Yes, a judge has the power to make any ruling. It is not uncommon for a
convict to fight and lose a retrial battle, then give up. It is not like a lawyer just
shows up in court and ask the judge to free his client because he found new evidence.
It is not that simple.


It should, if a man is sentenced to 5 years imprisonment and spent the whole 5 years fighting for a retrial with no success. What is his gain?
It would have been better he didn't fight it and save his money.

You guys should go and ask your Barrister it's not possible to deny a retrial if there is a new concrete evidence even if a judge deny you or recused himself you have the power to go to higher courts.Double jeopardy only works for the same offence not a new evidence.
Even though the bolded is not our business,a retrial is always faster than a speed of light if the new evidence is genuine

It depends on the jurisdiction. Even the most liberal ones will require the convict
to file for a retrial which may turn out to be a lengthy legal process. After that will
the new evidence be examined for their merit or demerit.

A Conviction or acquittal becomes void immediately there is a NEW EVIDENCE! Judge has no power to rule otherwise
