his visa catogery was ir-2 ....denial was on the basis that adoption is not valid cuz adoption didnot met some provison of the adoption law ![]() |
hlo officer,my brothers immigrant visa was denied and sent back to uscis..anyhow do u know how long does it take uscis to receive the case and review it??if we are able to rebut the consulars decision can they deny him again for the same reason of previous denial during his 2nd interview? pls throw some light on this issue. thanx ![]() |
dear vo,i read on web that the approval time of I-130 depend upon various factors nd one factor is the complexity of the case...more the complex case more time will it took to be approved/denied now my question is that i think consular officers dont have as much time as uscis they have to act fast now how do they reach the verdict soo fast or do you recieve a memo about the particular case from uscis whn you receive petition from visa center??can uscis approve a case just to be denied by visa officer?? ![]() thanks ![]() |
@ hello sir, what are the chances of getting an immigrant visa after I-130 is approved by uscis??what is the percentage of denials compared to non immigrant visas ?what type of denials are most common? nd is it common for a visa officer to return an petition back for revocation? |
thanks you sir for clearing my doubts however i didnt understand what do you mean by USCIS is not allowed to adjudicate visa cases?? on the other hand you said in petition-based IV cases, we Consular officers only have the authority to issue visas??then who adjudicate IV cases![]() |
@visaofficer hlo sir,plz bear with my bad english i have a ir 2 visa interview this month but yesterday i noticed that there is a mistake in form ds 260,my given name in form is not matching with given name in my passport .it was filled nd submitted by lawyer.he messed up my given name,he forgot to type my last name.will it cause any problem at interview or how it can be corrected? i have few more questions if you dont mind sir :-1) my sister got her IV few months back nd she is now in states,does this by any means increases my chances of geting my IV visa?? 2) some applicants are denied at their interview cuz they not are qualified for that specific visa category like i read some where a beneficiary who had interview for an ir 4 visa,he was denied nd advised to apply for an ir 2 visa ...doesnt uscis or dhs checks if the beneficiary is eligible for visa category he/she is applying?? 3)i always read on web that visa is temporarily refused nd visaofficer need additional proof or specific documents now why doesnt uscis verify the petition properly nd make sure it doesnt need any additional documents before forwarding it to the embassy ? 4) can a visa officer issue a visa on humanitarian basis or out of sympathy?like a beneficiary has a bonafide relationship with the petitioner nd completely depended upon the petitioner but somehow their relationship is not legally recognized like relationship is adoption based but adoption is not valid 5)does the visa officer verify the validity of documents submitted like adoption deeds,birth certificates etc? or he just makes his decision based upon the interview i mean isnt its the job of uscis or dhs to make sure that all documents are valid nd according to law 6)i know all you need is speak truth at inyerview but can you plz give me any additional tips how to present my self at interview? ![]() |
