I have tried in vain to avoid making a comment on this post to no avail. It is unfortunate that people who don't have the slightest idea about law school are comng here to say that students failed because they did not read. That is absolutely not correct. While few may not have read, majority read their lives out. I am one of those who wrote the last Bar finals. I graduated with a CGPA of 4.80 and had a study group made up of some 1st class and 2-1 graduates. We read very hard and shared ideas. But when the result was released, only one person in my group had a 2-1. I had a 2-2 with several others while 2 had a pass.Let me make it abundantly clear that the last Bar finals result does not reflect the kind of effort that was put in by students. How I got a 2-2 is still a mistery to me but I refuse to allow myself to be defined by that grade because I know am worth more than that. There is no constitutional provision preventing a governor of a state from defecting from a party after elections. If anybody has ever seen such a provision let him or her bring it to our notice. In ANPP v Yuguda, the court refused to declare vacant the seat of Governor Yuguda following his defection to PDP. Secondly, the case of Atiku Abubakar v AG Federation is very clear on this. The Supreme Court held that even though it was morally wrong for Atiku to have defected from PDP and still remain in office, there was nothing legally wrong with that. It is my humble submission that the case against the governors will not hold water |

It beats my imagination the way people reason on Nairaland. There is nothing stopping a litigant from seeking to withdraw his suit. When a suit is struck out, it has not been decided on its merit hence there can be no victor. |

An appellate court after evaluating the decision of the lower court can alter it. There is no law prohibiting it from increasing or reducing the sentence of the lower court. It should however be noted that where the appellate court increases the sentence,that is the subsisting judgment and the accused has no option of picking the lesser sentence of the lower court. |

It is imperative to state ab initio that am not holding brief for Amaechi but certain things need to be put in proper perspective. Assuming without conceding that Amaechi intends to run for the office of Vice President in 2015, is that a crime for which he should be so harassed? Is it not his fundamental and inalienable right to so do? Secondly, when did it become a crime for a state governor to disagree with the president? Must Amaechi agree to every policy of government even when they would hurt the interest of Rivers people? The sky is big enough for any bird to fly, so this reckless vilification of Amaechi should stop. If he chooses to run in 2015, let it be up to Nigerians to decide whether to vote for him or not. |
