It clearly stipulates and itemizes any pending or existing issues that relates to the property (if any). A genuine Deed of Assignment must contain the following: ---- Full names of both parties (Buyer and seller) ---- A column for date (which should initially be left blank because if you don’t stamp it within 60 days of stated date, you will attract a penalty for everyday in default after the 60days). ---- The addresses of both parties. ---- The history of the property i.e how it was first obtained from original owner, the documents it possesses, how many "hands" it has passed through, etc ---- The price of the property which seller accepts to be paid ---- Details of verifiable documents the property possesses. ---- A comprehensive description of the property. ---- The covenants or promises both parties agree to undertake to finalise the transaction ---- The signature of both parties and Witnesses to the Transaction ---- The section for the Governor or its representative to consent and validate the agreement. ---- The name and address of Lawyer that prepared the Deed From these contents of Deed of Assignment listed above, you'll notice it's almost impossible for you to have any litigation issue in future that may threaten your legitimate right to claim ownership of your property if your deed of assignment is well prepared and all terms spelled out with the consent of the government. I once received a call from a prospective client informing me of his intention to sell off some plots of land at almost half its current value because he needed money urgently to execute a contract. My excitement at the possibility of a quick sale knew no bounds because I got a serious request some couple of days earlier for land in that exact location. So I immediately set up a meeting to view and familiarise myself with the location of the land and also take a look at the title documents but (un)fortunately, after going through the documents, I discovered that the survey plan isn't a registered one which simply means that there exists a possibility the land could be an illegitimate one . I asked if he did a land search before paying for the land and his answer was 'NO', because according to him, the people he bought the land from are his relatives and very trustworthy people. Well, I had to let him know that since I was coming with the buyer, I'm not going to fail to advise my client to do a search at the Lands Bureau. Long story short, we did the search and the land in question is still in the market for sale till this moment. I never fail to tell those who care to listen that you must ensure that you know the status of your property no matter how long it has been in your possession. Knowing the status of your land eliminates all unexpected occurrence in the future. You cannot lay any claim to what is not LEGALLY yours if/when the need arises. One of the most important documents in Real estate is the Survey. The SURVEY PLAN is a document that measures the legal boundaries of a parcel of land to give an accurate measurement and description of that land. Before you pay for ANY land, you must demand for the survey to enable you do a proper land search at the lands bureau. Then, you must get in touch with a licensed surveyor who will not only confirm the exact measurement of the land but will do a proper search on the status of the land at the surveyor general's office. This will ensure that you verify it's authenticity and guarantee your peace of mind. Also make sure you demand for the land information certificate from your Surveyor though this takes a couple of weeks before it can be processed, it is a concrete proof that you have a first hand information on status of land. A genuine survey must contain the following: 1) Name of owner of land 2) Size of land 3) Description of land 4) The surveyor that drew the plan and the date the survey plan was made 5) "Free from acquisition" stamp 6) Beacon numbers Owning a property is a necessity and a luxury. I recently bumped into a childhood friend who I hadn't seen for almost two decades but unfortunately, after a couple of minutes catching up on old times with all the excitement of an unexpected reunion, he nearly broke down in tears when he began to narrate the unpleasant situation he currently finds himself. He had just received a notice from the government that his house and every other within his vicinity has been marked for demolition as it's a committed land under government acquisition. What this means is that he's about to lose his house (investment) where he's lived for over 5 years at a time he can't even afford to rent a place let alone build another. His story is not different from so many others who have invested their hard-earned money in the ever lucrative world of real estate only to later discover they are unfortunate victims of illegitimate transactions. According to the Land Use Decree of 1978, ALL lands in the state are under the control of the state government even though it gives out some portion to the traditional dwellers of the communities (omo-onile) to do whatever they please. Lands not given out to the omo-oniles are either 'merely' under the acquisition of the government or committed. If a land is 'merely' under government's acquisition, people in similar situations as my friend can qualify for Ratification/Regularization to save their property from demolition but if it's a committed land, there's absolutely nothing that can be done because these lands have been set aside specially by the government for projects such as roads, bridges, housing estates,etc . It does not matter how long you've owned that property or how much you've spent developing it, when the government decides to make use of it's land, nothing stops them. Stories such as these does not change the fact that real estate will forever remain one of the most lucrative investments in the world with a huge percentage of the world's billionaires directly involved in it. It is a powerful investment tool for anyone seeking financial independence or freedom but the major problem potential investors face is usually lack of adequate information. You should understand that one of the major advantages of a true real estate investment is that profit is made when you buy, not when you sell so before you buy that property (Land or House),you must have a very clear objective of what you intend to do with it and a budget to match.Then, you must make sure you have enough experience in the purchase of properties that will ensure you have a successful transaction and a deserved peace of mind forever.
