Start from here since you say your family is not financially buoyant.

First locate any police officer that’s above the rank of an inspector or a staff of the Social Welfare Department of the Government ( I will recommend the later, police officer may be demanding for money). Explain everything to the person stating that your brother is living with serious mental health condition. And you don’t have any means to help him and that his condition is threatening the lives of other family members and neighbours.

Don’t include that you have been beating him please. Section 41 of the National Mental Health Act 2021 specifically authorizes these persons to make an application of involuntarily admission on victims behalf.

To locate the Social Welfare officer in your state, ask around they are usually at the Federal Ministry of Health, since the Act is a Federal legislation.

You can hold a copy of the law and show the person and plead with him or her to help you. It doesn’t cost him anything. I will suggest you approach a female. They could show more empathy and be quick to respond.

If your application for involuntary admission is granted, your brother will be admitted for 28 days and if they notice (medical officer who usually are empowered to make the recommendation) or you notice his situation is not improved, you have to make another application for extension to the mental health assessment committee before the expiration of the 28 days. The chairman of that committee is often a lawyer. You can find out about him at the hospital if you can contact him directly, he may assist you.

The Act guideline on how to prepare the application and what grounds it must contain can be found in Section 28( 3) (4) of the Act. Summary of these provisions: the application must show its for the best interest of your brother who is the person with a mental health condition. So don’t go about hating on him in your application. Otherwise the application won’t be granted.

Regarding the beating, it’s actually a criminal offence punishable under the National Mental Health Act to torture, cage , administer forced treatment, seclusion or discriminate someone suffering from mental illness.

Part II of the Act contains a very long list of the fundamental rights of mentally ill individuals. And as a matter of fact, a mentally ill person has the same fundamental right as a fellow sane citizen. So, be guided accordingly.

To help the Social Welfare officer navigate his work, the right department to approach at the federal medical center is the Department of Psychological Medicine / Psychiatry at Abia State University Teaching Hospital (ABSUTH), Aba. It’s where the officer can address his letter to apply for involuntary admission for your mentally ill brother.

Section 1(c) of the Act makes provision for the “mental health fund” probably that’s where the money for your brother treatment will be drawn from.

If your brother is ever going to need a lawyer, and since you don’t have money, Section 22 provides for legal representation to a mentally ill individual and in fact where in your case your family cannot afford the service of a legal practitioner that section makes it mandatory that the state must provide one for you.

If you want to make this process seamless, you can find any lawyer in your community and plead with him to help you navigate the process. You can show him my comment. It will safe him cost of research time. If he’s busy, you can ask him to refer you to the NBA probono team. And whoever they assign to you, show him this my comment. You can copy it to your phones notepad.

Do you have any NDLEA office around you where your parents live or where you live in the city? Try bundle and take him there, explain all your predicament to them. In the NDLEA they have several departments that handles different levels of drug abuse. And they wouldn't charge you. They will detain him and manage him while you guys will be bringing food to him.

I would have said you should charge him with attempted murder but that would be too harsh... That's the only way to have him apprehended and locked up by the law... Just know that when he eventually gets out of jail; he will come for everyone!!!

A more humane advise is to try get the money needed to send him to a psycho hospital.
