For our purposes, the police certificates are valid for one year from the date of issuance. So it sounds like your friend won't need a new one. smiley

Good Morning VisaOfficer,

This is just a quick question regarding Police Certificates. I am inquiring for someone who has an interview scheduled in February - immigrant based visa (IR2 I believe). The police certificate was obtained in November of last year and the certificate states it will expire 3 months after being issued, which would be prior to the person's interview date. However, the letter received from the NVC states that the police certificate must have been issued less than 1 year ago. Will the embassy accept the beneficiaries police certificate since it was issued less than a year ago, or will she need to obtain a new one prior to the interview? Thank you for clarifying this for us smiley .

Hi JASM,

When a Consular officer is not convinced that a K1, IR1, or CR1 relationship is bona fide, the petition is returned to USCIS with a memo explaining the officer's findings. The cases remain in "administrative processing" status because they are still open pending action by USCIS. In IR1 and CR1 cases, USCIS will contact the petitioner and ask for more information. Unfortunately, because K1 petitions are only valid for four months, USCIS usually does not contact K1 petitioners. Instead, the petitioners can file a new petition if they so desire. You can reach out to USCIS directly if you feel you can present a compelling argument as to why they should reaffirm the K petition, but if it has already expired, they usually will not do so. I hope this information helps.

Welcome back and thank you very much for your response. I have been reading about cases that get transferred from the consulate back to USCIS and it says that they can take anywhere from 2-3 months before they reach USCIS. Our K1 petition is set to expire January 10 which is less than 2 months away so I will reach out to USCIS and hopefully they will allow me to submit the additional proof. Since the interview my fiancé and I have been speaking about the possibility of me traveling to Nigeria next year to do the wedding since we're not sure anymore that having the wedding in the US will be a possibility, that's if the K1 is revoked. As much as I would love to travel back to Nigeria to be with him and his family and don't mind having the wedding there, so much time, money, tears, etc. have been spent on the K1 process to just let it go.. especially when we felt that the validity of our relationship would be apparent during his interview cry. I am new to nairaland and have been monitoring this thread for a couple of weeks now before joining. I never thought I would have to post on here asking for assistance, but at this point I don't know what to do.

I'm writing this post with a very heavy heart and much sadness. My fiancé had his K1 interview at Lagos this morning 11/14 and we didn't expect things to turn out the way that they did. We felt that our case was strong and I sent along many forms of proof to ensure that it showed (phone records, pictures, a couple emails, copy of boarding tickets, hangout call log, etc.). However the officer that interviewed him didn't feel that we had enough proof. He made mention of us not having enough phone records and pictures, but I supplied at least 4 months worth of call records (from Oct 2013 - before we applied for the K1 visa through about September/October of this year with all calls to both parties highlighted) and both call logs from my cell phone provider as well as from Boss Revolution (Boss Revolution showed additional months worth of calls). I'm also camera shy and have never liked taking pictures, but I sent what I had. I have scenic pictures from my time in Nigeria but I didn't feel like those would matter. I would have definitely sent more call logs across each month had I know that wouldn't be enough because we talk just about every day and the phone is our main communication.

Also, when my fiancé was younger he went to the embassy with his mom and younger siblings for a scheduled interview. Only his mom was interviewed, the kids were not, but the case was denied. And so when he was asked on the DS-260 whether he had been denied a visa before he said no because he personally never applied for one nor had been interviewed for one. We definitely misunderstood that question and had we known that it was considered a visa denial for him we would have definitely answered yes. He was young at the time of that case and didn't understand all that was going on.

I'm not sure what the status of our case is at this point. From what I understand he wasn't told it was denied, but I don't think it was approved either. When I check the website it says "Administrative Processing" which I know is the status of the case after the interview. If possible, would you mind checking on our case when you have a moment to let me know the decision reached by the consulate? LGS2014774001.

I'm hoping for guidance in either way the decision has gone. We are willing to take whatever the next steps are, but at this point I don't know who I should be contacting. I apologize for the lengthy entry and I look forward to your reply.
