Imminent retrogression for the last quarter make sense knowing that in 3-4 months, a new fiscal year begins for new numbers to roll in. Albeit, Movement of Priority dates for fiscal year 2025 will be reduced to cope with influx of application .

With imminent retrogression, worse case dates expected for FAD July -September:
EB2 = November 2022 vs Aug/ July 2022 (Aggressive).
EB3 = Aug 2022 vs Dec 2021.

Seem Employment based Backlog has come to stay for forseeable future. USCIS has gotten efficient with processing of enormous cases, but congress isn't helping anytime soon to help other arm of the process function properly. Enormous demand with limited supply.

EB-3 route are here also, some of us DQ, waiting for PD to become current. Most of us representing our wives who are nurses, I don't know if it is only nurses that are in EB-3. So I don't know your academic qualifications.

EB-3 is both for skilled and Unskilled workers. A category to which Nurses belong. According to bing; EB-3 is a visa preference category for United States employment-based permanent residency. It is intended for "skilled workers", "professionals", and "other workers". Those are prospective immigrants who don't qualify for the EB-1 or EB-2 preferences. The EB-3 requirements are less stringent, but the backlog may be longer. Unlike persons with extraordinary abilities in the EB-1 category, EB-3 applicants require a sponsoring employer. Checkout podcast i.e WOndery to listen to, or some softskill masterclass to help.

Not too late to start scouting for jobs if you are on EB-NIW and have no offer at the moment. We are at the cusp of Massive Lay-off in all sectors, best to start now than never.

Waiting daily for a consulate that wouldn't change it's capacity anytime soon is not the best way for your mental! Shalom!!

So, I created a petition that seeks to end the rip-off IELTS keeps perpetrating with the 2-year validity of their test results, particularly for high scorers who scored btw Band 8-9. Surely, someone who got a band 9 shouldn't, wouldn't, couldn't have lost the skill that earned him/her a band 9 after two years.

Pls join the petition and let's make this change happen. Share across all platforms, as millions stand to benefit.

You don't have to ignore. There is nothing wrong with your suggestions. People reason and react differently.
I have been wondering how some people get job before arriving the US. This is due to the fact that some employers prefer someone who is present in the US.
Keep on encouraging others, because the waiting is not easy. Mostly when your PD has been current for more than 6 months yet no IL.
May we have divine intervention.

We will get our ILs soon enough, 4 months is worth the wait. Let's keep faith alive.

not sure this my reply is still timely. You cant use evaluation by wes canada. But you can create a new account with wes usa and move your profile from wes canada to wes usa for wes usa to evaluate

The last sentence on my PCC reads "This Certificate is issued to the holder for the purpose of Travelling to United States of America and it is valid for 3 months from the date of issuance." I believe I applied for travelling....

This might have happened due to 3 reasons;
1. Expedite request approval
2. Spill over of those placed on AP in Jan. They might have been delayed in getting what was required of them.
3. Exceptional ability and incontrovertible job offer that placed the holder on glaring national interest. Just my thoughts though.

Is so worry some, I think someone should be looking at other countries, with NCLEX at hand maybe Canada or Australia? Again, Lagos Consulate is not helping matters at all, for some people that their PD has been current since, no IL till this retrogression met them again. Other countries like Kenya and SA don't waste time in giving IL. God, Please Help your children, we are going through a lot here in this country.

Hi, I just joined NL. I'm self petitioning for EB2 NIW from Canada. I'm very happy to have stumbled upon this thread while looking for resources online.

These fees caught my attention because I filed for EB2 NIW on June 7 but got my entire application sent back to me for wrong fees. I did $715 for I-140 and $2805 for premium processing.

Apparently there's now a $300 Asylum fee. It's $600 for petitioners that employ more than 25 people. USCIS is transferring the cost of Asylum seekers to us. It started April 1.

It took me a while to wrap my head around it because I'm an individual not a company but the fee still applies unfortunately. You can Google form G-1055 to see the fee schedule. It was a pain reprinting almost 5lbs of docs. The returned petition was marked hence useless.

I'll be resubmitting next week with the additional $300.

So the current fees are:

$715 - I-140
$300 - Asylum fee
$2805 Premium processing (optional)

Or if I'm requesting for premium processing, and I pay the $2,805, there'll be no need to pay additional filling fee of $715?

The fee schedule is a bit confusing.
A friend of mine got his petition sent back a couple of weeks ago. It was stated that he has not fully completed his petition. They pointed to:

-Part I 501(c)(3) or government research nonprofit organizational
- Part I 25 or fewer full-time equivalent

Since the "Other information" (last part in Part I of form 1-140) was the only part left blank in Part I (because he thought it was not applicable), I told him to answer NO to the two "objective" questions (5 and 6 under other information in Part I), and send it back. He is till waiting to hear from them again.

Initially, when he told me, I thought it was regarding the fee; because he paid only the 715 for regular processing. But when he sent me the attached letter, nothing was mentioned about the fee not being appropriate. Only those issues mentioned above. To my understanding, they are still related to the fee anyway.

I believe, the new schedule is also confusing to some USCIS adjudicators. Probably, the NIW often skipped their minds. To my understanding, NIW has nothing to do with Asylum fee. Only for those who are already in the US. I-140 is applicable to many categories of people, that is why.

Anyone will recent successful filing story can guide on this please 🙏

Since April 1, the $300 has become part of the EB2 NIW fees. Apparently, petitioners that are not employers are also considered to be under those who employ 0-25.

So you have to select NO to question 5 (the non profit question) and YES to question 6 (the question about being an employer that employs 0-25)

Until you do this, and add the $300 as a seperate fee, they'll keep returning the petition.

As wild as it sounds, it's what it is.
