The president is now the governor acting through the sole administrator. His requests will be approved by FEC. The functions of the two arms of government in Rivers State has been suspended. The supreme Court said that before now the executive exist but no legislature which was abnormal. In essence no constitutional government.

In a state of emergency the constitution is suspended to the extent of it's operation by a democratically elected governor and house of assembly. This is the import of section 305 variously cited.
