Does employer have the right to pay terminal benefits to some employee that they lay off running into million and after payment of the terminal benefits brought a new policy for the remaining staff that they are not entitled to any terminal benefits after exit from the company.

The Principal Statute in Nigeria, the Labour Act, has recognised that employees do have rights which must be protected. These rights stem from the fundamental human rights as enshrined in the Constitution of the Federal Republic of Nigeria, International Conventions and Protocols to which Nigeria is a signatory, to name a few.

Thus, an employee whose rights have been violated may bring against his employer an action for redress at the National Industrial Court.

Rights of the Employer

So to speak, the employee’s rights include the following;

Right to Maternity Leave
Right to Sick Leave
Right to freedom from discrimination
Right to Participate in Trade Union Activities
Right to Annual Holiday
Right to be treated with dignity and respect

Duties of the Employee

In addition to the rights of an employee, an employee also owes a duty to his employer, which the law expects him to render at all times of his employment. As stated earlier on, a duty is an obligation owed by one person to another. The employee’s duties to his employer include the following;

Duty to obey lawful Order. Lawful order includes instructions given within the context and timeframe of the work hours. An employee is expected to at all times comply with written and oral instructions of his employer. Failure to comply may result in the termination of the employment contract by the employer.
Duty of Disclosure: This duty requires that an employee must disclose to his employer all relevant and necessary information, must act in good faith, and personal interest must not and never conflict with his work obligations.
Duty to take reasonable care: In the performance of an employee’s duties, the law expects the employee to exercise great care and skill in order to avoid incurring liabilities to his employer. (Employers may in a bid to protect themselves from a careless employee, enter a separate contract of indemnity with the employee).
Duty to Indemnify the Employer: By this, an employee has a duty to indemnify his employer from the consequences of his negligent acts done in the course of his employment.

Consequences of Failure to perform his Duties

Where an employee fails to perform his duties as required by the law, the employer may sue the employee for damages caused and suffered. It is always to have a contract of indemnity signed by the employee in favour of the employer at the same time the contract of employment is executed.

The appropriate court having jurisdiction over labour-related disputes in Nigeria is the National Industrial Court.

My name is Mr Aunde Emmanuel (Age 34, Single). I worked as Customer Care Rep. at Peace Mass Transit, Emene, Enugu State.

On the 14th of January 2023, at about 07:00 a.m, I Logged into the Facebook page of Peace Mass Transit, even as an admin of the page, I also had access to it.

I discovered it had over 500k followers, and I later that same day edited the page and changed it to mine.
I was into content writing back in the days in school (University) as far back as 2011, I now took hold of the page, thereby not allowing other customer care have access to it.

For three (3) days, this lingered and it put my HOD, Mr. Ikenna Everastus under pressure from the company.

On the 16th January 2023, I had brought down all post and pictures on the page cos I was not wanting to use the page to impersonate or scam people, that was why I brought down all related post. Though my conscience had since then not been at rest.

Unknowingly to me that, the management already called some Facebook professionals to see how they could help retrieve the Facebook fan page.

On 17th January 2023, after official working hours, I called my HOD Mr. Ikenna Everastus at 7:00 pm, that I would like to see him and talk to him face to face. He agreed and asked me where we could meet. I told him to meet me close to where I was staying. That same night he showed up and I entered his car and we started talking.

I opened up to him, that, the Facebook page all of them were struggling to recover, I was the person in charge of it. And since then, I saw that it wanted to affect his (HOD) job, my conscience has not been at rest. Although he was disappointed 😞 and sad that it was me. He said if it was someone else he would had not been surprised, I told him I understand, due to the bond and good teamwork me and him had towards our job at Peace Mass Customer Care Service.

He asked if I could be able to resume office the next day being 18th and be bold to meet the GM and tell him what I said. And I told him yes, that I already thought of the consequences (Losing My Job).

On the 18th, I Resumed work, called my HOD and gave him login access to the Facebook account and also showed him how to secure it very well.

Afterwards, we moved to see the GM. In the office, the GM invited the HOD IT and my colleagues. There I told them same thing I told my HOD on the 17th night and then I was handed over to the policemen from Abakpa Area Command Police Station, Enugu, Enugu State

Before the policemen took me, there was an atmosphere of tears, from me, my colleagues including the policemen who came to arrest me.

