Hello VO,

I had my IR1 interview on Jan 16. I was deemed inadmissible and requested the option to file I-601 waiver. However, I asked the Consular Officer for a "Refusal Notice" which is essential to file the waiver at the Phoenix Lockbox, but he insisted he does not have to give me any document in that regard.

According to the USCIS website, it states -

"If you are outside the United States and a Department of State consular officer has already interviewed you at a U.S. Embassy or Consulate and determined that you are ineligible for an immigrant visa based on a ground of inadmissibility, the consulate will give you a refusal notice. The refusal notice indicates the ground of visa ineligibility and whether you may be eligible to apply for a waiver. If the notice indicates you are eligible to apply for a waiver, you may apply for a waiver by filing Form I-601 with the Lockbox".

In light of the above, can I get a Refusal Notice? My NVC # AMS2007812003.

Thanks for your help from our last correspondence. (My NVC case # is AMS2007812003). I now have an appointment for Jan 16.

Though our I-130 was re-approved (I-824) in 2014, it was approved initially in 2007/2008. It's been a while, and I don't remember my invoice number.

I have to fill out a DS 260 form before the interview, and it requires an invoice number. Can you please check it for me?

An email has been sent by my attorney requesting a rescheduled date for an interview. The email was sent to LagosIVscheduling@state.gov on Friday, December 19, 2014 as requested.

Good morning VO,

I had previously filed for an Immigrant Visa in 2008 through the Amsterdam Embassy. The visa was denied. However, because of the length of time outside of the U.S., I re-applied and would like to consular process through Lagos. An I-824 was filed and approved in March 2014 regarding my wife's' previously approved I-130.

Since May 27, 2014, we has made five written inquiries of the consulate in Lagos as to when an interview would be scheduled.

The standard response is "Thank you for your email. We have forwarded your inquiry to the appropriate unit. We urge you to wait patiently for a substantive response. "

We wrote to the Amsterdam embassy to make sure they were aware of the transfer request. Amsterdam responded promptly in August to advise that on July 9, they transferred the I-130 to the Lagos consulate. Our last inquiry to Lagos on October 31, 2014 produced the same responses as before.



At this juncture, we are requesting assistance in getting the status for the Immigrant Visa interview. We are aware that a waiver will be required.
