The Lekki Estates Residents and Stakeholders Association (LERSA), the umbrella body of Residents Associations of over 77 gated Estates from 1004 Estate area down to Epe, have added their voice to the clamours of Residents and Property Owners in Lekki, Lagos

LERSA condemns the inhuman treatment of Homeowners who are being thrown out of their homes in Victory Park Estate and Goshen Beach Estate and other Estates in Lekki by Asset Management Corporation of Nigeria (AMCON) with the use of heavily armed policemen and a group of fiercely looking unidentified armed men. Several families have been forced out of their homes with mothers and children left out in the heavy down pour of rain with little or no notice at mid-day when most Residents were out for work.

LERSA reiterated the fact that residents and property owners in the affected Estates bought into gated Estate Schemes like most estate development Schemes in the Lekki axis of Lagos State. These properties are widely publicized, and in the case of GOSHEN Beach Estate, the sale was a joint venture between the developer and Lagos State Development & Property Corporation thus giving comfort and confidence to would be subscribers/buyers that they are credible and the titles are free from any encumbrance. It is appalling and devastating to buy into a State Government sanctioned transaction only to have homes and life sustaining facilities like sewage treatment, borehole and recreation area forcibly sealed up almost twenty years after purchase.

In view of the current circumstances of some of our Estates with AMCON, it is the opinion of LERSA that the right and equitable thing for AMCON, which is a Government Agency to do, is to go after the assets of Developers who are the loan defaulters and not prey on soft targets that are innocent citizens, who are bona fide purchasers for value, without notice of any encumbrances known to law. The enabling law establishing AMCON stipulates that AMCON Receiver Managers shall take over receivership of properties of judgement debtors subject to existing encumbrances.

Residents and Property Owners of Victory Park Estate and Goshen Beach Estate who bought their lands and built their homes in the Estates, have suddenly become soft targets of AMCON for the recovery of bad debts.

It should be noted that our members who are the owners of their properties duly paid for by them have no relationship whatsoever with AMCON. Any bankers who accept common estate facilities such as waterworks, road network, general service infrastructure and so on as collateral for loan will need to question his/her qualifications as a banker. It is shocking to see AMCON appointing a receiver for properties which has been bought and paid for by individual Nigeria citizens rather than go after the judgement debtor, it is appalling that AMCON came after innocent citizens as soft targets after the demise of the developer who is their banks customers. Our properties were acquired and paid for fully without any caveat and or encumbrances.

The use of force with the help of unidentified armed men to invade, intimidate and force out; law abiding citizens from their homes by any Government Agency is strongly condemned and should not be allowed to thrive in our democracy.

We call on President Mohammadu Buhari, the Vice President Prof. Yemi Osinbajo, the Governor of Lagos State, His Excellency Babajide Sanwo-Olu, the Inspector General of Police, Mohammed Adamu, the Chairman of AMCON Mr Muiz Banire and the Managing Director of AMCON, Lawan Kuru to intervene in the matters of Victory Park Estate, Goshen Estate and any other Estates in Lekki and ensure that innocent Nigerians are not deprived of their homes and properties.

AMCON INVADES VICTORY PARK ESTATE WITH POLICEMEN AND ARMED THUGS
..........FORCIBLY THROW OUT WOMEN AND CHILDREN FROM THEIR HOMES

Tuesday, 25th June 2019 was a traumatic day for over 300 Families in Victory Park Estate, Lekki Lagos. Asset Management Corporation of Nigeria (AMCON) in a gestapo style action invaded the homes of Residents in Victory Park Estate while most residents were at their places of work leaving their young families exposed to the invasion of over 30 armed police men and over fifty thugs claiming to be executing a High Court Judgement of 2017 against Knight Rook, Grant Properties and the Awosedo’s (Promoters of Victory Park Estate).

According to eyewitness who craved anonymity “the Action was carefully planned by the AMCON and its Receiver Manager, Mr. Lanre Olaoluwa to take place at a time that most Home Owners would be at their places of work”. Homeowners had to rush back to the Estate when they received a distress call from vulnerable members of their families left at home.

