Local Government Autonomy: AGF Fagbemi's Action Is To Strengthen Democracy - APC Group Replies Sanwo-Olu The attention of the APC League of Professionals has been drawn to the statement attributed to the governor of Lagos State, Mr. Babajide Sanwo-Olu over the decision by the Attorney General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN) to institute a suit against the 36 states of the federation on behalf of the Federal Government of Nigeria at the Supreme Court over alleged interference with the local government autonomy in their domains. In a statement released to newsman in Lagos on Wednesday by the National Publicity Secretary of the group, Mr. Anifowoshe Daramola, the group said the intention of the Federal Government was not to praise or expose states that encourage or discourage local government autonomy in their domains as suggested by Gov. Sanwo-Olu through his remarks, but to strengthen democratic institutions at the third tiers of government with the expected outcome of the 'case law' that would emanate from the Supreme Court in order to further reinforce what the Constitution has said about the status of local government autonomy in Nigeria. For example, Section 7(1) of the 1999 as amended says: "The system of local government councils is under this Constitution guaranteed; and accordingly, the Government of every state shall subject to section 8 of this Constitution, ensure their existence under a law which provides for the establishment, structure, composition, finance and functions of such councils." Recall that before the lawsuit, there were several reports on how states disrupt the tenure of elected council chairmen without recourse to the extant laws establishing them. Furthermore, there were reports that some states allegedly tamper with local government allocations in their domains coupled with the composition of caretaker committee members who run the affairs of the councils instead of conducting periodic local government elections as required by the law. According to the investigative report by the Vanguard Newspaper of Saturday, May 18, 2024, Volume 21: No. 94674, the paper reported that 19 states out of the 36 states of the federation run 433 local government councils with caretaker committee members instead of conducting local government elections. In the same vein, the Senate on May 15, 2024 urged the Federal Government to stop further allocation of funds to caretaker-led local government councils across the federation. Therefore, it is part of the Renewed Hope Agenda of the Tinubu's administration that the Federal Government of Nigeria through the Office of the Attorney General of the Federation and Minister of Justice decided to permanently put an end to the insinuation that state governors unduly interferes with local government autonomy among others. What the Federal Government is asking for in this case is very simple; "'An order prohibiting state governors from unilateral, arbitrary and unlawful dissolution of democratically elected local government leaders for local governments.” ''An order of injunction restraining the governors, their agents and privies from receiving, spending or tampering with funds released from the Federation Account for the benefits of local governments when no democratically elected local government system is put in place in their states.” “An order stopping governors from constituting caretaker committees to run the affairs of local governments as against the Constitutionally recognised and guaranteed democratic system.” It was on these premises that the Federal Government acted and not on the premise of hailing or condemning any state whatsoever. “The Constitution of Nigeria recognises federal, states and local governments as three tiers of government and the three recognised tiers of government draw funds for their operation and functioning from the Federation Account created by the Constitution." "In the face of the clear provisions of the Constitution, the governors have failed and refused to put in place a democratically elected local government system even where no state of emergency has been declared to warrant the suspension of democratic institutions in the state. “The failure of the governors to put democratically elected local government system in place is a deliberate subversion of the 1999 Constitution which they and the President have sworn to uphold. “All efforts to make the governors comply with the dictates of the 1999 Constitution in terms of putting in place a democratically elected local government system has not yielded any result and to continue to disburse funds from the Federation Account to governors for non-existing democratically elected local government is to undermine the sanctity of the 1999 Constitution. Finally, the move was not intended to disparage any governor or state as the case may be, but an action taken in good faith to further strengthen our democratic institutions at the local government level. NULGE PRESIDENT HAILS EKITI STATE, TWO OTHERS ON LOCAL GOVERNMENT AUTONOMY The President of National Union of Local Government Employees (NULGE), Comrade Ambali Olatunji has commended Ekiti State Government for adhering to the constitutional provision of local government autonomy in the state. Speaking on Channels Television’s programme, The Morning Brief on Tuesday, Comrade Olatunji, who criticised state governments for flouting the local government autonomy law, however cited Ekiti State as one of the three states that have followed the due process for local government autonomy. He identified Rivers and Jigawa as two other states that have also complied with the constitutional provision. The NULGE President who flayed what he described as flagrant disregard for the local government autonomy, by state government, alleged that many states have continued to deny the third tier of government democratic governance through the use of Caretaker committees or sole administrator as against elected officials, adding that many of them have also not complied with the financial independence aspect of the autonomy, through unwholesome practices that slow down growth and development at the third tier government. When asked by the moderator to mention names of the states that are disregarding the local government autonomy law and who are in the habit of crediting and withdrawing money from the local government account, Comrade Olatunji said only the three states- Ekiti, Jigawa and Riverrs have complied with the law. “Only three states are complying “mutantis mutandis with the provisions of the constitution -Ekiti, Jigawa and Rivers. These are the states that stand above board in the issue of local government autonomy.”, he added. Speaking further, the NULGE President said. |

