When Aaron Greenspan submitted Freedom of Information Act (FOIA) requests asking for all criminal investigative files on Bola Tinubu (linked to 1990s narcotics investigations in Illinois), the FBI and DEA initially refused to confirm or deny whether any documents even existed.

This legal refusal is called a Glomar response" They claimed that revealing whether files exist would violate individual privacy under FOIA exemptions.


The Court Overruled FBI and DEA

Judge Beryl A. Howell rejected the agencies' Glomar argument.

The court pointed out that an affidavit filed back in 1993 by the US Department of Justice (DOJ) already officially acknowledged that Tinubu's bank accounts were investigated by agencies including the FBI and DEA.

Because the US government had already made that public years ago, the judge ruled that:

* The FBI and DEA **cannot** keep hiding behind privacy secrecy.
They must process the files, conduct proper searches, and release non-exempt documents to the public.
