Contrary to earlier denials, embattled ministerial nominee, Musiliu Obanikoro, has confessed to several Senators in Abuja that he did participate in an election-eve meeting in Ekiti in June 2014 in which a group of politicians and government ministers met with a Nigerian army general to rig the governorship election in favor of Ayodele Fayose, the candidate of the People’s Democratic Party (PDP). The meeting, which is now known as “Ekitigate”, was secretly taped by an army captain who was subsequently forced to flee for his life. Despite the scandal, President Jonathan went ahead to nominate Obanikoro into his cabinet for the second time, and the nominee is lobbying the Senators to give him a pass during his upcoming nomination hearing. It is in the process that he has confessed to some of them that he was indeed present at the rigging meeting in Akure, on behalf of the President, to ensure that everything went smoothly. Obanikoro’s story is that he was simply making “peace” between the army and Ayo Fayose at the meeting, claiming that he was not party to any conversation about rigging. On the contrary, Obanikoro, who was at the time junior Minister for Defence, is overheard clearly on the tape bragging about the authority granted him by President Jonathan. Prior to admitting his involvement to the Senators, the former minister met with President Jonathan to discuss the tape and his role. A presidency source said Obanikoro told President Jonathan he was present at the meeting but that a part of the audio-recording was “doctored”. They said President Jonathan had called him to the meeting to discuss how to mitigate the damage created by the leaked tape. He told the Senators categorically that it was Jonathan himself who had sent him to Ekiti to help Fayose win the election. On the tape, Obanikoro says, at least twice, that he is on a “mission” for the President. He also reportedly told President Jonathan at their meeting that he had asked his US-based lawyers to do a separate voice analysis of the tape and that the lawyers came back with “proof” that certain aspects of the tape had been doctored by SaharaReporters to make the regime look bad. Counting on that assurance, President Jonathan told a team of reporters from the Wall Street Journal during an interview that the tapes were not real and that he would not investigate the incident. Obanikoro also told President Jonathan that his US- based lawyers had assured him that they could file some cases against SaharaReporters in the US to “teach SaharaReporters and its publisher, Omoyele Sowore” a lesson. He explained to the president that with enough financial support, his lawyers would file the case and also employ private detectives to take down SaharaReporters. President Jonathan reportedly nodded at the idea, and asked Obanikoro not to worry. Following that meeting, the former Minister began a series of legal threats last week claiming to have sued SaharaReporters, as well as The Punch newspaper and Premium Times, both in Lagos. Up until now, those newspapers are yet to be served copies of the lawsuit. On Tuesday night, Obanikoro, who is also a US citizen, assured some of the Senators that his US lawyers had already filed the libel suit against SaharaReporters in New York. On Wednesday, Obanikoro deployed a small rented a crowd of protesters to hold placards in front of the National Assembly to denounce the All Progressives Congress. It is to be noted that two other key participants at the meeting, Police Minister Jelili Adesiyan and Ayo Fayose, the beneficiary of the Ekiti governorship rigging, have admitted that they were at the meeting that was taped by the army captain. For Obanikoro’s role in the rigging of the election, APC has advocated his being banned from holding any public office, and asked the Senate not to confirm him. SaharaReporters has learned of a new twist in the desire of some top officials of the Peoples Democratic Party (PDP) for a six-weeks postponement of polls in Nigeria, with several sources saying a faction of the party would work to replace President Goodluck Jonathan as the party’s presidential candidate. In separate interviews with SaharaReporters, numerous PDP officials disclosed that many founding members of the party had lost confidence in Mr. Jonathan’s viability as a candidate, adding that a faction within the party had discussed easing the incumbent president out of the presidential race, and replacing him with another candidate from the Niger Delta zone. “The only obstacle to the plan is that the South-South might kick against it, so we have arrived at a consensus to find another candidate,” one of our sources, a northerner, said. “If elections could be postponed for six months, we will definitely replace President Jonathan as our candidate,” another member of the faction confirmed. In a clear sign that the party was crumbling was within, several high ranking PDP members said they regretted letting President Jonathan carry the party’s flag as a presidential candidate in the forthcoming elections. One party leader revealed that some candidates in the northern area were all but campaigning for Mr. Buhari, the presidential flag bearer of the opposition All Progressives Congress (APC). However, some PDP officials told SaharaReporters that, while they hoped that President Jonathan could be sidelined to increase the chances of the party in the upcoming elections, they also wished that the APC would also dump Mr. Buhari as its presidential candidate. The party officials claimed that key political figures