Am married to a us citizen in usa. she refused to divorce me and now am back to nigeria. want to go do masters in canada. and i intend to say am single. do u think the embassy will know am married somewhere. just want to get your thought
If you stay long enough in America you should know that your info is a click away. If you have the right status and no hidden stories; you have no business with the US or Canadian embassies. By the way because "she refused to divorce" you is not an excuse, you file the papers first and meet in court.

Marriage is not slavery, you don't need permission to divorce in the US.

@Euromeko,

Both parties have to agree to a divorce. The wife has to sign the divorce. If she doesn't sign, the divorce proceedings cannot be concluded.

@ Poster, Until you a legally divorced, separated is the right word. According to your post, it would appear that your wife found out you used her to get your green card so she's ready for a showdown with you.

Not so.

Motion can be filed to compel her signature after due process. Assuming her refusal is baseless such as he's nit hiding assets yet to be discovered, as an example.

I was on a bike ride when I initially responded. I always like to backup with proof when I postulate online so here we go:

From Superior Court of California, Orange County. http://www.occourts.org/directory/family/dissolution.html

"What if my partner does not agree to a divorce?

Both persons do not have to agree to the divorce. One partner can’t force the other to stay in the relationship. Either partner can decide to end the marriage. The partner who does not want to get a divorce cannot stop the process by refusing to participate in the case. Non participation may lead to a default judgment, not to a dismissal of the divorce request. "

@Poster: If all else fails, simply go to the Dominica republic or Haiti where you can have your divorce within 24 hours without the consent of your wife. They do have good international lawyers over there who are quite experienced in handling such complicated cases, liaise with them and complete your divorce within 24 hours. They will legalize the "Decree Absolute" document for you at their respective ministries of justice, and you can now present this document to embassies as proof of your single status.
Don't lie to any embassy about your marital status angry angry angry
