A Certificate of Occupancy is a title to land given by the Governor of a state for Lands in Urban areas while a Right of Occupancy is given by the Local Government Authority for Lands in non-Urban areas. (See Sections 5 and 6 of the Land Use Act of 1978).

The Right of Occupancy (full name is Customary Right of Occupancy) confers the same rights as a Certificate of Occupancy only that it is issued by the Local Government.

Lagos State, by a Gazette declared all lands in Lagos State to be Urban Lands that's why all lands in Lagos State must possess a Certificate of Occupancy.

Abuja on the other hand does not have a Governor to issue Certificate of Occupancy, Abuja only has a Minister of the FCT. Abuja is also seen as a municipal city. That is why Lands in Abuja have Right of Occupancy has their title.

None is weaker, none is stronger, they are the same - issued by different authorities.