across Nigeria continue to view a Buhari Presidency with mortal fear because of his stubborn personality and his promise to punish the corrupt. Several of the PDP officials told SaharaReporters that the rift between Mr. Jonathan and a large faction in the party that wants him dumped was reflected in the responses to former President Olusegun Obasanjo who two days ago dramatically announced his resignation from the PDP, publicly tearing his membership card. Two of the officials disclosed that, while Mr. Jonathan’s aides launched direct attacks on Mr. Obasanjo, the officials at the party headquarters in Abuja adopted a more cautious and subdued tone, regretting that the former president had decided to leave the party. Some officials stated that the party hierarchy viewed Mr. Obasanjo’s public departure from the party as a dangerous signal and as a major threat. “Chief Obasanjo doesn’t just come out swinging the way he has done recently unless he is privy to the existence of some third forces that are against President Jonathan. And to the best of our knowledge, the former president has never fought a battle like this and lost, no matter how long it takes him,” one of the officials said. “The truth is that many senators, honorable members of the House of Reps and governors are loyal to Baba, Chief Olusegun Obasanjo. So they are doing Baba’s bidding even though they are giving Mr. President [Jonathan] the impression that they are with him,” another party official in Abuja said. The party officials acknowledged that the statements of former President Obasanjo in the last three days had caused a major havoc on the party’s plans to work towards an interim national government. Several of the PDP officials attributed the fractiousness within the party to the way Mr. Jonathan and his wife, Patience Jonathan, imposed unpopular candidates on the party in various parts of the country. Even though they agreed that Mr. Obasanjo had imposed candidates on the party in the past, one PDP official said the Jonathans consistently backed candidates who were extremely unpopular within the PDP and unelectable. Asked if President Jonathan was aware of plans to replace him, some of our sources said the president knew that many powerful members of the party were not satisfied with his style and low performance. One source said former Vice President Alex Ekwueme and even the party’s chairman of the board of trustees, Tony Anenih, were far from enthusiastic about Mr. Jonathan’s re- election. “President Jonathan’s candidature and unpopularity are damaging the party,” one official stated. He added that the party’s electoral prospects in the general elections had dwindled dramatically. “We are only sure of carrying about 11 states in the country, according to our internal polls,” one party official disclosed. “…It must be stated, by way of emphasis, that the Armed Forces have no role in the conduct of election (and) must not be involved except perhaps, in the area of providing logistics services to the agencies of government in the preparation for the election. ” —Justice Abdul Aboki of Court of Appeal, Abuja, on Monday, February 16, 2015 The courts have spoken! The Nigerian judiciary has ruled that the deployment of troops for election purposes is an aberration, an infraction on the Nigerian constitution and the Electoral Act. First, a Federal High Court sitting in Sokoto on Thursday, January 29, 2015 had declared that the deployment of military for election duties in the country is unconstitutional. Justice Mohammed Rilwan, who gave the ruling while delivering judgment in a suit challenging the deployment of the military for election duties, said that apart from protecting Nigeria’s territorial integrity, there is no constitutional provision for the deployment of the military for elections. In the case instituted by the Deputy Speaker of the Sokoto State House of Assembly, Bello Goronyo, the Judge said that for the Federal Government to do so, it must have recourse to the National Assembly which would enact such a law. On Monday, February 16, 2015, the Justice Abdul Aboki-led five-man Appeal Court sitting in Abuja upheld the position of the Federal High Court, Sokoto, on the matter. Justice Aboki gave the ruling in the Ekiti governorship election appeal case which was resolved in favour of the Ekiti State Governor, Ayodele Fayose. Justice Aboki raised some fundamental questions in coming to the conclusion reached which ousted the role of the military in elections. According to eminent justices of the Appeal Court, Abuja, “The question is that who ordered deployment of military or soldiers in the Ekiti governorship election? Was there any act of insurrection to warrant the call on the military to restore order? And was such deployment in accordance with Sections 217 (2)(c) and 218(4) of the constitution?” Their lordships submitted that, “There is nothing before us in the records in answering the posers positively.” “With this, whoever unleashed soldiers on Ekiti State disturbed the peace of the election on June 21, 2014, acted in flagrant breach of the constitution, and flouted the provisions of the Electoral Act which required an enabling environment by civil authorities in the conduct of elections.” The appellate court therefore barred the use of the Armed Forces in the conduct of future elections in the country. The court further averred that “Even the President of Nigeria has no powers to call on the Nigerian Armed Forces to unleash them on peaceful citizenry who are exercising their franchise to elect