My take on the recent supreme Court Judgement

I refused to comment, because for me it was wishful thinking and "iche onye ewu", until I saw a lawyer derailing completely.

The lawyer is mixing up two different "21 days" in the Electoral Act, 2026.

Section 82(1) of the Electoral Act 2026 deals with notice of a convention, congress, conference or meeting convened for the purpose of electing party executives or nominating candidates.

It provides:

Sec 82(1) “Every registered political party shall give the Commission at least 21 days’ notice of any convention, congress, conference or meeting convened for the purpose of electing members of its executive committees, other governing bodies or nominating candidates for any of the elective offices or merger specified under this Act.”- See APC's letter attached.

As you can see, there is no requirement in Section 82(1) concerning the submission of a party membership register.

Therefore, the letter the lawyer is referencing that APC sent to INEC on 20 April 2026, was to notify the Commission of the dates of its primaries in compliance with Section 82(1).

It was a notice of the proposed party primaries; it was not the submission of APC's membership register.

Section 77(4) is the provision dealing with the membership register.

Section 77(4) provides:

“Each political party shall make such register available to the Commission not later than 21 days before the date fixed for the party primaries, congresses or conventions.”

This is another 21 days.

It was pursuant to this requirement that INEC gave political parties the applicable period within which to submit their membership registers, with the deadline extended to 10 May 2026.

INEC subsequently confirmed compliance with the submission requirement. See INEC'S letter attached.

This distinction is important.

Notifying INEC on 20 April 2026 of the date of a party primary does not mean that the party's membership register was submitted to INEC on 20 April 2026. The lawyer got it completely wrong.

The two events serve completely different purposes under the Electoral Act.

However, Section 77(5) settles the consequence.

Section 77(5) provides:

“Only members whose names are contained in the register shall be eligible to vote and be voted for in party primaries, congresses and conventions.”- To this end INEC gave political parties a deadline of May 30th, 2026 for the conduct of Party primaries.

Consequently, if APC's membership register was submitted to INEC on 8 May 2026, as confirmed by INEC, the relevant question under Section 77(5) is whether the person's name was contained in that register and if the primaries were conducted on or before 30th May, 2026.

For example, a person who became a registered member of APC on 27 April 2026 will definitely have his or her name included in the membership register subsequently submitted to INEC on 8 May 2026. (13 days after he/she registered)

There is therefore no legal basis for automatically equating:

20 April 2026 — Notice of Primary to INEC

with

8 May 2026 — Submission of APC Membership Register to INEC.

They are two different statutory requirements governed by two different provisions of the Electoral Act: Section 82(1) and Section 77(4).

And ultimately, Section 77(5) identifies the persons entitled to participate in the party primary: those whose names are contained in the party's submitted register.

Finally some have argued that from the 27th of April 2026 to the first day of the APC's Primaries was 18 days. That's grossly immaterial.

I need to remind us that the APC revised its timetable and moved the Presidential Primaries to 30th of May, 2026.
The guideline is clear, that all Parties must conduct their primaries between 23rd April 2026 and 30th May, 2026.
