...We’re in war situation, Senate President says Senate President David Mark yesterday said conducting elections in 2015 is “not on the table” for now because the nation is at war with Boko Haram. Mark spoke during a debate on a motion titled “Threat to National Sovereignty and Territorial Integrity of Nigeria by Insurgents”, moved by Senate Leader Victor Ndoma-Egba (PDP, Cross Rivers) and 44 others. “There is no question of election; it is not even on the table now. We are in a state of war,” the Senate President said, on the day the National Assembly reconvened after weeks of recess. Boko Haram has been holding several towns and villages in Borno, Yobe and Adamawa states for weeks now, starting August 6 when they seized Gwoza and later proclaimed it part of an Islamic caliphate. “When Boko Haram moved from kidnapping, killing of people and destruction of property to occupation of parts of Nigerian territory, it has declared total war in Nigeria,” Mark said yesterday. “There is no difference between what Boko Haram is doing against Nigeria and what an enemy country waging war in Nigeria would have done.” He added: “The issue is beyond that of mere internal security. It is about how we execute the war. If Boko Haram has captured most of the parts of the country we represent and has created a caliphate, it means that some of the senators from those areas can no longer be in this chamber. This is why we must pay urgent attention to the matter.” The issue of whether elections could be held in states under emergency rule came up late last year when the Independent National Electoral Commission hinted that it may not be feasible to hold the 2015 elections in those places. This attracted widespread condemnation especially from opposition politicians who said it was a ploy to disenfranchise Nigerians and favour President Jonathan. INEC later clarified that it never said there would be no elections in those states. But there has been suspicion in some quarters that the raging insurgency could be used as a reason to suspend all elections nationwide. Speaking during yesterday’s debate, Deputy Senate President Ike Ekweremadu expressed fear that the 2015 general elections might suffer serious problems because of the prevailing security problems. He argued that some provisions of the Constitution are clear that if the nation is at war, the issue of election could be jettisoned. The 1999 Constitution provides that when the nation is at war elections could be suspended and tenures of politicians extended for a renewable six-month period through a resolution of the National Assembly. Section 135 of the Constitution says: “If the Federation is at war in which the territory of Nigeria is physically involved and the President considers that it is not practicable to hold elections, the National Assembly may by resolution extend the period of four years mentioned in subsection (2) of this section from time to time; but no such extension shall exceed a period of six months at any one time.” The subsection referred to here affects the tenure of the President. There are other similar constitutional provisions on extending the tenures of state governors, and federal and state lawmakers under sections 180, 64 and 105 respectively. After a heated debate, the Senate resolved to mandate its leadership, relevant security committees and all senators from the three troubled states of Adamawa, Borno and Yobe to meet with President Jonathan to ask him to declare “total war” on Boko Haram. ‘Saboteurs in military’ There was an outrage in the Senate chamber during the debate as senators who spoke accused the military of not doing enough to contain the insurgents. Senator Emmanuel Bwacha (PDP, Taraba) said, “The biggest problem within the military is that there are Boko Haram members within the military. I am calling on the Nigerian military to look inward. The political class is also not helping matters. There are those who are benefiting from this problem and they will not want it to stop.” In an emotional speech, Senator Mohammed Ali Ndume (APC, Borno), whose constituency has been ravaged by insurgency, accused his colleagues of not doing enough to help end the war because it did not affect them directly. Ndume said the Senate should have been recalled from recess a month ago when the insurgents overrun Damboa, and subsequently parts of Adamawa and Yobe. “The Senators has not done enough. Are we not citizens of Nigeria?” he asked. Ndume said the emergency rule proclaimed in Borno, Yobe and Adamawa since May last year has failed. He said also reports from the affected area said only 100 insurgents chased away over 500 soldiers who were supposed to be better armed. Senator Solomon Ewuga (PDP, Nasarawa), for his part, said: “There is no morale within the military and until it takes up the responsibility, it cannot give us value.” Deputy Senate Leader Abdul Ningi (PDP, Bauchi) said the activities of Boko Haram have developed into a full-scale war, and therefore called for the suspension of electioneering activities in affected states until the war is won. Senator Alkali Jajere (APC, Yobe) told senators that he has hunted for 20 years in Sambisa forest where the insurgents are said to be operating from and wondered why the military has been unable to rout them. Senator Bukar Abba Ibrahim, who represents Yobe East, told his colleagues that half of his constituency has been captured by the insurgents. The Senate also yesterday referred the request by President Jonathan to borrow $1billion (about N160 billion) for the war on Boko Haram to its committee on Finance, to report back in a week. Security sources said the insurgents were “on a revenge mission after the heavy casualty they recorded last Friday.” Last Friday, the insurgents met stiff resistance from Nigerian troops and members of the vigilante group, also known as civilian JTF. Over 100 of their members were reportedly killed by Nigerian troops who rounded them up after a tip –off. One of the security sources, who does not want his name in print because he was not authorized to speak said the fight was ongoing as at 8pm. “From the information we have so far, the insurgents were armed to the teeth. They have mortars, anti aircraft missiles, rocket propelled grenades and assorted guns with a cover from Armoured Personnel Carriers (APCs). “As I am talking to you now, our men are engaging the terrorists… Their ultimate target is to subdue our men in Konduga so that they can advance to Maiduguri,” he said. Workers of the Nigerian National Petroleum Corporation (NNPC) and the Department of Petroleum Resources (DPR) yesterday embarked on an indefinite strike over their managements’ refusal to fund the pension system as stipulated in the PENCOM Act. The workers, under the aegis of the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN) and the Nigerian Union of Petroleum and Natural Gas Workers (NUPENG), had Friday staged a protest to the NNPC Group Managing Director office and presented a memo on their decision to down tool. They also listed problems related to inadequate supply of crude to the country’s four refineries as well as failure to carry out major overhaul of the refineries. One of the union leaders, who pleaded for anonymity, said with the strike, crude oil exports would be affected, gas supply to the power generation companies would be shut down and all activities at the jetties as well as depots would be suspended. The meeting summoned yesterday by the NNPC management with the unions ended deadlocked. At the NNPC Towers in Abuja yesterday, our reporter gathered that official activities were hindered as some of the workers left before 1.00pm. In Lagos, the workers’ leadership under the auspices of PENGASSAN and NUPENG held a closed door meeting with the NNPC management on the issue. Meanwhile, queues of vehicles were yesterday witnessed at some filling stations in Abuja as the news of the strike broke. The workers had last Friday issued a three-day ultimatum to management. The deadline according to Babatunde Oke, PENGASSAN media officer, expired yesterday morning. Oke said all the workers at the NNPC branches nationwide had been mandated to shun their offices from today to press home their demand. The National Pension Commission (PENCOM) had last week revoked the licence granted to the NNPC Pension Fund over failure to meet its requirements. A letter dated September 8, 2014, addressed to the Group Managing Director NNPC, and signed by the Ag. Director General, PENCOM Chinelo Anohu-Amazu put the deficit in the scheme by NNPC at N133.56billion (inclusive of the N182.26bn receivable from NNPC) as of December 31, 2012. The PENCOM is concerned that eight years after the grant of approval to continue with the existing scheme, the NNPC has failed to honour its promises to fund the deficit despite several reminders..
