Israel had an observer status the Organization of African Unity, the predecessor to the African Union

After a two-decade absence, Israel is returning to the African Union as a member with an observer status, Jerusalem announced on Thursday.

Israel’s Ambassador to Ethiopia Alaly Adamso submitted Israel’s charter to the continental body, according to a Foreign Ministry statement.

Israel had an observer status the Organization of African Unity, the predecessor to the African Union, which was dissolved in 2002.

The Jewish state has diplomatic relations with 46 of the 55 member states.

“This is a day of celebration for Israeli-Africa relations,” Alternate Prime Minister and Foreign Minister Yair Lapid said.

“The diplomatic achievement is the result of great efforts by the Foreign Ministry, the African Division and Israeli embassies on the continent," Lapid added. "This is a corrective step to the anomaly that was in place for almost two decades and it represents an important part of bolstering and fortifying the fabric of Israel’s foreign relations.”

The upgrade of ties between Israel and the continental body would allow all parties to collaborate in the war against terrorism raging throughout the continent, as well as against the coronavirus pandemic.

Findings by a UK newspaper indicated that Mr Kanu’s British passport remains in Kenya.

As the arrest of Nnamdi Kanu, the leader of Indigenous People of Biafra (IPOB), continues to stir controversies, evidences have shown that the Buhari regime “abducted” and repatriated him from Kenya.

Since Mr Kanu’s repatriation in June, the regime has kept mute on the country where he was taken from, even though his family, as well as his attorney, Ifeanyi Ejiofor, accused Buhari regime, in cahoots with government, of abducting Mr Kanu.

Mr Ejiofor claimed that Kenya’s special police force detained and tortured the separatist leader before he was later handed over to the Nigerian government.

Before Mr Ejiofor’s assertion, the Kenya High Commissioner to Nigeria, Wilfred Machage, had refuted claims that Mr Kanu was arrested in the country, describing it as “deliberately concocted to fuel antagonistic feelings in the minds of certain sections of the Nigerian people against the people of Kenya.”

However, findings by The Guardian, a British outlet indicated that Mr Kanu’s UK passport remains in Kenya.

He was said to have entered the East African country this year with the passport on a visa expiring in June, the newspaper said.

Also, Kingsley Kanu, a brother to the British-Nigerian citizen, claimed that they spoke over the telephone, a few days before his arrest in June.

“I spoke to him on the phone, he was well, in Nairobi. His associates said he went out, he didn’t take his documents with him so he wasn’t planning on going anywhere. Then all of a sudden we see him paraded in handcuffs in Abuja,” the outlet quoted Kingsley Kanu to have said.

“It is an extraordinary rendition, aided by Kenyan authorities,” he said, just as he maintained that “It is an outrage that cannot be allowed to happen. We are holding the Nigerian government and Kenyan government responsible.”

Kingsley further disclosed that the government of UK was in contact with the separatist leader’s legal team as there are worries that he would be abused in detention.

Last week, the Head of Communications, British High Commission in Abuja, Dean Hurlock, confirmed that the Foreign, Commonwealth and Development Office would provide “consular” assistance to Mr Kanu.

“With regard to any questions about whether the British High Commission is providing assistance in this case, we can confirm that the Foreign, Commonwealth and Development Office stands ready to provide ‘consular’ assistance,” Mr Hurlock had said.

The IPOB leader was arraigned at the Federal High Court, Abuja, where the court ordered that he be remanded until the continuation of his trial set for July 26.

He faces an 11-count charge of treason, treasonable felony, terrorism and illegal possession of firearms, among others.

A group known as the Muslim Congress has submitted a memo to the Senate Committee on the Review of the 1999 Constitution, proposing the implementation of Sharia in the southwest region.

The Islamic religious law is implemented in Muslim-majority states in the Northern region, despite the constitutional provision that states be secular.

Sharia is alien to the southwest region which has an almost equal population of Christian adherents and Muslims.

The Senate commenced its zonal public hearings on constitutional amendments across the country on Wednesday, May 26, 2021, months after soliciting suggestions from the public.

While presenting its memo at the Lagos hearing on Wednesday, The Muslim Congress said it wants Sharia implemented in the Yoruba-speaking southwest to cater to its Muslim population.

TMC representative, Abdulganihu Bamidele said: "We want to partner for the creation of Sharia courts in the southwest because of our population of Muslims.”

The faith-based organisation also proposed amendments to the constitution focusing on gender equality, local government autonomy, state and community policing, and judicial and legislative autonomy.

Dozens of other organisations and individuals also presented their memos at the public hearing on Wednesday, with the most common topics revolving around gender equality, restructuring, and devolution of power from the Federal Government to the State and Local Governments.

Some also proposed that the 1999 constitution be completely scrapped and replaced with a new citizens-led constitution.

Senator representing Lagos Central, Oluremi Tinubu, who chaired the public hearing, said the Senate will consider all the public submissions to create the perfect document to address everyone's concerns.

The British Government has mandated under a policy document that has now been withdrawn for review, that any member of Biafran separatist groups intending to apply for asylum on the grounds of “political persecution” must be physically present in the United Kingdom, TheCable reports.

It also stated that the applicant must not be considered a security risk to the UK.

