Your position demands more explanation. Did you authorize your brother/uncle to manage the property on your behalf? Did you authorize them to put in the tenants? Did you give them any power/authority in respect of the property? If answer to the above is yes, then you are bound by their actions, whether the money was collected with your knowledge/consent or not. They are deemed to be your agents. So you must give them quit notice to vacate. Except of course you had expressly warned/prohibited the tenants against paying rent to them or anybody without your consent.

Well, you are yet to prove me wrong that most inverter sellers dont tell you from onset that you need to acquire batteries for your inverter, which is more expensive than the usual car batteries.

I'm not talking of the management but the need to let prospective users know the total costs implication of the product so they can prepare their budget accordingly.

I maintain again that inverter technology is good and recommended. But pls ask for the total cost implications, not just for the inverters but for the batteries without which the inverter is useless.

Well you are lucky since you have the necessary documents according to you.

The reality is that in this instance, there is no way you can stop the FG from acquiring and demolishing the property because the purpose of the acquisition falls within the exceptions accepted by law, i.e. for over-riding public purpose.

The only way you may challenge the acquisition is if perhaps the compensation will not be paid immediately as required by law or if the property is assessed below its current market value.

Aside these exceptions, it is an herculean task to try to stop the FG from the acquisition.

@KenGali. I think you have succintly stated the correct position of the law. No govt, Fed/State/Local, can compulsorily acquire the property of the citizen. It is contrary to the 1999 Constitution vide Section 43 (which allows you the fundamental right to aquire property anywhere in Nigeria) and Section 44 which forbids compulsory acquisition of citizens' property. The only exceptions are e.g. when the property is required for over-riding public interest, amongst others. And even at this, there are procedures to be followed in the giving of notices, valuation of the property and payment of compensation first before the property is acquired and demolished.

If what the poster said about the property been demolished for passage of high tension wires is correct, then it comes under the exception recognised by the Constitution as over-riding public interest. The best you can do is to seek compensation, assuming your building is legally permitted in the first instance.

You see, the problem with us in this part of the world is that we like putting the cart before the horse. A man wants to buy a land or property. He does not engage a lawyer to investigate the title and ascertain whether the land is free from all encumbrances. He just buys the land and goes ahead building. Years later, he is informed that the property would have to be demolished because the site was reserved for a canal, market, school, high tension wire, or other public purpose. Without prejudice to the feelings of the poster, it is most likely that the master plan for the right of way of the high tension wires may have existed decades ago, which a search at the Registry may have revealed. But most of us consider that the few thousands of Naira we would pay the lawyer or surveyor to verify title is a waste, relying on claims by omo oniles. Years lon, our building worth millions is threatened and we now run back to the lawyer we ignored initially.

My advise to all: Pls always investigate title to any land before you commit your money into the venture. and endeavour to let a professional (lawyer or surveyor) do this for you. That will save you heartaches in the future.

This is the law:

A yearly tenant is entitled to 6 months' notice to quit.
A half-yearly tenant is entitled to six months' notice.
A monthly tenant is entitled to a month's notice.
A weekly tenant is entitled to a week's notice.

These are the rules. The exception comes in in the tenancy agreement where the parties may stipulate any length of notice between themselves. If you as a yearly tenant sign a tenancy agreement which says your tenancy may be terminated by a month's notice, it becomes binding on you. If as a monthly tenant, your tenancy agreement stipulates that you will be given 6-months' notice, your landlord is bound by it.

A quit notice may be given before or after the expiration of your tenancy. If for instance your tenancy runs from January 2009 to Decemebr 2009, your landlord is entitled to give you a six-month's quit notice sometime in June 2009 to coincide with the termination of your tenancy in December 2009. He is equally entitled to give you the six-month's notice anytime thereafter, so long as the notice does not terminate the tenancy midway. The law as stated by a recent Supeme Court case is that your landlord does not have to give you the notice to coincide with the expiration of your tenancy. He can give you the notice anytime before or after the expiration so long as he complies with the statutory requirement on the length of notice.

That is the law!

The problem with this inverter hype of a thing is that people marketing the invertrers dont tell you the whole truth. To acquire the inverter itself may be cheap but the cost of the battery is another thing. I bought an inverter in 2007 for N15,000. It was after this that I was told I needed minimum of 100amp battery to provide the power. The least battery I got was N25,000.  These are not the ordinary batteries but the sealed type. To really enjoy it, I needed minimum of 2 batteries.

It is really possible to enjoy 24 hour electricity with the inverter but that will depend on the number of batteries, and the load. Because it is the batteries actually doing the job of storing power and dispensing it when the inverter is at work. But to really enjoy power for a long time, you may need up to 5 batteries. Multiply the cost of batteries and you will know what I'm talking about.

The inverter technology is good, no doubt. I have been using mine for over two years now, maintenance free. It was imported anyway. It provides constant light, noiseless and cost efficient. But battery is the problem as you need to constantly charge it when there is light. at a stage too, the battery becomes weak, and you need to get another one. When I first started using mine, the battery could last up to 5 hours when I have just the light and fan on. Now it hardly does 30 minutes. I know I need to get another set of batteries.

The bottomline is tha the inverter is good. But be prepared for the cost of the batteries. Some mentioned that you could us ethe ordinary car batteries for but I've not tried it. But in the long rin, you will discover that it saves you money and energy if you acquire it.
