He only needs to prove that some polling units miscalculated his votes and was disenfranchised and lay claim to a substantial votes and once proven he will be awarded the votes. I am saying this with emphasis on what happened in Imo state governorship. Hope went to court to prove his stronghold was disenfranchised and concocted a tangible amount of votes as claim that those are the numbers that he could have gotten, when the SC established that he was truely disenfranchised they awarded him the votes that's how he became Governor. Everyone knows that he couldn't have amass such if the votes were to be done in reality. The same thing here if PO can establish that his votes were disenfranchised in some of the PUs and lay claim to amount of votes that's substantial to make up the number he can actually be declared a winner. I insist that Wike made it easier for LP to lay claim on substantial votes. Once they prove that the LP votes were suppressed they can lay claim to votes in millions and also the same with other units they have such discrepancies. I am just comparing the outcome with already established outcomes not even making technical input. He has a chance what is remaining to see is what line of technicalities the justices might decide to tow.

Exactly my thought too. I believe this is also the reason his lawyers are more hungry to get hold of the original election materials. They know that the only evidence is to prove that his votes were either miscalculated or misappropriated.

But if they go the way of not uploading of BVAS like PDP is doing then there will be no chance.

Precedence is significant when courts make ruling on issues, especially issues as sensitive as elections because the consequences can be dire. PO and his team would have to present "overwhelming" proof of any claims they are going to make to get any favorable judgement. The court, more than any other institution measures the temperature of the country. General pockets of violence, intimidation or manipulation may not be enough, it doesn't make it right but it is the truth.

Also, the party that appointed the Justices of the High, Appeal and Supreme Courts will play an important role in this situation. If PO and LP are able to get a favorable judgement in the High Court, then they stand a good chance of pushing this thing all the way to the Supreme Court. However, if the High Court's judgement is unfavorable, then it makes his task more herculean because the Appeal Court usually side with the ruling of the lower court. It is a tricky one for PO but if he believes he has enough then by all means, after all, it is his right as a Citizen of the country.

PO is experienced with fighting elections through the court, that should count for something.

I think the Tribunal is an Appeal Court already. You are right about how the courts make judgements, especially the SC.

I believe the evidence PO and his lawyers want to show is in the collation of the results and not the credibility. That's why he said he is challenging the process, so that the court will not just be looking at who won but whether the process is viable especially in the future.

Courts have overturned governorship elections and so there should be a precedence in overturning presidential for the sake of our democracy. Just as you said, PO will have to present overwhelming evidence to stand a chance. For me any evidence that does not suggest miscalculation of ballots will not stand a chance.

The electoral act is clear on it. Nobody or No one can mandate INEC to collate and transmit election result one way.

INEC has repeatedly said it that they will be doing manual collation of result for the 2023 election.

He has not yet made his petition to the Tribunal, that will be after his lawyers have gotten the true details of the total election results.

I think he believes he won the election and so if he can prove it given that the results are embedded in the IREV portal, it will now be left for the SC to make a decision.

Here the screenshot of the Electoral Act section 60 that talks about the collation and transmission of result.

INEC had the sole right and determined it in their electoral guideline that I quoted.

In fact it stated that there will be electronic transmission of results on real time basis. Please check again.

INEC cannot put forth a guideline for election and still go against it. In fact there is a court judgement that have ordered INEC to transmit the forth coming elections electronically.

Who disenfranchised the majority that didn't vote? It's the same INEC under the APC government. There's no one else to blame. But that's not even the issue. You are looking at the 15m who didn't vote for PO but ignore that less than 10people in INEC decided this election outcome.

The issue is that there was an election which was supposed to produced a winner under free, fair and credible conditions.

If those conditions were not met, it does not matter who emerges, the results cannot hold.

Even if only two people voted, let the results be credible.

I don't care who eventually wins, but let the the people decide not a few individuals in INEC.

It's not my violence, but no matter what the military does, lives will be lost. What if it leads to a revolution and /or anarchy? We are dealing with humans not animals.

That leads to say, that the decision of the SC may impede future Electoral reforms, and may weaken further our democracy. As anybody can be president if they are able to rig. Just as you have mentioned 2007, future generations will mention 2023.

I had a discussion with one of my oga's recently and he said Supreme court justices after listening to the facts of the case, they also consider other factors like political stability of the country and the general atmosphere when writing their judgement. If this was not the case, the 2007 election that brought Yar Adua to power would've been nullified simply on the facts of that case.

I found the whole thing head scratching , but it is what it is. look at Imo State election case, the justices obviously didn't weigh much on factors like political stability of the state when declaring Hope Uzodinma governor elect and see what has happened. You will be surprised how the supreme court justices will brush aside this Electoral guideline by INEC like it doesn't really matter.

However, I am not one that does things because of what others have done and I believe Peter Obi has a similar mentality. Will the Supreme Court justices also consider what precedence would be set if they violate their own laws and INECs guidelines? How do they answer to the Obidient movement on a case that is justifiable?

They should give sound judgement and declare PO winner. The least they could do is to cancel the elections. Any other decision will set the nation on fire.
