier comment.

That's because 1 million naira is the new penalty, not 25 million naira. That 25 million naira compensation has been awarded by the high court since 2016 and sustained by the appeal court too

After Mr Patrick has deducted his SAN's legal fees, and other monies he spent on logistics pursuing this case since 2011, I wonder how much he will have left.

This is one of the reasons why people have lost confidence in the Nigerian Judiciary. Justice delayed is almost always Justice denied angry

Even the PSquare guys are extremely wicked.. They couldn't pay off Mr Patrick when they failed to show up at his event after being paid, but they had money to pay lawyers to frustrate him and drag the matter right up to the Supreme Court angry...

In this kind of situation, the court further awarding exemplary damages of like 300m against PSquare would have set a deterrent against such disgusting behaviour...





I hear you .... but what I'm wondering is how much was the amount awarded before?..... was the devaluation of the Naira taken into consideration before awarding the N25M? I hope so. Booked for a show and don't show up... then I believe you can be sued for all the expenses incurred in organizing the show.

This has nothing to do with refund. Why will anyone accept a refund? It is breach of contract. How much is the money paid to their artist compared to how much the promoter spent on the show, adverts etc. His loss of reputation nko? Damage to his brand?
If you read the 25m judgement, you might see eg 5m for refund of payment to artist and then 20m for damages.


And they should've done out of court settlement instead of wasting money they're supposed to use and compensate the Man instead of jumping from one court appealing up nd down....

I think the man has chopped the 25 mil since. Notice that square deposited a cheque for the judgement. The issue they were battling is the cheque not to be cashed until the appeal which they lost both ways all the way to the supreme court.