their leaders.” These two judgments cited above are heartwarming particularly at this critical juncture where the role of the military in politics is being viewed with distrust. It will be recalled that a couple of weeks back, an audio tape was allegedly released by one Captain Sagir Koli where a purported rigging plan of the June 21, 2014 governorship election in Ekiti State was perfected. The recording professedly captured some political actors in a meeting discussing strategies for rigging the Ekiti governorship election where they also allegedly gave directives to the military to favour the PDP, claiming they were working for the Presidency. Two of the dramatis personae were reported to have owned up to attending the meeting but disagreed with the context. It will be recalled that on June 19, 2014, the same military denied some All Progressives Congress stalwarts entry into Ado-Ekiti on a spurious “order from above.” It is this patent partisanship coupled with the fact that recently the National Security Adviser wrote to the Chairman of the Independent National Electoral Commission saying that the security agencies would not be able to provide security for the earlier scheduled elections on February 14 and 28 thereby causing INEC to shift the polls by six weeks that make these judicial pronouncements laudable. It will also be recalled that just last week, the national leader of the APC and a former governor of Lagos State, Bola Tinubu, raised the alarm about the siege laid to his house in Lagos by some soldiers. It also did happen that in Imo State last week, some soldiers allegedly acting on the orders of a minister of state blocked the entrance to the Imo State Government House with Armoured Personnel Carriers. The APC had also cried out that the telephone lines of its national chairman and many of its chieftains may have been bugged. These are ominous. No wonder former president Olusegun Obasanjo also alleged partisanship on the part of the military. Now that the Federal High Court and the Court of Appeal, which is a superior court, have both made legal pronouncements on the role of the military in elections, what is the implication of these judgments on our elections? To my own mind, it does not bode well. Nigerian Armed Forces (Army, Navy and Air Force) as well as all major security agencies (Police, Civil Defence, Department of State Services, Federal Road Safety Commission, etc), about 16 of them, are all members of the Inter-Agency Consultative Committee on Election Security established by INEC in 2011 to provide some logistic support to the commission particularly in the distribution of both sensitive and non-sensitive election materials as well as provisioning of security for election personnel and materials. It is good that the appeal court had said the military can help out with the logistics. However, exempting them from providing election security needs to be revisited. Just last Friday, February 13, the National Human Rights Commission released a 80-page report where it stated that 58 persons had died in election violence across the country between December 3, 2014 and January 31, 2015. The Chairman, Governing Council of the commission, Prof. Chidi Odinkalu, while highlighting the contents of the report, noted that the 58 deaths had resulted from 49 election-related violence across 22 states in the country. If we had lost 58 lives within 60 days, that shows how volatile the forthcoming elections has been and will be. Can we then leave election security solely in the hands of the Nigeria Police, DSS and NSCDC? Will they be able to effectively police and secure the North-East zone and other hotspots across the country? It will be a suicidal gamble. In order not to act ultra vires, I hereby enjoin President Goodluck Jonathan to do the needful as prescribed by Section 217 (2) (c) by writing to the National Assembly on the need to approve the military deployment in aid of INEC which is a civil authority. This can and should be done now that the National Assembly is back to work after their recess. In approving this however, a well spelt-out code of conduct must be handed down to the military about their limited role of providing logistic support to INEC as well as complementing the police and the DSS in providing election security. The Presidential candidate of the All Progressives Congress, Maj. Gen. Muhammadu Buhari (retd), on Tuesday likened the remaining weeks to the 2015 elections to extra-time in football. He enjoined party leaders, supporters and members to avoid mistakes that could cost the party the elections by remaining resilient because their patience would be tested in the days ahead. Buhari said this at the Joint Leaders’ Meeting of the party, held at the Yar’Adua Centre, Abuja. According to him, he alongside leaders of the party travelled the length and breadth of this country, and had heard the cry for change which had become a common refrain among Nigerians. He noted that it was common knowledge that the country was passing through trying times “which was imposed on us by the bad Peoples Democratic Party administration.” Buhari said, “The imminent change in answer to the yearnings of our people has been delayed by the postponement of the February 14, 2015 elections. “Our patience and resilience will be tested in the days ahead. We must pass this test. “In a time like this, which in football analogy can be referred to as extra-time; we must avoid making costly mistakes. In the weeks ahead, I would like to implore you to remain true to the vision – to