Nigerian Army on Wednesday constituted a court-martial for offenders in the counter-insurgency warfare in the North-East area of the country. Twenty soldiers (four officers and 16 other ranks) were bought before the newly inaugurated court for various offences including murder and sales of fire arms in the ongoing war against insurgency in the North-East. Inaugurating the General Court-Martial with Brig. Gen. Olusegun Adeniyi as its president in Maiduguri, the acting General Officer Commanding, 7 Division of the Nigerian Army, Brig. Gen. Victor Ezugwu, said it was established to try offences committed by personnel within the Operation Lafiya Dole theatre of operation. He said, “The court-martial is to achieve timely and quick dispensation of justice within the framework provided in relevant statute books. “Therefore, it is important that both the prosecution and the accused persons or their counsel are mindful of this fact and strive to shun all forms of antics such as request for frivolous adjournments which could lead to delays in the trial processes. It is often said in the legal parlance that, justice delayed is justice denied.” He asked the president and members of the GCM to dispense the assignment in accordance with the appropriate extant laws and ensure that their opinions and decision on all the cases brought before them were not in any way beclouded by bias, external pressure or extraneous factors. Speaking to journalists after the inauguration, Ezugwu disclosed that some of the accused were involved in criminal activities which included murder, crimes against civilians, and illegal sales of firearms. The GOC said over 100 soldiers had been tried and punished at the Brigade level over acts of indiscipline and unprofessionalism. He disclosed that there was little or non-issue with indiscipline in the theatre as 15,000 soldiers had been awarded medals of excellence in the theatre of operation for patriotism and gallantry. Speaking during the inaugural sitting, the president of the court, Brig. Gen. Adeniyi, said there was no need for the accused to entertain any fear as they would be given fair hearing. The All Progressives Congress Youth Forum (APYF), on Monday (August 8th, 2016) night accused the Economic and Financial Crimes Commission (EFCC) of abusing its powers under the law by sending its operatives to pick up one of the Forum’s founding members, Mr. Abubakar “Abusidiq” Sidiq Usman, on charges of cyber stalking. A statement released by the EFCC earlier on Monday claimed that Abusidiq was arrested and questioned on offences that allegedly contravene the Cyber Crime Act. In a statement signed by Olu Onemola, the National Public Relations Officer of the Forum, the APYF condemned the filing of spurious charges against Abusidiq, stating that if the EFCC’s actions was left unchecked, it could dent the institutional credibility of the financial watchdog and the perception of the adherence to the rule of law of the entire President Muhammadu Buhari-led federal government. The APYF further stated that it would be utilizing all the protections and legal recourses that are available to citizens in the Constitution of the Federal Republic of Nigeria. A statement released by the Commission claims that Abusidiq was arrested and questioned on offences that allegedly contravene the Cyber Crime Act. The APYF wishes to condemn in the strongest possible terms the arrest and filing of spurious charges against Abusidiq, by an agency that has obviously overstepped its jurisdiction and crossed beyond the purview of its responsibilities which are to combat financial and economic crimes. From the EFCC establishment act, “The Commission is empowered to prevent, investigate, prosecute and penalise economic and financial crimes and is charged with the responsibility of enforcing the provisions of other laws and regulations relating to economic and financial crimes.” From the aforementioned, the APYF wishes to state in the clearest possible terms that the EFCC lacks the powers to put forward such charges against Abusidiq on the grounds of cyberstalking as it is not within their mandate to do so. As an organisation that believes firmly in the rule of law, moving forward the APYF will be utilising all the protections and legal recourses that are available to citizens in the Constitution of the Federal Republic of Nigeria. 1. We will be petitioning the Attorney General of the Federation to call the EFCC and its Chairman to order - as these allegations if left unchecked can dent the institutional credibility of the Commission in particular, and the perception of the adherence to the rule of law of the entire government. 2. Generator fumes on Saturday killed a man identified by his neighbours as a policeman, and his lover, suspected to be a member of the Nigeria Security and Civil Defence Corps (NSCDC) in Anambra State,Punchreports. They were found dead on Sunday in an apartment at Ezinifite Okpuno, Awka-South Local Government Area of Anambra State. According to the report, the identity of the policeman could not be ascertained, but the woman, a mother of the five was known as Ifeoma. The woman reportedly told her husband that she was going for a vigil, but went to her police lover’s house instead. The policeman, it was reported, had three children who live in Lagos with their mother. Some neighbours attributed the cause of their death to generator fumes. One of the neighbours said that “there was the sound of a small generator throughout the night in his apartment. But at about 4AM, it went dead; maybe the fuel got finished”. “The policeman lived on the third floor of the house. As a policeman, he hardly stayed around, but each time he was around, everybody would know, because he would run his generator all through the night. Everybody called him ‘Officer’, but I think he was an inspector,” the source added. The labourer then rushed out and alerted neighbours. However, according to the state Police Public Relations Officer, ASP Nkeiru Nwode said that the deceased man was not a police officer and the identity of the woman is not yet known. “With all due respect, the man in question is not a member of the Nigeria Police Force and the woman’s identity is yet to be ascertained. I have not yet been fully briefed on the story. As soon as I get the details, I will communicate with you, please,” she said.
