The more complicated the logistics of any application is, the more UKBA would be deemed to frustrate your application process, by ways or way of putting bureaucratic hurdles.
Best to submit a simplified application, inline with documents process.
Thanks....so what do U suggest can make it simpler. will d new rent do?.

NB :a letter from Ex is a NO NO.

If he is living in the house with his kids then he must have other utility bills in his name?

This is really complicated issue, i feel sorry for your hubby, the UK law regarding married couples is just one sided and unfair.

Exactly why the thought of getting married scares a living daylight out of me.
Yes, he has all the utility bills,gas,electricity,everything in his name,except d motgage.
Now that we realise the risk it might be to my application and after.
He is bringing an option of getting a rent, d landlord has agreed to take some deposit till when d visa will be granted before moving in as no one knows when d visa will actually be granted...and d landlord does not mind writing a letter of agreement to this effect.

My question is,can he use this present mortgage adress as a correspondence, as that is d only place where we can present bills in his names from last 6mnth/yrs & getting to put d new rent details and d letter of agreement from d land lord.as wellhuh?.

A thought just came to my mind. Assuming you eventually get over this tenancy document and submit your application and the visa is granted. You arrive in the United Kingdom, how long would you live in the present house with your hubby?
Would you be happy contributing towards a mortgage,while having no equity in the property? (and yes in the uk, the wife contributes one way or the other) If your hubby decides that you both go and buy your own property, I can just see his ex-wife walk in or stroll in and claim her house (he has no share in equity of the property).
You see how this case can quickly transform into something else !!!!!!!!!!!!!!!!!!
The reason why I am here to seek an advise on rent or otherwise.....

Getting a new rent somewhere else would involve all new documentations for the new rent, to support your application.
'right under a trust'? It's either his name is on the mortgage deed or not, that is a legally binding, regarding tenancy or ownership.
I would advise, he goes to a conveyancing solicitor, presents his case and sees what options are available to him.

Do you mean my hubby?
No. He is not sharing the house with his ex, they have been apart & divorsed several yrs back.
Only my hubby and the 2kids they had together stay/live in the house since several yrs till now.

Assuming you are applying for a settlement visa, not having your sponsors name on a residential property (mortgaged or renting), is a bad idea.
How can he prove that he has an accommodation to house you (documentary - wise)?
Removing his name from the mortgage deed, due to adverse credit, is an explanation I do not understand(not unless he faced impending bankruptcy and removed his name from the mortgage, before the bankruptcy application was filed).
He is also paying a mortgage that is not in his name. What would stop his ex-wife, claiming the property in the future?
I think you need to consider your present document arrangements carefully !!!!!
NB: My recommendation : Get the person that the mortgage is in her name to write him a tenancy agreement (do not fake it)(hopefully, they are in talking terms and have a cordial relationship).

Pls my hubby can not get his ex to write a tenancy agreement.
What else can I do pertaining this accommodation thing,can he get a new rent somewhere else for this accomodation thing(pls does it make sense)as we r planning to put in d app. For next month..pls this is eating me up.

@ girlfio,if only d mortgage won't cause an hassle ni...*it is a 3bed,2receptions,just my hubby and 2kids, He has been paying on d mortgage rent for 14yrs instead.i have spent holidays and stayed few months severally,its suitable to accommodate me......

However, even though he is not legal owner of the house, does he not have rights under a trust because he is contributing to the purchase price by paying the mortgage b4& after divorce d ex have not been paying but him for so long years. meaning that some of the house is his,cant he assert this right by stating it in covering letter....

@justwise don't look at me like this ké grin shocked.....U just might kno about some rights that is cloudy to me....

Hello house.
Pls I need ur help,i have put all papers together but d mortgage my hubby have is still in his ex's name,though it was both in their names but due to bad credit his name was removed, just d ex name & his surname.
After divorce he still own this particular mortgage to himself as his ex has others
He has been d one paying on the mortgage ,d bills,and all since divorse,all kids were giving to him from court as well.he has all payment receipts over 8yrs.and all papers pertaining to d house
Pls justwise, girlflo and everyone who can help.
Is it save to use this accommodation as where I will be in my application.if no what can I do.this is d only thing holding me back.
