VisaOfficer: You previously stated that your father has passed away, and I've already informed you that when a petitioner passes away, the petition is rendered invalid.
If you attempt to conceal this fact during your interview, you will be found permanently ineligible to enter the United States -- not only for material misrepresentation, but for the much more serious infraction of attempted human smuggling. (Your children and spouse are derivatives on your petition -- you are responsible for them.)
And if your petition were still active, which it is not, you would also need to tell us that you are married, or you would again risk becoming permanently ineligible to enter the United States.
Honesty is absolutely the best policy here. Concealment will only damage your chances of going to the United States. Also, it hurts everyone else's chances, because now I'm going to have to remind all my officers that for all F1s, they should carefully double-check whether the petitioner is alive and whether the beneficiary is married. sir ur reply has been very helpful. I hav already applied for humanitarian re- instatement as u advised. I didn't lie abt my family. Am only asking how best to ensure that I carry them along, cos I want d best for my family. Sir, My F1 IV application was filed 8yrs ago. I married 2yrs ago with kids. Am currently processing d F1 visa interview. Wl my famly b given visa with me or do I apply singly and process theirs later. Thanks. |