Senator Jimoh Ibrahim Withdraws Ondo APC Primary Case, Thanks Tinubu; Ajulo Praises Legal Team Senator Jimoh Ibrahim, representing Ondo South Senatorial District, has officially withdrawn his lawsuit challenging the recent All Progressives Congress (APC) primary in Ondo State. The senator attributed his decision to the intervention of President Bola Ahmed Tinubu, whose assurance of commitment to internal party democracy prompted this development. In a letter addressed to the press, Senator Ibrahim detailed the reasons behind his withdrawal. He noted that President Tinubu personally intervened by meeting with him and assuring improvements in the party's democratic processes. "The suit is now withdrawn due to the intervention of President Bola Ahmed Tinubu GCFR. The President called me, had a meeting with me, and assured me that he will, as the leader of the party, improve on the internal democracy within our party," Ibrahim stated. Further emphasizing his respect and trust in the President, Ibrahim added, "I cannot disobey the President of the Federal Republic of Nigeria because the issue I am fighting for is not personal. It is simply to improve internal democracy to which the President has promised improvements. My respect for the President is absolute." The newly appointed Senior Special Assistant to Kogi State Governor, Usman Ododo on Drug Rehabilitation, Comrade Richard Otitoleke has congratulated his principal on his victory at the Election Petition Tribunal, saying it is a re-affirmation of the will of people of the state. [/b] He said the decision of the court represents the overwhelming mandate the people of Kogi freely handed to Ododo to pilot the affairs of the state during the Nov. 11 governorship election. Recall that a three-member tribunal led by Justice Ado Birnin-Kudu held that the Social Democratic Party (SDP) and its governorship candidate, Murtala Ajaka failed to prove their allegations against Ododo, and therefore upheld his election. In a congratulatory message on Tuesday, Comrade Otitoleke while commending the courage of Ajaka to approach the court in order to enrich the country's electoral jurisprudence urged him to place the welfare and development of Kogi first, insisting that the endless litigation will serve no interest. While expressing hope that Gov. Ododo will justify the confidence the people reposed on him by choosing him as their leader at this time, Comrade Otitoleke called on Ajaka to support the governor in building a Kogi for which generations to come will be proud of. This is contained in a statement from the college signed by Prof. E. O. C. Obidimma, Associate Provost (Humanities), for the College of Postgraduate Studies after an emergency meeting over some unfriendly and sponsored publications in the social media aimed at tarnishing the image of the College. The College management and staff in the statement said the Provost, Prof Igbokwe remained distinguished in character, stickler of excellence, outstanding in leadership and could not be diminished by malicious attacks by faceless people online. The College insists that there is no rot in any form in the Nnamdi Azikiwe University Awka Postgraduate College ,neither was there any staff of the college officially engaged in extortion in any form as the Ethics and Disciplinary committee of the university is at work 24 hours a day. The College described the Provost, Prof Igbokwe and team as proactive and urged the reading public to disregard such reports online emanating from sadists, sore loosers and those who do not wish the College well and envious of the university's feats in the Postgraduate College. The crop of staff in the College are exceptional, diligent and dedicated to the goal, vision and mission of the University rooted in Discipline, Self-Reliance and Excellence. The College is open to any form of investigation as regards the said accusations, as the integrity of our great University and the College in particular, has always been and would continue to be in high esteem. The College informs further that Prof. Philomena Igbokwe, the Provost of the College is not just the Provost of Unizik College, but also the immediate past Chairman of the Committee of Provosts and Deans of Postgraduate Colleges and Schools of Nigerian Universities. Prof Igbokwe is one of the most respected professors of Nnamdi Azikiwe University,Awka and one of the frontline female professors of Chemical Engineering in Nigeria (the first female professor of Chemical Engineering in Nigeria). Those who know her know that she is a very disciplined person and an administrator to the core, hence since her assumption of the seat as the Provost of the College, she has always ensured timely graduation of students and would always do everything humanly possible to maintain discipline and sanity in the College. The College, not leaving anything to Chances, has set up a high powered committee of people with proven integrity to investigate the allegations dispassionately for the College to know the truth of the allegations and take all necessary disciplinary actions fit in such circumstances. Part of the statement read thus: The College hereby denies the contents of the said online publication in its entirety as it contains no iota of truth in any ramifications. The publication under reference is malicious and only intended to malign and harm the reputation of the College of Postgraduate Studies and to bring the individuals mentioned therein into public opprobrium and ridicule. Of a truth, there is no “extortion and fraudulent crimes” being perpetrated in the College against the students and no student is made to pay the sum of N8,400.00 (Eight thousand four hundred Naira) or any amount whatsoever for the purpose of having their results sent to the College Board for approval or for any purpose whatsoever. "There is also no threat to any student of not seeing his/her results on account of non-payment of the alleged amount demanded. These allegations are fallacious and are as baseless as they are unfounded. The College does not generate results. Results are computed/generated by departments where students have the opportunity of seeing their results if they wish to. This is not shrouded in secrecy. The College only collates results for presentation to the College Board for approval. "On the issue of Postgraduate students spending many years in running Postgraduate Programmes, the College states that this issue cannot be located at the doorstep of the College except for the purpose of calling a dog a bad name in order to hang it as is being done by the writer of the article in question. This is so because Postgraduate Programmes are run by departments which control the management of the Programmes. The College only supervises and intervenes on occasions (as it has done) where it's attention has been drawn in matters of conflicts between students and supervisors/lecturers with the potential of prolonging the students’ programme. The College does not play any part in delaying students’ programmes. The College reiterates that no form of extortion or fraudulent crime is being perpetrated in the College against the students whose interests the College serves and protects at all times. Let it be known also that Mrs. Njideka Nwangwu is not engaged in any high-level financial extortion as alleged at all, and that the Provost of the College, Prof. Philomena Igbokwe has no knowledge of any such alleged high-level financial extortion let alone being involved in such dastard and inhuman act. If the writer had employed due diligence and professionalism in his pursuit as he ought to, he would have verified the facts and arrived at a balanced view and the truth. 'The College is not unmindful of the defamatory nature of the publication under reference and the potential damage it could cause as it is understood that the sole purpose of the said publication is to tarnish the image of the College and that of the individuals whose names and photographs were published therein. The College is taking steps to remedy this wrong, and the individuals mentioned in the publication are also taking steps to initiate the appropriate legal actions to remedy the incalculable damage and the emotional distress caused by this unwarranted publication.
