@ALL esp to jenju! "When a title is assigned, there is a legal requirement that the actual odometer reading is recorded on the title itself. Even if it is not recorded by the exporter, it must have been recorded when a title assignment was made when it was purchased at the auction." Thanks a lot jenju, your right! Fortunately i got a copy of the title from german DMV now. There are two assignments. The first is from the auction. It states that the car was sold by the auctioneer (Manheim) to B, Auto Mall on 7/9/09 at a last odometer reading of 85772 (!!!). In the second assignment is stated, that the car was sold by B, Auto Mall on 9/8/09 to E, C, Co. at a mileage of 85798 (!!!). So i guess, that the odometer fraud happened in Germany! Auctions will record all info on every vehicle that they sell and file the info with the DMV. That is where the CARFAX company in turn gets its information from." That will be true but can you tell me how i can find out, on which auction the car was sold an who was the auctioneer? From Vehicle Information Check on DMV i know, the lien Information "Susquehanna Bank" but they are not able only upon VIN and Title # to tell me who was the owner of the car. I furthermore send an email to Brandon Automall but got no answer. I send an email to Bob Boast Dodge/VW-Dealer Bradenton Fl., who made the pre delivery inspection cause i thought, that the car returned to them for any Service. , They are sorry but cannot help me. So i hope to get out, on which auction the car was sold on 07/06/2009 an who was the auctioneer. Apart from this i think with you, that the german importer is responsible for the odometer fraud. But to verify this, i first have to verify the correct Mileage of the car before it was shiped to Germany. For this i took contact to the german toll. But they told me, that they only check the VIN when the car comes in. After this i hope to get out the auctioneer. Would be nice i you can help me. MAT GermanLaw |
Hy community, i´m a german Lawyer an need your help upon a case of odometer fraud belonging the car named in Subject. My clients bought this car here in Germany in Oktober 2009 with a warranted Mileage of apx. 39,000 mls. After some Engine-Problems appeared they ordered a Carfax History Report which stated, that the car was sold at an auction in Florida on 07/06/2009 at a mileage of 45,772 and offered for sale online on 07/14/2009 at a mileage of 45,999 mls. The seller sais, that the information of the Carfax History Report only belongs on hearsay. And, after contacting Carfax they confirmed that. Better, Carfax was not able to declare, who sent the mileage information to their information pool. "It is true that CARFAX depends upon our data sources for the accuracy and reliability of the data that appears on our reports. , We receive all data electronically from our data sources. , CARFAX receives vehicle history records from over 34,000 data souces and sometimes specific records received are inaccurate , ." CARFAX was not able to tell me, from whom they got their information about the Mileage on 07/06/2009 and 07/14/2009. On my VIN search in the internet i could see, that the car was offered by Brandon Automall (813) 657-4048 at a mileage of 45,999. I filled out the Contact-Form and asked for help but got no answer. So as the CARFAX History Report will not be valid at a german Lawcourt, i´ll have to identify the pre owners of the car to adduce evidence, that the mileage of the car was 45,999 mls. ore near by this before it was shiped to Germany. By the way, the only mileage registered at the Florida Department of Motor Vehicles (DMV) was 15 mls. at 12/31/2007. From Lien information of the DMV i know the Susquehanna Bank DV. But they cannot help me only on VIN- and Title-No. They need the Name of the originally Owner. So I hope you can help me! MAT GermanLaw |