According to TheCable, it was disclosed that the UK Visas and Immigration (UKVI) had released new guidelines to its decision makers on how to consider and grant asylum applications by members of Biafran secessionist groups.

Asylum is to be granted to “persecuted” members of the Indigenous People of Biafra (IPOB), which has been labelled as a terrorist group by the Nigerian government, and the Movement for the Actualisation of the Sovereign State of Biafra (MASSOB).

The Nigerian government has oppossed the decision while IPOB has declared that what it wants is freedom through referendum, and not an asylum.

Although the UK has said that it is bound by specific resolutions to protect those in need, the decision is perceived as unfair to the Nigerian government.

The policy document has now been withdrawn for review with an update expected shortly, Lagos-based Radio Now reported.

Burden of Proof

In the ‘Country Policy and Information Note Nigeria: Biafran secessionist groups’ seen by TheCable, the UKVI, a division of the Home Office, stipulates that the credibility of every application must be assessed under ‘Asylum Policy Instruction’.

The policy states: “An asylum claimant will be granted asylum in the United Kingdom if the Secretary of State is satisfied that:

"He is in the United Kingdom or has arrived at a port of entry in the United Kingdom;
"He is a refugee, as defined in regulation 2 of The Refugee or Person in Need of International Protection (Qualification) Regulations 2006;
"There are no reasonable grounds for regarding him as a danger to the security of the United Kingdom;
"Having been convicted by a final judgment of a particularly serious crime, he does not constitute danger to the community of the United Kingdom; and

"Refusing his application would result in him being required to go (whether immediately or after the time limited by any existing leave to enter or remain) in breach of the Geneva Convention, to a country in which his life or freedom would threatened on account of his race, religion, nationality, political opinion or membership of a particular social group.
"The subsisting policy on 'assessing credibility and refugee status' has been in place since 2015 and applies to those applying for asylum and refugee status.

"A claimant who makes an asylum claim and then leaves the UK will no longer be considered.

"The burden of substantiating a claim lies with the claimant who must establish that they qualify for international protection, the guidelines state.

"Paragraph 339 of the UK Immigration Rules emphasises the burden on the claimant to provide an evidence and the duty of the caseworker to assess the information put forward 'in co-operation with the person.'"

The UKVI says its caseworkers must “examine, investigate and research the available evidence and, if appropriate, invite submission of further evidence, although the caseworker may well be in a better position than the claimant to substantiate aspects of the account”.

Weight of Evidence

Evidence to be considered in dealing with asylum requests includes:

Screening Interview (SIR)

Statements made to an Immigration Officer prior to the claim being made, or information supplied when they applied for a visa

Preliminary Information Form (PIF)

Asylum interview (SEF – Statement of Evidence Form)

Other evidence submitted by the claimant, e.g. written statements, newspaper or internet articles, witness statements from family or associates, police or medical reports, political party membership cards

Country of origin information (COI)

Files relating to previous applications by the claimant or their relatives

Passports: where available, checked for entry/exit stamps, visas, to confirm the claimant’s immigration status and history

‘Section 8’ type conduct prior to asylum claim being lodged

When considering the weight to attach to any overseas documents (for example, official certificates or arrest warrants), the claimants are required to show that those documents can be relied on.

Caseworkers are to “assess whether a document is one on which reliance can be placed after looking at all the evidence in the round”.

In practice, this means that “a document must be considered together with other evidence, oral and written, that goes towards establishing the particular material fact”.

Relevant legislation

The Nigerian government thinks the decision is disrespectful gesture from the UK because Biafran separatists are officially branded as terrorists.

However, there are legal statutes upon which Nigeria’s former colonial masters might have based its decision.

The UKVI says the 1951 Refugee Convention is the primary source of the framework of international refugee protection, originally limited to persons fleeing events occurring before January 1, 1951 and within Europe.

The 1967 Protocol gave the convention universal coverage and has since been supplemented in the European Union and other regions “by a subsidiary protection regime, as well as via the progressive development of international human rights law”.

Another is the European Council Directive 2004/83/EC which was rearranged into UK law through The Refugee or Person in Need of International Protection (Qualification) Regulations 2006 and the Immigration Rules.

Other statutes are: Part 11 of the Immigration Rules setting out the provisions for the consideration of asylum claims and reflecting UK obligations under the Directives; and section 8 of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 which requires decision-makers to take into account the claimant’s conduct when applying the benefit of the doubt to unsubstantiated material facts.

LESS than 24 hours after bandits launched an attack on a military camp in Zagzaga community in Munya Local Government Area of Niger State, the Nigerian Army has shut down its camp and evacuated its soldiers from the community.

The Army, supported by the youths in the community, has equally begun a search for one missing soldier after the attack.

On Wednesday morning, about 60 bandits invaded a military camp in the said community and engaged soldiers in a gun battle, even as some of the bandits were said to have been seriously injured.

None of the soldiers was injured in the attack except the missing RSM of the camp.

A source close to the community told this medium that few hours after the soldiers moved out of the community in what the Secretary to the State Government, Alhaji Ibrahim Matene, said was a “tactical withdrawal”, the bandits had launched coordinated attacks on some communities in the area.

About 15 persons were said to have being abducted from these communities in the midnight attacks, leaving the areas now completely deserted as the people reportedly relocated to neighboring villages.
