For example, if someone had consensual sex and then later found out that that partner is underaged; it is still statutory rape.
But in this case, the person has a justification.

If it is taken as statutory rape, then it means that the excuse of not knowing was not acceptable.. Still means that it is not justifiable..

If you murder someone in self defence or under some other conditions, murder can be down scaled to man slaughter or less years of punishment given...

Same with stealing. Punishment can be tempered based on the motivation...

But for rape, whether one person dressed inappropriately or not, whether you were both under influence or not, rape is rape.. It can not be justified...
