A Federal High Court in Abuja has ordered the Independent National Electoral Commission to nullify the certificate of return issued to Christian Abah for the Ado/Okpokwu/Ogbadibo Federal Constituency seat in the House of Representatives of the forthcoming 8th National Assembly. Justice Adeniyi Ademola, delivering judgment in the suit challenging Abah’s eligibility to stand for the election, held that the allegation of certificate forgery levelled against him, by the plaintiff, Mr. Hassan Saleh, was established to be true. Abah was said to have forged an Ordinary National Diploma certificate in Accountancy purportedly obtained from the Federal Polytechnic, Mubi, in 1985. Justice Ademola said his findings revealed that an earlier judgment of the National/State Assembly Election Petition Tribunal sitting in Makurdi delivered on September 6, 2011, and a letter by the Registrar of the polytechnic, Mr. Suleiman Buba, affirmed that the certificate presented by by Abah to INEC was forged. The court ordered the Inspector-General of Police, Mr. Solomon Arase, to immediately commence prosecution of Abah for forgery and perjury. Abah, who is a member of the Peoples Democratic Party, had earlier been declared unopposed and elected being the only candidate presented for the March 28, 2015 election. The court in his judgment declared all the votes that accrued to him in the PDP’s primary held on December 6, 2014, as wasted and also declared Saleh, who came second as the winner of the primary. He ordered INEC to issue a fresh certificate of return to Saleh. The court also ordered the incoming Speaker of the 8th National Assembly to swear in Saleh as the member representing Ado/Okpokwu/Ogbadibo Federal Constituency. The court also berated the conduct of the counsel for PDP and Abah in the suit, Mr. S.I Ameh (SAN), for the frivolous applications and tactics to delay the hearing of the case. Justice Ademola therefore ordered that the processes filed in the suit and his judgment be served on the Nigerian Bar Association, the Legal Practitioners Disciplinary Committee, the Legal Practitioners Privileges Committee with a view of taking appropriate sanction against Ameh. The judge also imposed a N450,000 fine on the three defendants – the PDP, INEC and Abah in favour of the plaintiff. Barr Simon Lalong of the All Progressives Congress (APC) polled 564,89s votes to defeat his closest rival, Senator Gyang Pwajok of Peoples Democratic Party (PDP) in the Saturday governorship election. Pwajok polled 520,572 votes. Below is the performance of the two major parties in the 17 local government areas of the state: Mikang LGA: APC 12,512; PDP 11,522. Bassa LGA: APC 28,770; PDP 34,341; Shendam APC 40, 464; PDP 14,476; Barkin-Ladi PDP 56,933; APC 13,151 and Langtang North APC 25,202; PDP 23,045. For Jos East, APC got 15,356 votes to beat PDP which polled 7,752. PDP got 23,118 against APC's 18,458 in Kanke, while PDP got 37,793 votes in Riyom to beat APC which polled 7,253. Result from Kanam showed APC getting 41,512 votes against PDP's 30,466. In Mangu, APC got 74,981 votes to overwhelm PDP which received 28,509 votes. Votes declared from Pankshin indicated that APC polled 33,364 while PDP got 23,493. From Bokkos came the result indicating that APC got 35,689 votes to PDP's 16,111 votes; while APC got 31,760 votes in Jos South to lose to PDP which received 93,962 votes. Results announced from Langtang South and Qua'an Pan LGAs Sunday night showed that in Langtang South APC scored 13,663 while PDP got PDP 19,061 while in Quan'an Pan APC had 27,472 votes while PDP had 19965 respectively. In Jos North APC polled 117, 443 votes while PDP got 61,391. Some voters in Kwara State say they shunned voting on Saturday because they had no doubt that the governorship candidate of the All Progressives Congress, Abdulfatah Ahmed, would win the election. The voters, most of whom were supporters of the Peoples Democratic Party, said, even if they voted, they were sure that Ahmed, who is also the state governor, would be re-elected. Our correspondent, who monitored Ilorin West, East, and Ifelodun Local Government areas, observed that there was a low turnout of voters compared to the March 28 elections. Of 245 voters, who collected PVCs at a polling unit in Oke-Ose, Ilorin East Local Government Area, 95 voters were accredited. A PDP supporter in Ilorin West LGA, Tosho Ambali, said, his efforts to mobilise people