If Tuface did not legally divorce Anne, he may be liable for bigamy if she can prove that they had statutory marriage and that she had not been properly divorced. Under the Nigerian law when you want to divorce a woman you need to obtain two orders for the divorce to become complete. the first Order is called Decree Nisi and the second order is called Decree Absolute. After a divorce case is successfully what the judge is allowed to first order is for Decree Nisi and during this period if the wife is not comfortable with the divorce she can go to the Court of Appeal to challenge(cancel) the judgement. If the wife is successful the divorce will not hold. The most funny thing about this Decree Nisi is that if the man dies during the Decree Nisi it will be taken as if there was no Divorce because the Court has not ordered Decree Absolute and the wife will get all her full rights even though the man has divorced her. If the woman wants to pepper the man she can hang the appeal at the Court of Appeal for a long time and the Judge will not grant a Decree absolute. There have been many cases where the husband and wife were hanging at the Court of Appeal and the man died in the process and the wife was granted the full rights of a legally married wife even though the man was successful at the High Court and has gotten Decree NIsi. |
Kobojunkie:there is no law without exceptions. Bodily autonomy cannot override marriage obligations same way the fundamental rights of a child cannot prevent a father from punishing him for purpose of discipline. If you deny your husband his marriage obligations he has the right to go to court to get a court order to make you give him his marriage rights. |
princepee:the law is sacred and does not change even if people don't obey it. What matters is that it can catch an unfortunate person once in a while. The rich can afford to hire the best lawyers and defend their case and tell you that money na water. You cant expect the same from the poor. what matters is that the law is sacred and sacrosanct. Like i said under Islamic law they are allowed to marry up to four women. |
DrAkpa:tell us the truth then if you know it. You cant say something is a lie if you dont know the truth. for a lie to be established there must be proof of truth. |

galantjoe:At least under court marriage she will get some settlement but under traditional marriage she is expected to refund the bride price paid on her head. |
bdon123:dont worry when you jam a woman that knows her rights and can fight for it you will learn the hard way! |
Exceed15:you know that it is not easy for some men. maybe they want to maintain their marriage. |
If you are legally married in Nigeria, you cannot marry another person unless you want to chop free beans in kirikiri but this law will only apply if you had a statutory aka court marriage (that “white wedding” covered by Oyibo law). In Nigeria, we have 3 types of marriage: 1. Traditional Marriage: This is covered under African culture which encourages and allows polygamy. A man can marry as many wives as he likes but the wife can’t have more than one husband. The worst part is that the property of your husband will be shared according to native law which gives her nothing much because the native law sees the wife as a property to be shared and does not give her much power to inherit. Divorce is very easy in traditional marriage, it only requires sending the woman out and asking her family to refund the bride price you paid. 2. Islamic Marriage: You can marry up to 4 wives and divorce is very easy because the man can just say “I divorce you” 3 times. The property of the man will be shared under islamic law. 3. Statutory Marriage: This is covered by Oyibo law which demands 1 husband, 1 wife. Divorce is very difficult and you must go to court, follow strict process, and it is not cheap. The property of the husband will be shared according to oyibo rules. AS a woman make sure that you demand for Statutory marriage with your husband because it protects your rights 100%. It’s harder for a man to just wake up and marry someone else. Your Peace of mind secured. It even protects you from the man's family and even your own children because the properties of your husband will be shared according to Oyibo law which gives you something huuuge and not according to native or islamic law. Before the man will be able to divorce you he must go to court and agree to give you half of his properties and also if he dies, the law requires that you will take half of his properties first even before the children will share whatever remains. Statutory marriage is the best for an educated woman in this modern world. As a man, if you know you can mistakenly marry another woman or have side chick or give another woman belle outside your lawfully married wife please avoid statutory marriage before you enter prison. FOr you to marry another wife you must first dissolve the first marriage and be free to go into another marriage. |
🚨Did You Know?🚨 Under Nigerian law, if your legally married wife denies you sex — not just once, but repeatedly — you can actually take her to court and get a court order for her to give you your right! 😳 Yes o! The court can issue what is called an “Order for Restitution of Conjugal Rights”. This simply means that the judge will order her to return to the marriage bed and perform her marriage duties! 😮 📚 This is not vibes or cruise — it is real law! You can find it under the Matrimonial Causes Act of Nigeria. Before you rush to file case, please, note: ⚖️ This applies to legal marriages only (not just boyfriend/girlfriend or "come and stay" .⚖️ The court will first try reconciliation. ⚖️ It also works both ways — wives can file too! What do you think? Should the court be involved in bedroom matters? 🤔 Drop your thoughts below 👇🏾 #NigerianLaw #MarriageMatters #ConjugalRights #LegalTori #wetinlawsay |
Kobojunkie:when the law recognizes a right and obligation and permits a person to sue to enforce it what else do you need to make it enforceable. if the court order to restore conjugal right is obtained it is a ground to divorce without any other excuse. That is also a way of enforcing it. |
DrFunmisticGlow:no it is under the law both the south and north as long as it is a statutory marriage. you should google section 47 of the Matrimonial Causes Act. it provides for the restoration of conjugal rights. |