build a country that works for all of us and not just for the few. “To rescue and stabilise our nation from the hands of plunderers. On this, I believe we all agreed. “The important issue today is that we must use the next six weeks that have been imposed on us to re-charge and re-focus on our goal. The goal is to win the elections now slated for March 28 and April 11 with a convincing majority.” The APC candidate enjoined party members to aim for and achieve a victory that would be beyond dispute and proceed to form the next government and start work on the task of rebuilding our beloved country. He maintained that the objective of an APC-led government was “to build a great society that works for all, a country where every child has an equal opportunity to get an education, where every young Nigerian who needs a job can find one and where the sick are looked after and senior citizens are provided for. “And most importantly, a country which gives value to human life, where the welfare and security of all is a national priority and corruption is defeated.” In his first reaction to the alleged use of soldiers to rig the Ekiti governorship elections, Buhari described the revelations made by Captain Sagir Koli as “worrisome.” He also said the fact that there had yet to be an official denial of the most unfortunate event, “makes me wonder, in the circumstances that led to shifting of the date of the Federal elections, whether the security services are even now being prepared to play a similar role in the March 28 and April 11 elections.” The retired General enjoined Nigeria’s security services to remain committed to their constitutional responsibilities to Nigerians and to avoid the temptation of allowing themselves to be dragged into partisan politics. While stating that he had tremendous respect for the security services, he enjoined the hierarchy of the military to stick to and concentrate on their constitutional duties to avoid further complicating our national situation. Buhari commended members of the APC for making the requisite sacrifices which culminated in the momentum, which he said, the party was enjoying. Earlier, a prominent leader of the party, Asiwaju Bola Tinubu, had likened milestones recorded by the APC within its short lifespan to bringing down the Berlin Wall. He specifically expressed gratitude to Buhari for leading the party to avoid the booby trap set by the PDP. Tinubu said, “We have to be further vigilant. Thank God that our presidential candidate is now more democratic and more obedient than ever before. The booby trap set was for our supporters to react (to the postponement) violently so that they will declare a state of emergency but he (Buhari) led us from that trap. “The PDP government is desperate to cling to power; we are determined to take power from tyrants. No one will serve you power, the determination is yours. We know now that they have been unable to achieve the violent booby trap.” Tinubu congratulated the Osun State Governor, Ogbeni Rauf Aregbesola, for finding a “panacea for the PDP rigging machine” in Osun State. He said the party could benefit from his experience in the general elections. On March 28, 2015, Nigerians would be heading to the polls to choose a president who would govern them for the next 4 years. But unlike other countries, Nigeria has a complex political atmosphere too difficult to understand. While Buhari and the All Progressive Congress (APC) may appear to be gaining momentum at the moment, there are 5 likely reasons why Buhari may lose the coming presidential election. These reasons are disused below. 1) The Independence Of INEC Has been Compromised The independence of an electoral body is sacrosanct for conducting credible elections in any country. In Nigeria however, the independence of INEC has always been called into question. From the tenure of Abel Guobadia in (2000- 2005) to the tenure of Moris Uwu (2005- 2010), and even now that Atahiru Jega is at the helm of affairs, INEC is only as free as the government permits it to be. Both Abel Guobadia and Moris Iwu were criticized for overseeing elections that were not any better than that organized by the National Union of Road Transport Workers (NURTW). The reason why these men failed is not far fetched. Nigerian politicians will never permit a free and fair election. And from the dramatic way in which the February 14 poll was shifted, it appears President Jonathan is also not ready to permit credible elections on March 28. This may work against Buhari at the polls. The misconceptions about Buhari that he is a jihadist waiting to Islamise Nigeria may be his undoing. Nigerians are known to push religious sentiments above other important issues like competence, credibility, and good governance. That’s why many in the Southern parts of Nigeria would rather prefer to suffer under a Christian ruler than smile under a Muslim one. 3) The Nigerian Army Is now A Political Party Gone are the gallant days of the Nigerian Army. In recent times the Army has become a shadow of itself. In other countries, the military separates itself from politics and never blurs that line. During the Arab spring in 2011, the military in several Arab countries who had sit – in-tight dictators lived up to expectation. They tasked themselves with protecting lives and property and did not go further. In Nigeria, the opposite holds sway, the Nigerian Army has become a product of our decayed society. A career in the Army is now centered on looking for juicy postings and Ghana-must-go bags. Following the