to come out and vote were futile. He said, “People have been weighed down by PDP’s defeat two weeks ago. I moved from one house to another for mobilisation but only a few of them came out. When we (PDP supporters) trooped out in the presidential election, we lost not to talk of now. I voted for PDP but it is glaring APC will win again.” Gbolahon Kolawole, who registered at polling unit 007, Kure-Oja in Ilorin East LGA, said he did not exercise his civic right, claiming that it would not count at the end. He said, “I decided to sit at home because I did not want to waste my energy. You can read the mood of most voters irrespective of the party they belong. Everybody knows who will win in Kwara already. My advice is just that APC should deliver at both federal and state levels in the next four years.” A voter, who identified himself only as Yusuf (aka Mentor) in Shaare, Ifelodun LGA, said he would not vote when our correspondent approached him where he was playing table tennis around 12.30pm. “I have kept my Permanent Voter Card for future use since I voted for that Mallam (Buhari). I have not benefitted from the state government. So, I can’t for APC,” he said. When asked why he did not vote for any of the other party, Yusuf said, “I can’t waste my vote.” Meanwhile, a chief of PDP in the state, Senator Makanjuola Ajadi, boasted that the governorship candidate of the party, Senator Simeon Ajibola, would win the state governorship election. Two people were shot when youths blocked distribution of electoral materials in Danmusa Local Government Area of Katsina State. INEC officer of Danmusa, Itachu Godwin said all was set for the exercise “but PDP thugs have been blocking efforts to distribute election materials”. He alleged that the thugs were engaged to snatch ballot papers and attack electoral officials. He said the INEC state office has asked them to hold on till sanity is restored. Unknown hoodlums in the early hours of today hacked to death, a policeman along Rex Lawson Street in the Borokiri area of Port Harcourt. The Police image-maker in the state, Ahmad Muhammad, who confirmed the killing of the policeman, attached to the Borokiri Police Division, said the police had commenced investigation into the killing. The Nigerian military has ordered the release of two Aljazeera journalists who have been detained in Maiduguri, Borno for over a week after being accused of “loitering” around areas of military operations. Ahmed Idris and Ali Mustapha were released in the early hours of Saturday after spending ten days in detention in their hotel room. The defence headquarters spokesperson, Chris Olukolade had in a statement said the duo were moving around “restricted areas” in Yobe and Borno states without protection, accreditation or clearance. The two Journalists also sued the Nigerian Army challenging their detention, which has been condemned by Nigerian and international civic groups. The were represented by lawyer and human rights activists, Femi Falana, who sought a declaration that the arrest and detention by the military was illegal and unconstitutional, thereby violating their right to personal liberty guaranteed by Section 34, 35 and 41 of the constitution and Article 5, 6 and 12 of the African Charter on Human and peoples’ Right Act. He also sought an order directing the Nigerian military and the army chief, Kenneth Minimah, to release the journalists from illegal military custody immediately. It is not clear if their decision to approach the court was responsible for their release. Efforts to speak with a representative of Aljazeera network were unsuccessful as our calls were neither answered, nor returned at the time of publishing this story. Also, efforts to speak to one of the released Journalist, Ahmed Idris, was unsuccessful. He also did not respond to our text message. Reports reaching PREMIUM TIMES indicate that members of the insurgent Boko Haram are currently attacking Kayamla village of Borno. Kayamla is about 20km from Maiduguri, the Borno State capital, and the attack was ongoing at 2:10 p.m. An official of the local vigilante called Civilian-JTF in Borno, Muhammed Gava, confirmed the attack to PREMIUM TIMES. “We just got a report from our vigilante members around Konduga local government area that Boko Haram terrorists were in Kayamla and we’ve just assembled a team of vigilante members and the Civilian-JTF who are about to storm Kayamla