CORRUPTION: A TALE OF CHINA, IRAN AND NIGERIA If you are spending 100 Naira everyday, it will take you 27 years before you can exhaust 1 million Naira. As a reminder: Late Zheng Xiyaou was the Director of the China Food and Drug Administration from 2003 to 2005. In May 2007, Zheng was convicted of taking bribes. His corrupt practices, amount to $850,000 (270 million Naira) was believed to have led to the death of 40 persons. He was sentenced to death by a Trial court in Beijing. The trial took less than 2 years and he was executed on the 10th July 2007! In Iran, Babaji Zanjani, a 40-year old billionaire and businessman was also sentenced to death by hanging for corruption in the excess of $2 billion. He shortchanged his country's in oil deals at a difficult time. But in Nigeria, the poor Nigerian youths who are the victims are busy celebrating and protecting their thieves with their lives. ELRUFAI’S ADMISSION OF NSA PHONE The admission by former Kaduna State Governor, Nasir El-Rufai, on national television that he was aware of, and allegedly participated in, the tapping of the telephone line of the National Security Adviser, Mallam Nuhu Ribadu, represents one of the most serious allegations of constitutional breach and abuse of power in Nigeria’s contemporary political history. This is not a matter that can be dismissed as mere political rhetoric or partisan disagreement. It is a constitutional issue, a criminal law issue, and a national security issue of the highest order. Section 37 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) provides in clear and mandatory terms that the privacy of citizens, their homes, correspondence, telephone conversations, and telegraphic communications is guaranteed and protected. This provision imposes a legal obligation on all persons and authorities within the Federal Republic of Nigeria. No individual, regardless of political status, past office, or influence, possesses the legal authority to intercept the private telephone communication of another person without lawful authorization backed by a court order. Any such act, if carried out without due legal process, constitutes a direct violation of the Constitution itself. The Cybercrimes (Prohibition, Prevention, etc.) Act, 2015 further strengthens this constitutional safeguard. Section 13 of the Act criminalizes the intentional and unlawful interception of electronic communications. Upon conviction, offenders are liable to imprisonment for a term of up to seven years, a fine, or both. In addition, the Nigerian Communications Act and its Lawful Interception of Communications Regulations make it mandatory that any interception must be authorized by judicial warrant. Any interception carried out outside this legal framework is unlawful and punishable. The gravity of this matter becomes even more alarming when considered in light of the office allegedly targeted. The National Security Adviser is not an ordinary political office holder. He is the principal coordinator of Nigeria’s intelligence and national security architecture. His communications often contain classified information relating to counter-terrorism, defence strategy, intelligence operations, and national stability. Unauthorized interception of such communication is not merely an invasion of personal privacy; it is an act capable of undermining national security, compromising intelligence confidentiality, and weakening institutional trust within the security framework of the state. History across democratic societies demonstrates clearly that illegal phone tapping carries severe consequences. In the United States, the illegal bugging of political opponents during the administration of Richard Nixon led to the Watergate scandal, criminal prosecutions of senior officials, and ultimately Nixon’s resignation in 1974. In the United Kingdom, journalists from the News of the World were convicted and imprisoned for unlawfully intercepting private voicemail communications. The scandal led to the permanent closure of the newspaper and marked one of the most significant media prosecutions in modern British history. These global precedents demonstrate that illegal interception of communication is treated as a serious criminal offence, not a political triviality. Under Nigerian law, the public admission of involvement in an illegal act carries significant evidentiary weight. Sections 28 and 29 of the Evidence Act, 2011 recognize voluntary confessions as admissible evidence. Where an individual voluntarily admits on national television that an act he knew to be illegal was committed, such admission constitutes strong prima facie evidence capable of triggering criminal investigation and prosecution. The law does not require such confession to be made in custody alone. A voluntary public admission is sufficient to ground investigative and prosecutorial action. The implications of this matter go beyond the individual concerned. It raises fundamental questions about abuse of power, misuse of state machinery, and respect for constitutional governance. If unlawful interception of communication at the highest level of national security is tolerated without consequence, it would set a dangerous precedent and erode public confidence in democratic institutions. Nigeria stands at a defining moment. The Constitution must remain supreme. The law must apply equally to all persons. Where there is credible admission of illegal conduct, there must be investigation. Where evidence supports it, there must be prosecution. And where guilt is established, there must be accountability.