Samantha125:the constitution said there is no difference between a child born inside a marriage and the one born outside a marriage. |
Dtruthspeaker:but the constitution said they should have equal shares and when a man dies he will not be there to say anything. The court will decide it for him. |

🚫 STOP Female Circumcision. It’s Not Culture—It is a CRIME. 🚨 Dear Nigerians, let’s be clear: Under Nigerian Law, female circumcision is ILLEGAL. Yes, you heard right. 👉 It is a crime to circumcise a girl child. 👉 It is a crime to encourage it. 👉 It is a crime to help someone do it. You can go to prison, face a hefty fine, or both. The law is called the Violence Against Persons (Prohibition) Act. Read it. Know it. Share it. Culture is no excuse for cruelty. Protect our girls. Break the silence. Let’s END female genital mutilation in this generation. 💔✂️🚫 #ProtectTheGirlChild #SayNoToFGM #EndViolenceAgainstWomen #NigerianLaw #JusticeForGirls #VAPPAct |
Kobojunkie:most men dont care if they were responsible they will not be running away from their responsibility. |
Kobojunkie:nobody is a bastard i am sure they are not at fault. men should do the fair thing and take care of their children. |
Kobojunkie:yes they should get something because it is their right. I think that is the right thing to do. |
Dtruthspeaker:they may start to cause problems when the man dies so it is better that the man will share everything and give everyone something before leaving the world. The constitution is very clear on that. |
Dtruthspeaker:Bro no matter at least give them something small so they can use it to guide |
Kobojunkie:I never said that bro I only meant that men should put their house in order when they are alive. Give everyone their share when you are still alive so that there will be peace when the man leaves. |
📢 "DEAR NIGERIAN MEN: You see that your child from side chick? He has the SAME inheritance rights as the ones from your legally married wife!" Yes, you heard me right. As long as you’re the father, Nigerian law does NOT discriminate. Wife, baby mama, side chic, weekend mistake… the children are equal under the law. Even if your wife does Thanksgiving every Sunday… Even if you never paid bride price… Even if the child lives in another state… 👉🏾 If there’s no will, ALL your children can show up and inherit when you die. 💀 You won’t be here to explain. But the courts will simply settle it for you by following 📜 Section 42 of the Nigerian Constitution which says: No Nigerian child shall be denied any of their rights because of how or where they were born. Let that sink in. 😳 So before you start hiding children in other states... 😬 Before you say “Na only my wife’s pikin dey count”... Ask yourself: 📉 Have I written a will? 📈 Do I want my children to drag themselves in court or beat themselves at the funeral? 💡 Solution? Write a will. Or be ready for "game of throne movie" after you die. 🎬⚰️ 👀 Tag that your uncle, cousin, or friend that needs to hear this. 🧠 Share this to someone before it’s too late. #NaijaLaw #BabyMamaNoBeSideChic #NigerianFathers #KnowYourRights #InheritanceWahala #WillOrWahala #FamilyDramaLoading |