A traumatized resident who also witness the AMCON rampage lamented that “One of the families with children between the ages of 3 and below were forced out of their homes with little or no time to pick any personal effects under heavy downpour and very heavy armed presence”. He decried such inhumane treatment of hapless victims of high handedness and warned against a reoccurrence.

AMCON Obtained a Judgement against the Promoters of the Estate and seeks to attach the lands and property in the Estate to the Judgement debt without taking into consideration existing encumbrances which are lands owned by Individuals and families who purchased their land, built their homes and have been living in the Estate without any notice at the time of purchase of their land of any encumbrances on the land. No Registered Mortgage and no Caveat at the Lands Registry.

The various Banks that handed over the debt of the promoters to AMCON, knew that the Promoters were selling the lands to innocent hard working Nigerians who took loans to purchase land in a supposed secured Site and Service Estate having done their due diligence at the land registry.

The Promoters and the Banks are parties to the fraud against innocent Nigerians and now AMCON has degenerated to an Omonile by taking over homes of families and sending mothers and children out of their homes under very heavy armed presence and down pour.

AMCON is a supposed Agency of Government and must not be seen to exploit the vulnerability of families that genuinely purchased land and built their homes in their Country only to be evacuated from their homes in a gestapo manner. AMCON Act provides that AMCON and its Receiver Manager shall take over Assets subject to existing encumbrances. The Judgement against the Asset of the promoters should ideally not extend to what no longer belongs to the Promoters. “You cannot give what you don’t have”.

Families in Victory Park now live in fear and horror not knowing which family will be next to be thrown out of their homes. A Government should not through its Agency treat its citizens like outcasts. The families are vulnerable, AMCON has the instrument of State, the Courts and the Police and now the self help thugs. “Who do the Citizens, the over 300 young families in Victory Park; Who do they have”.

While the Families are seeking legal help, AMCON as a Government Agency is enjoined to immediately call to Order its Receiver Manager, Mr Lanre Olaoluwa who happens to be a legal practitioner to desist from the harassment and intimidation of families with the use of armed thugs and heavily armed police men.

The Chairman of Pan Ocean, Dr Festus Fadeyi has assured that the Pan Ocean’s Amukpe-Escravos Pipeline Project (AEPP) in Delta State, will go up stream in 2018.

He emphasized that the project, which will significantly boost Nigeria’s crude oil exports by 160,000 barrels per day, will also serve as an alternative to the much-troubled Trans Furtado’s Pipeline (TFP) for oil companies operating in the western Niger Delta.

The chairman, a well-respected businessman and philanthropist noted: “Driven by the urgent need to encourage alternate field production potential of exploration and production companies as well as infrastructure development for Nigeria, Pan Ocean, Operator of the Nigerian National Petroleum Corporation (NNPC) Pan Ocean Joint Venture awarded a contract for the construction of Amukpe-Escravos Pipelines Project (AEPP) to Fenog Nigeria limited, an indigenous company in 2011. The contract which involves installation of 20 inches pipeline across the 67 kilometers route will have capacity to handle 160,000 barrels of oil per day (BOPD) with remote manifolds to accommodate third parties crude oil evacuation to the Escravos Tank farm.”

Dr Fadeyi remarked that, “The Amukpe-Escravos Pipeline Project (AEPP), a joint venture (JV) of the Nigerian National Petroleum Corporation (NNPC) and Pan Ocean Oil Corporation, is scheduled to come on stream by early 2018. It is hoped that the pipeline project will offer an option to the “much troubled” Trans Forcados Pipeline (TFP) for crude export from mid-western oil producers in the Niger Delta.

According to the oil and gas boss, “The TFP has a daily capacity of 240,000 bpd, with average daily flows ranging between 200,000 bpd and 240,000 bpd. Amid it’s shutdown, Nigeria’s crude oil production fell from 2 million bpd to as low as 1.27 million bpd, losing its position as Africa’s number one crude oil producer and falling behind Angola several times over the past year.

The AEPP is going to be a major export line, it also gives opportunity for other injectors who may also be stalled by the erratic vandalism of the TFP to join in transport crude to Escravos together.

This great achievement means Pan Ocean has an alternative line to export its crude and has also created an opportunity for others who have been using TFP to also export their crude without disruption. This project will help the country to continue to flow their crude and keep the economy alive.”