now,” he said. Kayamla was last attacked by the Boko Haram in January last year. Saturday’s attack comes barely 24 hours after Boko Haram attacked a fishing community about 15km from Maiduguri. Four fishermen were beheaded and dumped inside the river Alau, while five other fishermen were allegedly taken away by the insurgents, who were later killed by Civilian-JTF who trailed them to a Balle Village. SaharaReporters has learned that at least 18 members of the Ekiti State House of Assembly have agreed to commence investigations into allegations of grave misconduct against Governor Ayodele Fayose. SaharaReporters has obtained documents accusing Mr. Fayose of various acts of gross misconduct, a first step to his possible impeachment by the lawmakers. In June 2014, Mr. Fayose, a member of the Peoples Democratic Party (PDP), decisively won the governorship of Ekiti State after defeating then incumbent Governor Kayode Fayemi of the All Progressives Congress (APC) throughout the state. However, a major shadow was cast over the PDP candidate’s victory when SaharaReporters uncovered an audiotape in which several PDP politicians, including then Minister of State for Defense, Musiliu Obanikoro, Minister for Police Affairs, Jelili Adesiyan, former Senator Iyiola Omisore, and Mr. Fayose ordered Brigadier General Aliyu Momoh to use soldiers to intimidate and arrest APC members in a scheme to guarantee victory for the PDP governorship candidate. One of the legislators in Ekiti State told our correspondent, “We are going to look at the allegations against Governor Ayodele Fayose in a responsible manner and make our decision in line with the rule of law and the overall interest of the people of the state.” Asked to comment on the timing of the impeachment plot, a week after the APC’s presidential candidate won last weekend’s presidential election, the legislator said the assembly was already working on the issue before the elections of March 28. “I can assure you that this is not a case of partisan witch-hunt,” the lawmaker said. He added, “We are approaching the investigation with an open mind. No conclusions can be reached without a thorough investigation.” If the case ends up in Mr. Fayose’s impeachment, he would become the first Nigerian governor to be impeached twice. Strong indications emerged Friday that the Peoples Democratic Party (PDP) Chairman, Ahmed Adamu Mu’azu has fled the country to Dubai and may remain in self exile until after the presidential election. Sources in the intelligence and security circles revealed that the embattled chairman had become increasingly disenchanted with the abusive manner the Presidential Campaign of Goodluck Jonathan is being prosecuted and the seeming failure to rein in some of the elements that have gone overboard in attacking and insulting the opposition presidential candidate, Muhammadu Buhari. Our reporter learned that Mu’azu “found it tough to sell the candidature of Jonathan to especially his Northeast constituency ravaged by insurgent elements and neglected by the federal government.” The source further said that, “Mu’azu’s body language made the hawks in the government uncomfortable and who similarly made him uncomfortable. Most of his powers as chairman have been usurped by his deputy, Uche Secondus who is primed now to prosecute the concluding presidential campaign.” Our correspondent gathered that for some time now, Muazu has not signed a single cheque to offset huge adverts bill in several newspapers with one source pointing at that as evidence of being disenchanted and another insisting that he was being “muscled” out. A family source told our correspondent last night that the PDP chair had privately confided in him of his disenchantment with the abusive tone the presidential campaign has taken and he vowed that he would never go that low in insulting Buhari. The family source however stated that Mu’azu didn’t flee but confirmed that he was currently in Dubai en route Saudi Arabia to perform Lesser Hajj. On Thursday Muazu personally signed a press statement saying that he was doubtful of a landslide victory for his party’s candidate, Goodluck Jonathan. Efforts to get the response of Muazu failed, but a top echelon of the PDP yesterday night told Peoples Daily Weekend in a phone interview that Muazu did not flee. “We were with him in Yobe on Presidential campaign when he had to travel to Dubai to visit his sick mother.
