There is a world of difference between jurisdiction and technicality.

The case of Nwajiuba v. Tinubu & Atiku was struck out on jurisdiction. The case of PDP v Shettima met same fate.

Jurisdiction can be raised for the first time even when it is before the Supreme Court. It has happened before (see Ohakim v Rochas Okorocha)

Technicality in law are minute details that seem unfair but forces the Court to make tough calls. An example is Jegede v Akeredolu.

However, jurisdiction is the foundation, the bedrock of which any case rests on.

Mr. Man, there is a difference if it comes to jurisdiction. A case that happened in Kwara cannot be taken to Osun. You see how close the states are but because of jurisdictional principle, as to prevent abuse of court processes. In the past you see politicians leave their state and go to procure order from another state and you just see different orders emanating from different courts on a single case. A case is done where the cause of action happened. Learn that one today.

The Presidential Election Petitions Tribunal (PEPT) sitting at the Court of Appeal in Abuja on Friday, May 19,  continued hearing on petitions filed by the Peoples Democratic Party and its presidential candidate Atiku Abubakar; the Labour Party and its presidential candidate Peter Obi challenging the outcome of the presidential election.

The court heard the application by LP and Obi for live broadcast of the proceedings.

At the resumed pre-hearing on Friday, the tribunal reserved ruling in the application filed PDP and Atiku Abubakar for a live broadcast of the tribunal’s proceedings of its petition.


Justice Haruna Tsammani, the presiding judge of the Tribunal reserved ruling, at a later date to be decided by the court, after lawyers of the respective respondents and petitioners made their arguments and submissions on the application.

Meanwhile, The acting National Chairman, Labour Party, Lamidi Apapa, has kept his word on returning to the Presidential Election Petition Tribunal, following his attempt on Wednesday.

Apapa was spotted seated at the back of the courtroom as opposed to the area reserved for Labour Party representatives.

This comes after his brief appearance at the tribunal two days ago, where he attempted to occupy one of the seats reserved for LP leaders.
He was however resisted by some party members, resulting in a shouting match.

Federal High Court in Kano cannot hear a case brought before it from Abia because of territorial ground (jurisdiction). The aim is to prevent abuse of court, which this depict.
