I do not think I own anybody an apology for doing that. However, I admire your passion to move the country forward. Politics › Court Dismisses Suit Against Akpabio by dkdimgba(op): 9:10pm On Sep 14, 2012
The Federal High Court on Friday dismissed a suit challenging the Akwa Ibom State Govornor, Godswill Akpabio’s nomination as People’s Democratic Party’s (PDP) governorship candidate for the 2011 election in the state.

Delivering judgment in Abuja, Justice Abdul Kafarati held that the matter brought by Frank Okon, a governorship aspirant, had no ‘locus standi’ to commence the action.

Kafarati noted that the plaintiff’s claim that he was the authentic candidate of the party was not known to law adding that the Electoral Act and the constitution of the party empowered the party to conduct primaries to nominate its candidates for elections.

He held that the provision had made it difficult to obtain the nomination of party slots from the court of law.

According to him, the court is convinced on the process that brought Akpabio as PDP candidate for the 2011 governorship election.

“The court had previously validated the PDP primaries held on Jan. 15, 2011, which the governor won. The court stands by it since it has not been set aside.

“This summons asking the court to nullify that judgment which validated the Akwa Ibom PDP governorship on Jan. 15 primary is hereby dismissed.” He said.

Okon had in the suit, in which he joined INEC, PDP, and the former National Chairman of the PDP, Haliru Mohammed, as co-defendants, urged the court to declare him as the candidate of the party.

He urged the court to nullify all acts, tasks and functions purportedly performed during and after the Jan. 15 primaries.

Okon further sought an order compelling PDP to comply with Section 87 (3) of the Electoral Act 2010 and Article 17 of PDP Constitution.

According to him, the election contravenes the 1999 Constitution, the PDP Constitution, and the guidelines for the PDP governorship election, as well as the Electoral Act.

He argued that Akpabio was not qualified to have contested the January 15 re-run primaries held in the state.

Politics › Court Declines On Impeachment Moves Against Jonathan by dkdimgba(op): 7:24pm On Sep 14, 2012
A Federal High Court, Abuja, on Friday, refused to stop the House of Representatives from beginning impeachment moves against President Goodluck Jonathan over poor budget implementation.
Justice Gabriel Kolawole declined the exparte application by the National Chairman of African Liberation Party (ALP), Dr. Emmanuel Osita Okere, who asked the court to stop the House.
Emphasizing the need for caution, the court said it must have been established that the impeachment proceedings had begun before it could hear the suit in order not to interfere with the functions of the House.
By the provision of Section 143 (1) of the 1999 Constitution, the court held that no single arm of the national assembly can unilaterally impeach the president, adding that it requires a joint resolution of the House and the Senate before the president could be removed.
By not joining the Senate as a party to the suit, the court said, the motion ex-parte cannot succeed.
"This may not be the proper occasion for this court to grant ex parte order against the 2nd and 3rd defendants, as the reliefs sought by the plaintiff largely benefits the president", the court said.
Justice Kolawole accordingly refused the ex parte order and adjourned the matter indefinitely, for the Chief Judge to re-assign the case.
Moving the exparte application, the Applicant's counsel, Alex Williams had prayed the court to grant an interim order restraining the House, saying, it was capable of distracting the president from discharging his duties.
The defendants are the Speaker Aminu Tambuwal; the House of Representatives, the Attorney General of the Federation and Minister of Justice and President Jonathan.
In his affidavit in support of the originating summons, the plaintiff stated that the move to impeach the president is heating up the polity, describing it as a disguise to cause political turmoil.

Politics › Attempt To Cause An Unrest In Nigeria Capital City by dkdimgba(op):
"This demonstration as gathered is a planned attempt by the AkwaIbom state government to disrupt the court sitting tomorrow being Friday 13th September 2012 in Abuja to decide the case between Governor Godswill Akpabio and Engr Frank Okon."

David Mark and Tabawal in Uyo, AkawaIbom State capital
However, following the court sitting tomorrow to decide the case between Akpabio and Frank Okon which has been adjourned since July 12th, the senate president and his counter part in the house of representative made a visit to Uyo earlier today. as of the time of filing this report, it is yet unclear to us what assignment the two are carrying out in the AkwaIbom State capital. It is possible they are trying to calm down the situation or trying to resolve issues.

dkdimgba: It was largely reported that the presiding judge for the Akpabio and Frank Okon case did not show up today, hence the case was not decided. But here is a beautiful report of what may be. Personally I cannot imagine such a performing governor facing a heavy litigation as this. But such is no longer a surprise following recent developments in this country of ours.