Inspector Peter Udobi who was my IPO, said, why tears dropped his eyes was because he saw an atmosphere of repentance.

I was taken to the Area Command Police Station at Abakpa roundabout Enugu State. I was detained for 5 days and then I was now transfered to State CID Enugu State by the order of the CSO at Peace Mass Transit on the Charge of CONDUCT.

After much investigation by Inspector Peter Udobi of Area Command Abakpa Junction Enugu State, he discovered that, "the suspect did not intend to defraud anyone, neither did he chat with any customer and that was why he brought down the peace mass transit Facebook post and changed the page name."

"If the suspect intends to impersonate, he would had not brought down the Facebook post and name"

On the 23rd, I was transfered to State CID Enugu State command and my IPO name is Sgt. Chika Gabriel of the Cyber Crime department D18. I was detained for 2 weeks and 4 days after having several heart attacks in detention.

Later I was told that, Dr. Samuel Maduka Onyishi paid the Facebook professionals in Lagos sum of N12000000 to recover the Facebook page.

On the 3rd of February I was taken to magistrate court Enugu State by the order of the CSO of Peace Mass Transit Emene and the Lordship asked me if I had a Lawyer I told him No and he also asked the police lawyer if this case was a bailable case and the lawyer said No.

The Lordship ask that I be remanded in Enugu State prison till February 15th so I can be taken to high court for further judgement.

My prison remand Number is C/NO:146/23.


Public Request From Nigerians:

Please, I am pleading with the public, Nigerians to help me plead with the:

Family; Business Groups and Associates (Peace Mass Transit Ltd);

to help me plead with Dr. Samuel Maduka Onyishi, to please forgive me and withdraw case from court so I can get my life back.

I'm also calling on Nigerian Lawyers who wish to voluntarily stand for me in my next adjournment, which is dated 15th February at Enugu Federal High court to come help defend me. I have no money to Hire a lawyer.

I'm also calling on the Ordinary President of Human Right Radio (Brekete Family) to come to my aid so I can get my life back outside the walls of Enugu Prison.

I'm also calling on good Nigerians to help me. I am currently helpless!

Please do share until it gets to the reach of Nigerians who can help me out of this Enugu prison.

This will serve you right, ordinary Ahmed isah will not even help you because he is facing the same hacker, who hacked his YouTube and delete all is video. Let the law take it course to serve as a deterant to others.

I didn't receive any pension from them. They didn't open account for me. I remember i ask the HR he said pension is only for few set of people that not for me. Mine is to be paying me full salary. They were not deducting pension from my salary.

Let me tell you something I work with a pension fund administrator, the pension reform act state that any organization that have more than three staff should do pension for all it staff, not a selected few people. Pencom have been penalizing organization that refuse to do pension for staff or do selective pension as it applies to your case so you have a good case in court.

Secondly your organization is supposed to have a group life insurance for all it staff should in case of death if this is not the case National Insurance Commission will take them up.
Thirdly, federal government mandate all private companies to register all employees under Nigeria Social Insurance Trust fund (NSITF) should in case of any work related accident. If your former employer did not register you with NSITF then they have a big case to answer.

No need to worry. Get a good lawyer most foreigner violate the right of Nigerian and go away with it. I believe when your lawyer write to all this government agencies your former employer will beg you to let go off the case

My aunty's husband who was a civil servant in Lagos State, recently died. Before that, he had made her next of kin for his benefits. 

Although they have paid her husband's Insurance Benefit, they are refusing to pay her his Death Benefit, claiming that the insurance benefit is also the death benefit. 

Lawyers, insurance executives, civil servants and other Knowledgeable people in the house, please help out: Is someone trying to deprive a widow of her husband's death benefit?

Let's help this widow because she needs all the money she can get to take care of the children her husband left behind.

let the widow go to the husband pension fund administrator, bulk of the husband retirement benefit is with the PFA. all the balance in the pension account will be paid emblock to the next of kin. i don't know the numbers of years the deceased spent with lagos state government, but if he join service before the introduction of the contributory pension scheme in 2004, you can be assured that he still have outstanding benefit in the old defined benefit scheme.
