Properties / Lagos State Has New Law Against Omonile(2 Years Imprisonment) by Jasmine360(f): 11:44pm On Jul 13, 2017
Want to buy a land in Lagos Nigeria? Then read this…

Everyday thousands of Nigerians at home and abroad hope to buy lands in Nigeria more especially in popular cities such as Lagos, Abuja, Port Harcourt, Abeokuta, Ibadan etc but a common reoccurring theme that filters through their minds is how to safeguard their money so that they won’t be duped by Land Fraudsters or lose their Lands to the Government coupled with the terrifying stories that normally accompany the smooth transfer of these lands because of the prevalent nature of Land Scam artists and dubious Real Estate companies that specialize in defrauding prospective land purchasers.

Buying lands in Lagos or anywhere else is usually complicated. In case you are lucky enough to have bought your land genuinely, you should be ready to contend with omoniles demanding for various illegal fees, ranging from agreement, job card, fencing, security, Germany floor, decking, roofing and all kind of frivolous fees.
During construction, you will see hoodlums coming around to task developers and their workers like bricklayers, iron benders, carpenters for illegal fees. They charge developers for sand, granite, cement or any materials delivered to site and beat up workers when they are not paid and stop them from working. This trend has discouraged many potential land buyers, investors and developers.

This new law known as “Lagos State Properties Protection Law “in section 11 has prohibited any person from demanding those fees.

Demand for fee

“A person shall not, whether for himself or acting as an agent demand for any fee or levy in respect of construction activities on any property, disrupt or obstruct construction works provided that the provision of this section shall not be interpreted to preclude land owning families under the authorization of the family head to demand for customary fee for possession from buyers or ratification fee pursuant to judgment of a court of competent jurisdiction”.

(2) Any person who contravenes the provision of subsection (1) above commits an offence and shall on conviction be liable to a fine not exceeding one million naira (N1,000,000) or two (2) years imprisonment or both.

The method we have devised since this law came out is always take a copy of the law with you. Any time they come around to demand for this illegal fee, just bring it out and read out section 11 to them that they risk 2 years imprisonment for demanding for construction fee. This trick has worked wonders. They will be begging you not to take any further action but begging you to forgive them and give them anything you want. That is how it should be and not the other way round.

Everyone lives in a house and And everyone wants to own a house for themselves or for their children someday or even now as you are reading this post.

The truth is that there are laid out rules or secrets on how to buy or own a house in Nigeria and at the end of this post you must have grasped the knowledge on how to buy a house or Land in Nigeria without falling into the waiting hands of fraudsters or Omoniles.
There are a great number of things to look out for and keep in mind when buying a new home or land property especially in a place like Lagos or anywhere else in Nigeria. The following principles are crucial and will serve as guideline while you make that investment in property in Nigeria.

1. Know What You Want
Before you decide on going to buy a property, land or house in Nigeria; we often advise our potential clients to know what they want and what their budget can afford- over stretching yourself beyond limits and acquiring unnecessary long term debts is something that should be a last option.
More so, know the type of property in Nigeria that suites your need- for instance if you have a family of four as a civil servant you don’t have any business going for a 6 bedroom mansion which you know is far beyond your budget. Some houses might be packaged to look like what you want but our core interest here is to ensure our client gets a well built and finished structure with good title document. 2. Understand the Nature of the Property

And this often translates to the best return on their investment. 4. Research Who is Selling
This is one of the most relevant secrets to buying a property, but a few people pay attention to it. Always keep the following questions in mind:

1. "Who is the owner of the property?"
2."Who is selling the property?
3. Is it the owner, the owner's wife, son, daughter, or someone else?"
4. "Who's name appears is in the documents?
5. Is it the current owner or the previous owner?"
6."What liabilities currently exist on the property?"

5. Verify the True Owner
Before you buy a plot of land or a completed building, be sure to conduct what is called a "search" on the property. This is the process of verifying from the state government if the property in question is within government acquired properties or not and whether there are any pending litigation or other issues on the property. The bureau of lands of Lagos state is responsible for all land related matters in Lagos state. It also has office in Government secretariat Alausa Ikeja Lagos Nigeria.

6. Make Payment and Collate the Right Documentation
Pay the property amount to the property owner, then collect the (a) purchase receipt (b) the contract of sales (c) the building plan where applicable (d) originals of other relevant documents in possession of the previous owner. NB: Make sure you raise your bank draft and cheque in favour of the name on the title document.

7. File the Documentation for Your New Purchase With the State Government
It's important to do this step because it legally makes you the new owner in the eyes of the law. If the property already has a C of O (certificate of Occupancy), you’ve got Governor's consent for it which is great. If it does not, then you start processing your C of O as soon as possible.