manner in which the Nigerian Army handled the Buhari certificate saga, it is clear whose side the military is on, the side of OUR OGA AT THE TOP . The one who can guarantee them juicy postings and jumbo retirement benefits, President Jonathan. With a partial military guarding the ballot boxes, Buhari would likely lose on March 28. The People’s Democratic Party has been in power for 16 years with little to show for it. The Party is well known for surrounding itself with individuals who lack credibility, from Alamieyeseigha who jumped bail in England by dressing as a woman to James Ibori and other politicians who see credibility as a virtue too expensive to afford. The dust raised by the N70 million presidential campaign funds released by the Minister of Petroleum Resources, Diezani Alison-Madueke, to the Bayelsa chapter of the ruling Peoples Democratic Party is yet to settle even as the chairman of the party in the state, Sam Inokoba, has dismissed moves to probe and unseat him. Mr. Inokoba allegedly received the N70 million from Mrs. Alison-Madueke but declared N30 million to the state executives of the party. The party in the state descended into crisis after Mrs. Alison-Madueke reportedly informed party leaders during the PDP’s presidential rally in the state that she advanced N70 million to the party for the rally. Mr. Inokoba was embarrassed and became uneasy when he was confronted, party insiders said. Members of the Bayelsa State Executives of the PDP have since set up a panel to probe the chairman on the allegation of diverting N40 million out of the N70 million earmarked for President Goodluck Jonathan’s rally in Bayelsa. The state Publicity Secretary of the party , Osom Macbre, confirmed that the party’s State Working Committee had set up a panel to probe the chairman. PREMIUM TIMES gathered that the panel hurriedly met and suspended the chairman while the search for a replacement has since begun. Mr. Inokoba shunned the invitation of the state working committee to respond to the allegations, party insiders said. He maintained that he disbursed the funds in compliance with the wishes of the donor and was not guilty of diverting party funds as alleged. He further argued that the State Working Committee of the PDP lacked the powers to discipline him. In a statement reacting to his reported suspension, Mr. Inokoba said the move violated Section 10 subsection 7 of PDP’s amended constitution which vested such powers on the national leadership of the party. He described the reports of his suspension as “rumour and unconstitutional”. Mr. Inokoba did not answer or return calls made to him Thursday night seeking comments. |

Sixty civil society groups organized in support of credible and transparent elections in Nigeria called in Abuja, Saturday, for the resignation of military chiefs and security heads including the Police “on account of their inability to exercise their constitutional responsibility to secure lives and property at all times including during the elections.” The group, otherwise named the Nigeria Civil Society Situation Room (Situation Room), came short of characterizing the actions of the military and security chiefs as a coup against democracy in a strong statement signed by Agianpe Ashang, Senior Programme OfficerPolicy and Legal Advocacy Centre, PLAC, shortly after meeting with the INEC Chairman, Attahiru Jega in his Abuja office, Saturday. Nigerians should be vigilant and be ready to protect this hard won democracy, said the group after Mr. Jega told them that he had received a letter from the security services advising that he postpones the general elections. He said they based their reasoning on the grounds that they were engaged in a renewed battle against insurgency in the North- East that would require their full concentration. The reasoning of the military and security leaders is bound to come as shock to many Nigerians who appear to be very enthusiastic about the elections. According to a political survey recently conducted by the NOI polls, analysis by geo-political zones revealed that the North-West (89% ) and South-East (87% ) regions accounted for the largest proportions of Nigerians who expressed optimism for voting in the 2015 general elections when compared to other regions, although a majority of residents in all the geo-political zones expressed optimism in voting in the 2015 general elections, with a minimum 76% (North Central). Also, respondents aged 46-60 and 18-21 years showed more optimism for voting in the 2015 elections than other age-groups. In the letter, Mr. Jega said, the military was demanding a rescheduling of elections by at least six weeks in the first instance. He was was accompanied by 12 of his National Commissioners. Members of the Situation room told Mr. Jega and his team that the action of the security chiefs “amounted to blackmail and arm- twist the Election Management Body away from its constitutional guaranteed function of conducting elections. Situation Room also condemns this advisory by security agents that they cannot guarantee the security of citizens, election officials and materials during the election. The Situation Room is made up of Civil Society Organisations (CSOs) working in support of credible and transparent elections in Nigeria and includes such groups as Policy and Legal Advocacy Centre (PLAC), CLEEN Foundation, Action Aid Nigeria, Centre for Democracy and Development (CDD), Enough is Enough Nigeria, Wangonet, Partners for Electoral Reform and Youth Initiative for Advocacy, Growth & Advancement (YIAGA).
