Exactly, the case seems a bit straightforward. This case wouldn't be about proving the elections were rigged, pockets of violence or there was over voting and all that could affect the outcome of the election. The case will just focus on interpreting section 179(2) and determining if the candidate declared winner met this condition. No much documents needed in court only the final result sheet signed and stamped by the returning officer Prof. Otunta and all the party agents. One month is even too much if we have a serious Judiciary.

That's not true. Please read section 179 of the 1999 constitution (as amended) from subsection 1 to 5. Subsection 3, 4 and 5 focuses on runoff elections!

There is a big difference in section one and section 2 of this law....the first section stresses each local government when only two people are contesting, but when more than two people are contesting, section two kicks in...each local government won’t be considered in watching the spread.

Honestly i dont know.inec never made mention of the total cancelled votes.it was the pdp candidates that were speculating and throwing figures around.therefore,inec were inorder.

. it is not about people's happiness. rather, it's about doing the right which in this case is to declare it inconclusive and order a re-run. The AA guy sure has a genuine case to present in court.

I actually missed it up...two-third of ‘each’ is where one person is contesting....but where two or more people are contesting....the word ‘each’ was removed.
The constitution had Rochas in mind for that clause.

As you can see,both sections have 'each' in the criteria.the conditions for a single candidate and two or more candidates are same.the only difference is that where a single is involved and fails to meet the requirements,new nominations are specified.but for two or more candidates,a runoff is required.its very clear.ihedioha in the eyes of the law is not a governor

It can be amended later but would still apply for this election cycle.by the way,its a good law.it makes sure the winner has a large level of acceptability within the state.
This is not the first time multiple and very strong contestants are contesting.in anambra polls,over 5 strong contestants usually take part but the winner usually meets all the requirements.same thing in ondo.the only time a candidate almost didnt meet this rule was in 1979.

What if INEC indeed made a mistake in declaring Rt. Hon. Emeka Ihedioha of the People's Democratic Party (PDP), governor-elect in Imo state, as alleged by Uche Nwosu the Action Alliance (AA) candidate.

According to section 179 (2) of the 199 Constitution of the Federal Republic of Nigeria (as amended);

For a candidate to be declared duly elected to the office of Governor of a State in Nigeria he should win a MAJORITY OF THE TOTAL NUMBER OF VALID VOTES CAST and must have scored at least 25% OF THE TOTAL NUMBER OF VALID VOTES CAST IN AT LEAST TWO THIRDS OF THE TOTAL NUMBER OF LOCAL GOVERNMENTS IN THE STATE.

In my free time, I did an analysis of the results announced by INEC and indeed the PDP candidate didn't satisfy the " at least 25% OF THE TOTAL NUMBER OF VALID VOTES CAST IN AT LEAST TWO THIRDS OF THE TOTAL NUMBER OF LOCAL GOVERNMENTS IN THE STATE " (See the attached Table). The PDP candidate got 25% in only 11 LGAS

I also found out that the total Number of votes announced by INEC is different when summed using excel...

FACTS: The PDP Candidate won in 11 LGAs, AA in 10, APGA in 4 and APC in 2 LGAs.

The analysis was done using the results of the top 5 candidates and not the 71 who contested, simply because these were the only results available online. It is important to note that if the analysis was to be done with the remaining 66 Political parties, these percentages might drop but not significantly since some parties scored zero votes in a few of the LGAs

To Anser your question, Inec did not declare ihedioha winner in error with the following explanations.

1. He score the highest number of valid vote cast.

2. To ascertain if he score 25% of total valid vote cast in at least two third of the local government.

This calculation is applied:

Total valid vote = 686,037

One third of valid vote : 686,037÷3 = 228,679

Two third of the valid vote cast : 228,679 × 2 = 457,358

25% of total valid vote cast : 457,358 ÷ 100 x 25 = 114,339.5

Which 25% of 2/3 of local government valid vote is around 76,226


So pdp candidate score : 277,582 which is above 76,226
